Ransack and demolition of Dalit temple with connivance of police- Santokhgarh

  • Summary:: This incident happened in Santokhgarh, District Una. A 52 year old Shri Guru Ravi Das temple was situated next to the Dalit houses. In 1990 Chabba (Bhramin) families had filed a case in the Court. According to them Shri Guru Ravi Das temple was constructed on their land. There are total 42 Chabba families. The temple covered an area of 18 Kanal (as per H.P Govt. land measurement). This case has been running in the Court for the past 15 years. In 2000 the Chabba family illegally got land entitlement of the temple land through the government land distributor, because of which the Dalits lost their case. The Dalits appealed in the High Court Shimla, they lost their case even in the High Court because the advocate never mentioned it was a temple, he always addressed it as a room. The Hon’ble High Court of Shimla gave direction on 28-12-2004 to demolish the temple. On 28-12-2004 the Dalits from Santokhgarh village as well as from nearby village encircled the temple, because of which the Chbaba families could not demolish the temple and the police also went empty handed. Chhaba families again approached the Court for the dates and the Court again on 22-01-2005 directed for demolition. On 21-01-2005 evening 6 battalions force reached Santokhgarh village and next day early morning i.e 22-01-2005 the Dominant caste people along with forces ransacked and demolished the temple. Pargaso Devi, a Dalit woman saw everything and alarmed all the Dalits about it. Police did not allow any Dalit to come near to the temple. The situation became uncontrollable; police started throwing stones towards Dalits. Vidiya Devi, a Dalit woman was badly injured. Later police started firing tear gas and plastic bullets due to which many Dalit men got injured. Chabba families with the help police were able to demolish the temple. After this the police went towards the Dalit basti and started arresting them. Police arrested 103 Dalit men. They all were accused of attempt to murder under Sec. 307 of IPC. In total 6 children, 24 ladies and rest were young and old men were arrested. From morning to evening the police tortured and beat them black and blue. There were 8 people who belonged to state Punjab and amongst those 8 people there was an Ex MLA, Singararam Sahungda from Gadshankar village. On the same day all the arrestees were sent to District Jail, Una. On 23-01-2005 around 7pm, the District Court granted bail to all the women and the remaining people were sent to Kanda jail Shimla. They were kept in jail for 35 days. Dalits from all over the Himachal Pradesh went for protest. Finally HC ordered to release them. Dalits were still accused under section 307 of IPC. This case was taken up by NCDHR and was also presented in Patna Pubic Hearing. In regarded to this case Shri Mayawati on 10-04-05 came to District Una and addressed the mass gathering. Police compromised with the Dalits and granted 22 lakhs and granted them land exactly next to Chabba families for the construction of the temple. Now a five story beautiful temple has been constructed. On 22-01-2007 statue which was brought from Jaipur was installed. Every year Jod Mella is organized, people from nearby village also attend this Mella. Case was compromised by police.

Dalit Woman Burnt Alive following Previous Enmity

  • Summary:: The incidence has taken place in Uttar Pradesh, 50km from Bulandshahar Dist. Tehsil and Police station Kotwali Dibai, at village Dangarh. Village consist of numbers of caste such as Thakur, Muslim, Baniya, Chamar, Dhobi, Kumhar, Mali, Brahmin, etc in the same village there lived Ratiram, 52 and his wife Naniya, 50 of Chamar (SC). While Naniya was sleeping on a cot, Rajputs of the same village poured Kerosin oil and burnt her to death. The persons accountable and responsible for the death of Naniya were Harish, Chandrapal, Megasingh and Pappu and his sons of Manveeran Singh, Dangarh village, post office and police station Kotwali Dibai, district Bulandshahar, belonging to Rajputs by their caste. Tracing the recent history back the Rajputs and found guilty of a number of misbehaviors and other offensive activities. They used to gamble, supply liquor, womanize, rape, etc. They even used to sell the trees belonging to the government. They had been habituated with encroaching other’s land in the village. And when people start speaking against them then they would murder them. While the accused were setting the wire over the house of Ratiram, they beat him on that day for he opposed the putting up of the wire in the year 2004. The revengeful attitude thus instilled in them from that day on waited for the day to revenge. Irritated and awestruck all the members of the family except Naniya and her mother in law went to Chandigarh in Punjab to work in a bricks factory. It so happened that on the eve of the incidence the mother in law of Naniya went to the neighborhood and slept there at night. Taking the chance of the night the accused entered the house of Naniya and poured kerosene around the cot she was sleeping and put fire on that. Naniya was alone and there no one could come and rescue her from the fire. The family members were given message of her death over the telephone.

Dalit Woman Stripped Naked and Beaten Severely

    Padamata kesavpur village is in Bachannapeta mandal in Warangaldistrict. Different castes People are living in that village. It consists 40 Madiga, 30 Mala, 80 Yadavs and Kurmas,(BC) 20 Padmashalis, 20 Gowdas40 Reddys, 4 vysya, 2 vadrangi.(OC). Reddys are the dominant caste in the village. Kommu Laxmi (32) w/o Yadaiah is a resident of Kesavpur village. She is SC (Madiga). They have 2 daughters and two sons Sirisha, Uma (9), Srikanth (14) and Sridhar (12). Yadaiah was employed by the Panchayat to see the water related works. Laxmi is a labourer.

     

    Six months ago Yadaiah (40) eloped with Rajamma (40) w/o Samalapalli Ramulu to Nizamabad. They were brought back to the village and the Panchayat advised them to live with their respective families. But Rajamma’s husband refused to do so because she eloped with a dalit. They went back to Nizamabad again. After few months Yadaiah called up Laxmi on phone to come to Nizamabad because he is unwell and Rajamma is not taking good care of him. On 1-1-2005 Laxmi went to Nizamabad and brought them back to the village. Namosu Megamala shouted at her saying “How dare you to bring them back to the village. I will see your end”.

     

    On 4-1-2005, when Laxmi’s family was sleeping in their house, Samalapalli Ramulu (40), 2.Samalapalli Ratnakar (16), Namosu Megamala (30), Rajalingam(40), Srinu (25) armed with bamboo sticks and knifes attacked Laxmi and removed her clothes. They have beaten her with sticks on her breasts and kicked her on her genitals. They abused her badly and dragged her on the road and stabbed on her back. She was injured severely and bleeding badly. They also injured her mother in law Pochamma. On 5-01-2005police took her to the hospital in Janagaon. All this happened because her husband (SC) eloped with Rajamma (OC) and Laxmi brought them back. The higher castes people saw this as a sin. Police have registered a FIR and taken the accused in to custody. The case is pending in Special Court. The victim got only a little immediate relief from the MRO and she did not get any compensation.

Atrocity on 300 Villagers of Sayar Gaoni

  • Summary:: Sayargaon is situated 18km far from the Sathpada PS, AND Sathpada PS is 25km far from the district head quarter Bidisha. In Sayargaon 50 to 60 Thakur families, 20 to 22 Pal family, 10 to 12 Sahoo family, 8 to10 Brahmin family and 8 to 10 Dalit family resides. Other dalits lives in the field. There is a medium school in the village and conference hall of forest department. Forest department of Madhya Pradesh has established forest committee in villages. The head of the committee has to propose and select the land where forest department will be having plantation. In Sayargaon Ranbirsingh Tomar who belongs to Thakur is the head of forest committee. In the village thakur has 200 to 500 acres of land but dalit has only 2 to 4 acres and other dalits are landless. According to the committee Dalits land were selected for the plantation where as thakur also has extended land near the forest. The proposal was granted by the committee and survey was done by the forest ranger and found out that dalit had occupied some forest land. So the dept has taken the land under their control where dalits had planted some trees. Forest dept had plantation of 25 hector land and has set boundary and closed the roads of the dalit field to village. So there is now only way to enter the village that is to cross a river, the river is of 15ft deep and100 ft wide there is no boat to cross the river so the dalits cross the river with the help of a wire and tube. Once the wire broke and 60year old Tularam along with 5to 6 people were saved while drowning in the river road. Mostly sick person are affected they cannot go out for better treatment, due to lack of treatment Rajashree(25) has lost her eyesight. Due to the road blockage 50 dalit students has not gone to school since last 4 month because they have to cross the river and walk 10km to reach the school and it takes almost 3hr. Parents also has stopped sending their children to school. When dalits oppose the plantation and road blockage they were beaten even the old and women were injured. When the victim went to file FIR, they were frightened away. Dalits have given complaint to higher officials of forest department, Chief Minister, collector but there is no action taken about it.

Rape of a Dalit woman in Mahesh Nagar

  • Summary:: Victim Santosh Devi (23) w/o- Giriraj Bairba is a dalit women, on the day of incident she was at home in 81 Tagore Nagar, Near Kartar Railway gate. Her brother in law Yadram(8) was in the house with her. The accused Rajaram Jat, is a police constable, is the friend of her husband Giriraj. Rajaram used to come to their house, that day also he had come to give Rayfal oil for her mother in law and went out with her mother in law and sister in law. They had gone to collect fire wood from the fruit market. But at 12.30pm Rajaram entered the house by jumping a wall and send Yadram to get candy from the shop and took shontosh devi and raped her. When her husband came for lunch she informed him about the incident and they filed FIR against Rajaram.Police arrested Rajaram and put him jail. Santosh Devi is getting constant pressure to compromise in the case now. She has fear and doubts that if they will compromise; her husband will get money and divorce her.
