Social boycott of Dalits in Signahali village

  • Summary:: This is an incident of Signahalli village which is located 18kms away from Dharwad district head quarter in Karnataka. There are 582 families residing in the village which comprises 40% of Marathas and Lyngayaths families 50% Muslim families and 10% dalit families. Most of the upper communities own cultivable land and dalit working in their filed as agricultural laborer. Dalit who belong to Hindu Madhare community are still performing the manual scavenging and burying the dead bodies. In the village contract license to run the fair price shop usually given to the person whom the village people nominate by conducting ward meeting. In the year Naggapa who belongs to Maratha community was running the shop with license but mismanaging it by giving 1/2kg rice instead of 3kg to school children and selling the food grains in private market. So people complaint about it and the license was given to Shettappa Madhare (55) with the decision of the villager in the month of November 2001. Naggappa became furious with the decision and threatened Shettappa to kill him if he runs the shop. In several events in the year 2004 Naggappa’s brother Sivappa created problems for Shettappa and his co worker Mallawwa in the fair price shop by falsely blaming them for Mismanagement of the shop. They have also abused in the name of case and by using all filthy slangs to the victims. They conducted a meeting and declared that they will boycott Shettappa and his supporter from the society. The victim had gone to file complaint many times but the police authority did not take the complaint instead one of the constables once threatened them to put in jail. In spite of several protest, dharna and gherao by the victim not action has taken place against the accused

Dalits Left Landless- Alienation of Lands Assigned to Them for Housing and Burial Purposes

    Birdugadda Suresh S/o. Kanakambram aged 12 yrs, of Mala Community was returning from the school after flag hoisting on 15/08/2004 along with his friends. He accidentally fell into the tank. His friends ran to the village and called the elders; by the time they came, Suresh was dead.

     

    The villagers were agitating on the main road of Pedda Thumiddi on 16/08/04 regarding the death caused to Suresh due to drowning in the fish tank. This irritated Bolla Radha Krishna, as it was against him and his familhy members, he used vulgar language and discriminated the villagers present there on grounds of caste.

     

    Yalla Ratna Raju S/o Gangaiah aged 50 yrs. of Mala    Community, who is a resident of Pedda Thummidi Village of Bantumilli Mandal, Krishna District and his daughter Siromani were forced to work at the compound of Bolla Ravindranath Tagore in Hyderabad since he failed to repay a loan of Rs. 3,000/- which he had borrowed for purchasing fertilizers. After having worked for 9 months, Ratna Raju’s son came to Hyderabad and asked Tagore, why the debt did not clear, though they have worked for many months.  Tagore got irritated and gave a beating to Rantam and his son, and they were sent away. Tagore forcibly confined Siromani, daughter of Ratnam and sexually harassed her for about 6 months and sent her back to Pedda Thummidi because he came to know that she became pregnant. He ensured that she got undergoes an abortion in Bantumilli.

     

    Bolla Ravindranath Tagore alienated the burial ground of Dalits adjacent to his lands at Bandlagudem village and converted the same into fish tanks.

     

    Pamu Kalawathi w/o Gandhi (late) aged 50 years of Mala community has 7 children.  Her land in RS No-838, extending to 2.40 acres was alienated by Bolla Ravindranath Tagore of the same village. Her husband expired before a year due to this.  Till date, neither has the land been returned, nor has any remuneration been paid.

     

    Bolla Radha Krishna S/o Ramulu of Pedda Thummidi village has forcibly occupied the lands of Putti Subba Rao, Sheelam Vimala Devi, Mundru Sugunamma, Kurma Gnanasundramma and also of the witness Gudipudi Bala Swamy of Vaivaka village approximately 3 years ago.  When resisted by the victims Bolla Radha Krishna has threatened of dire consequences.  Having got afraid of Bolla Radha Krishna they haven’t complained all these days.

     

    Dasari Ramesh S/o venkateshwara Rao the sarpanch of Pedda Thummidi in Bantumilli Mandal was waiting for the bus at Lakshmipuram center in Bantumilli around 09:30 pm on 23/10/04 to go to his in-laws house.  Bolla Venkata Durga Narsimha S/o Ramulu came to him and took to his house on motor bike beat him up saying that the decisions to be made in the panchayat board to be held on 24/10/04 should be made in favour of his brother Bolla Radha Krishna, llikewise threatened him of dire consequences if the land is not registered in the name of his other brother Bolla Ravindranath Tagore. Dasari Ramesh was dropped at his house at around 11:00 pm.  Ramesh told his broher Suresh about all that happened. At round 08:00 am on 24/10/04 Suresh sent his brother to bring newspaper and by the time he returned back at around 09:30 am, Ramesh was found dead. He hanged himself to death. No action has been taken against the accused, in some cases; Charge sheets have not been filed. Compensation has not been paid in some cases not paid.

Murder of a Dalit over Land Related Dispute at sithsl

  • Summary::

    About 25-30 years ago the govt. allotted 5 “Bigha” land in the name of the father of Girraj freely. Close to the land of Girraj, there is 30 acre of land, which Girraj had encroached. That was between the plots of Girraj and Prabhu.

     

    Once on 23.10.2004, Girraj came home back from Sithal after the treatment of his daughter Garima. Once Banwari Kharwal, the accused with a pretext took Girraj to his field, because he wanted to know the location of land belonging to the victim. The victim’s daughter Garima too followed them. When the two reached there, Gulabo Radheshyam and Mangi Devi who were already present over there attacked Girraj with axe, wood and other harmful weapons. He fell almost dead. Thinking that he was dead, they ran away. Kaushalya w/o Nemichand and Garima d/o Girraj witnessed the incident and told Sajna Devi w/o Girraj. Based on the statement given by Sajna police arrested the accused and filed the FIR no. 111/04 on 23.10.2004 under the sections 143, 341, 323, 447 IPC and 3 (2) (v) of SC/ST (PoA) Act. Now the case is under trial in the session court of Dausa. The living witness Garima (9) d/o the victim Girraj was shocked to death. That doubled their tragedy.

     

    The family sought for the justice in all the way possible. The case is still continuing in the session court and the whole family is threatened. Investigation of the case is done and the final report has been submitted in the court.

A Dalit Woman Gang Raped for Objecting to Land Grabbing

    The victim Sumitra Devi w/o Sudhir Saday was assigned a plot of land. And the perpetrator Ajay Thakur wanted to possess this plot of land. That was opposed by the land owner Sumitra Devi. As a result Sumitra Devi was gang raped.

     

    In the night of 10.10.2004, the victim Sumitra Devi w/o Sudhir Saday, belonging to the Dalit community from Sisoni Tola, Andhra Thadi Police station in Madhubani District, Bihar, was sleeping with her sister-in-law Sona Devi, Sister Sabitri Devi in her parental house and about 10 – 11 p.m. She woke up and went out for urination and in the meantime accused  Ajay Thakur caught her and along with other accused mentioned in the FIR took her towards south of her house near Brahmasthan and there all the accused raped her one after the other. After quenching their lust for the sex, threatened of her life and went their way ahead. When the accused had gone away she cried for the immediate help. Hearing her cry for the help a few men from the same tola came out for her rescue and took her home back.

     

    The villagers themselves took her to the AndhraThadi Referal Hospital but she was refused to be treated there till the police came and took the statements. The police came and took her to the police station. They made her sit there whole day long then in the next morning the victim was taken to a hospital in Madhubani. She was examined by a lady doctor Kanti Mishra. The FIR no. 92/04 on 11.10.04 was registered under the sections 376, 34 IPC and SC/ST POA 1989 section 3 (1)x, xi and 3(2) v.

A Dalit Woman Confined in the House for Two Days without Food when She demanded for Her Due Wage

    On 7th Oct 2004, A Dalit woman Borra Laxmamma (38) R/o Ananthasagaram village, Athmakur Mandal of Nellore district, Andhra Pradesh state. When she went to Araveedu jangalapalli village to collect the due amount from Sudhakar Naidu and she was abused and disrobed locked in a room for 2 days. Borra Laxmamma (38) W/o Penchalayya residing at Ananthasagaram Village, Athmakur Mandal, Nellore District, belongs to SC-Madiga community. She has two sons & six daughters. Being first daughter got married remaining children are living with them. Since last 2 years her husband is working under Kallu Sudhakar Naidu, a Coal Merchant who is from Araveedu Jagalagaapalli village, which is north side, 45 KM away from Athmakur Police station. Her husband cuts trees and makes it into pieces and turns out into coal.

     

    Once Laxmamma eldest daughter fell sick so, she was taken/admitted in the Govt. Hospital, which is located at Athmakur. Sudhakar Naidu who comes to know about this and since he is payable of Rs. 1000/- as due to Penchalaiah (Coolie amount). he told penchalaiah, that he will pay Rs. 1000/- at Araveedu Jangalapalli village for his daughter’s medical treatment. On 7th Oct 2004 (Thursday), since penchalaiah fell sick, he sent his wife Laxmamma to collect Rs. 1000/- from Sudhakar Naidu. Therefore she started in the morning and reached Araveedu Jangalapalli village.When she asked Sudhakar Naidu to give Rs.1000/  he  said, that “Iam not due/liable to pay the amount” and started abusing “Eppudu pani Aggodatharu Dabbulu kavalante Maathram Poddunne vastharani”(always bunks the work but if only money is wanted then comes early) humiliated her. He did not stopped with this, also used vulgar words on caste name “Madiga Lanja” along with this he had pulled her hair, beaten her with chappal on her head & back and also kicked her with his leg on her abdomen and disrobed, locked her in a room.

     

    Even after one/two day passed i.e.8th Oct 2004/9th Oct 2004 (Friday/Saturday) Laxmamma did not returned home, therefore her husband got worried and then informed village heads dated 10th Oct 2004 (Sunday). The village heads sent Borra Ramanayya & Kamatham Chinnayya who is relatives of Penchalaiah, to trace her out. On 11th & 12th of Oct 2004, Borra Ramanayya & Kamatham Chinnayya approached Sudhakar Naidu’s house and traced about, in the beginning there was no answer from Sudhakar Naidu but finally when they warned him that they will file a case against him then, his niece agreed to show her. When they saw her, she was very weak and could not utter a word. They consoled her and said, that they come back to her and then left Athmakur. Borra Ramanayya & Kamatham Chinnayya informed about the condition of laxmamma with the village heads. On 13th Oct 2004, village heads immediately lodged a complaint on Sudhakar Naidu at Athmakur Police station. When village heads and relatives of Penchalaiah came to inspect/search the house of Sudhakar Naidu, by seeing of these people entrance, Sudhakar’s niece thrown out a saree to her through window to cover her body. Even though the police registered the complaint immediately, the proper sections were not kept. Thereafter she was sent to Govt. Hospital, Athmakur for medical checkup.

     

    The case was filed U/s IPC 355, 323, 342 with Cr. No. 57/2004. After the pressure & demand of Bala Chenniah & Venkateswarlu who are Dalit leaders & member of Anti SC/ST Atrocity committee, on Dist. SP, DSP to put proper/related sections of SC/ST Act 1989. Then 3(1) (x)(xi) of SC/ST Act 1989 sections were included in the case. Later on, under this Act she received Rs. 30000/- as compensation.
