Tamil Selvan (23) S/o Mr. Gopal is married to Kalpana, aged 19, of Pacharpalayam village, Malaiyapalayam village panchayat, Sultanpet panchayat union, Sulur Taluk of Coimbatore district. He is belonged to the Hindu Arunthathiyar caste (Sub Caste of Scheduled Castes). After completing his 12th standard, he has been working for the last 5 years as a tractor driver with a weekly salary (4000-four thousand) to Rakiyappan, a member of the Kongu Velalar counter caste in the nearby Malayapalayam.

M.R. Palanisamy, a 50-year-old of Kongu Vellalar Gounder caste is residing near the Rakiyappa Gounder’s house in the same hill station, is a member of the ruling ADMK party and is working as a contractor to put roads and small bridges in village panchayats. Tamilselvan has been working as an Acting Driver for the tractor M.R. Palanisamy Gounder and only one day in the month of Sunday on the request of Rakiyappa Gounder’s for only one day in the month of October, for which Tamilselvan did not pay them on M.R. Palanisamy Gounder.

In this situation, on 28-10-2020, Tamilselvan went to the house of M.R Palanisamy Gounder in Malaiyapalayam and asked for his salary for a day\'s work a month ago, but it has come to light that MR Palanisamy Gounder was not at home. He called and said that the night Tamilselvan had gone to Chencherimalai. When he left, MR Palanisamy Gounder went in front of him in a two wheeler and immediately Tamilselvan stopped at Palanisamy Gounder and asked for money for the work he had done for a month by driving a tractor and in turn he had verbally abused him in filthy and derogatory language referring to the caste names in public. Prabhakaran, a native of Tamilselvan\'s hometown, said the incident took place when Tamilselvan was slapped on the left cheek with his right hand about five times, kicked about five times, kicked down and spit on the face.

Arunthathiyar Tamilselvan, went in a two-wheeler with the help of his friends that night and was treated at the Palladam Government Hospital at around 10-00 pm, but the doctors refused to treat him as an inpatient saying that the injury was not serious. He came out of the hospital and went to the Sultanpet police station to lodge a complaint. MR Palanisamy Gounder went to Tamilselvan along with the ruling ADMK party Malaipalayam panchayat leader Mahendran, Rakiyappan, Rakiyappan son Balasubramaniam, Rakiyappan Machan Manthirachalam called Malaipalayam, Sencherimalai Gounder and tried to compromise and also threatened him not to lodge a complaint at the police station.

The next day (29-10-2020) Prabhakaran, Dharmaraj, Naveen and his lawyer Suriyakumar, who were witnesses to the incident, took about 30 people to the Sultanpet police station and filed under the SC/ST PoA Act. Sub-Inspector Ravi has lodged a complaint (CSR No: 120/2020) against Tamil Selvan and the Dalit organization for delaying the case in favor of the dominant caste without filing a case against the MR Palanisamy Gounder. FIR No: 404/2020 at Sulthanpettai PS u/s 323,506 (i) IPC r / w 3 (i) (r), 3 (i) (s), 3 (2) (va) Sc / St PoA Act-2015.

Also counter FIR has been registered against the victim Tamilselvan on the complaint lodged by M.R. Palanisamy Gounder and no arrests were made on either side.
