Case summary

That from last three years he was employed by Jaskaran Singh S/o Sajjan Singh, R/o Village- Holawali, tehsil- Zira, District- Firozpur who belongs to caste “Jatt Sikh” which is a non Scheduled Caste. He was employed as a “Siri”(Agriculture labourer). He was also taking care the 9 buffalos of the employer. That the previous employer of Puran Singh was Tara Singh who is resident of Firozpur city and after extracting work from him Tara Singh imposed Rs. 33,000 (Rupees Thirty three thousand) on him as a bonded debt. Jaskaran Singh paid the bonded debt of Tara Singh and engaged Puran Singh in his work. Now Puran Singh started work for Jaskaran Singh. In the first years the employer fixed his annual wages Rs. 40,000 (Rupees Fifty thousand) for the first year and for second year Rs. 50,000 (Rupees fifty thousand).That he was working for the employer from 6:00 a.m to 9:00p.m to take care the buffalos of the employer. During the season of wheat and paddy transplantation the employer was extracting work from him day and night. That during the work period the employer was abusing him on caste basis ad when ever he comes to his house for some time the employer was abusing him on caste basis when he came back to work. That Jaskaran Singh has taken the thumb impressions of Puran Singh on many types of blank papers  about which Puran Singh do not know that where he will use these papers as he is a illiterate person. Jaskaran Singh was not allowing him for any weekly rest or overtime. During the work period whenever he falls sick or could not attend the work due to any urgent work in his house the employer was charging him a fine of Rs. 600 (Rupees six hundred) and by adding this fine’s amount in the advance amount the employer was charging an interest on the whole amount as per his own wish. That during the work period whenever Puran Singh requests many time to the employer for his wages hardly he gives Rs. 500/- gives him Rs. 500/- in a month instead of this amount the employer never give him any amount of his wages. Puran Singh’s wife Jaspreet Kaur is a domestic servant and she is working in different houses in her village and she was managing the expenses of the house. That after working for the employer continuously for three years when Puran Singh demanded his earns wages from the employer. The employer imposed a bonded debt of 40,000 (Rupees forty thousand) on him. That to repay the bonded debt of the employer Puran Singh borrowed Rs. 15000 (Rupees fifteen thousand) from one person of his village and give back to the employer. After getting this amount the employer again demanded the remaining bonded debt amount as Puran Singh was unable to repay the bonded debt the employer started threaten him that he will took the possession of his residential house. That for his release and rehabilitation from bonded labour and bonded debt Puran Singh sent a complaint to the District Magistrate, Firozpur on 20-5-014 which is under consideration. That on 3-6-014 the employer Jaskaran Singh, Buta Singh S/o Gura Singh from village- Holawali and Jagsir Singh @ Seera S/o Mukhtisar Singh who is from another village came about 9:00 a.m and abused elder brother of Puran Singh whose name is Gurlabh Singh and his wife Baljit Kaur and threaten them that if they will not bring Puran Singh to their work or will not repay the bonded debt then they will took the possession of their residential house. The Baljit Kaur makes requests to the employer and his son and they went back. In this regard again a complaint was sent to the District Magistrate, Firozpur and Senior Superintendent of Police, Firozpur on 5-6-014. That on 1/7/014 when the family members of Puran Singh were not present in the house,  the employer Jaskaran Singh,  Jagsir Singh @ Seera, Buta Singh again came to the house of Puran Singh and threw out their household items and locked one room of their house. Now the employer and his fellow persons are not allowing Puran Singh and his family members to enter in the room which is locked by them.
