Case summary

Prafulla Behera, a physically differentlyable person, his wife Manjulata Behera, daughter Jayashree and son Balabhadra live in Tantisahi village under Sripurushottam GP under Delanga police station in Puri district. Jayashree Behera, is 14 year old minor girl who studies in Class-VIII in nearby school. They belong to Chamar Sub Caste under Scheduled Caste category. Prafulla Behera gets Disability Pension. All of them engage in making palm-leaf craft for their livelihood.

The family being in abject poverty cannot afford the luxury of a toilet and they go to field to meet the call of nature. On 19.3.22 in the evening, Jayashree was coming back from the field meeting natures call. At that moment the accused Sumant Barik pounced open her and put her on ground. He tried to disrobe her and rape her. She shouted for help and her mother came running to rescue her. Jayashree released herself from the clutch of Sumant; but the accused got hold of Manjulata, the mother and forcibly putting her down he tried to rape her. He threatened to kill whoever resist her and shouted that he will rape both the mother and the daughter. The girl put all her energy to rescue her mother and both tried to defend themselves with a stick. When he found such strong counter to his attempt, he ran away.

The matter was reported to the police on the same day resulting in repeated raids by police party during the nights. However written compliant was given in nextday morning which was registered as Delanga PS case no 85 dated 20.3.2022 under Sections 341,354A, 294,323,354,506 IPC with 8 POCSO Act and 3(1)(r)(s), (2)(v) Sc & ST PoA Act. The family approached Satyamanu Pradhan, an activist of nearby village and fact finding was conducted on 24.3.2022.
