Case summary

Dalit girl named Meena (18), D/o Mr. Rajendran resident of Mariamman koil St, Vinayagapuram, Kothampakkam Panchayat of Villupuram District. She is belonged to the Scheduled Castes (Sub Caste: Hindu Paraiyar) and residing at her sister’s home for the past 15 years. She had completed 12^th standard and is working in the Good Night company, Nallur, Villupuram District. She is working in the Good Night Company for the last 3 months.

In this context, a man named Arul Jothi of Suramangalam village and belonged to the most backward caste (Vanniyar) was working in the same company had proposed to the girl, but the girl refused to accept his proposal. She had added that he belonged to other caste and she belonged to the Scheduled Caste. But in these few months, he used to call her and converse over phone about his love proposal. Two months ago, Arul Jothi left the job at the Good Night Company. On 19.06.2019 after completing her noon shift (i.e: 2 pm to 10 pm) she came out of the company at about 9: 45 pm.  Arul Jothi was standing at the entrance gate in his pulsar bike. He had told the girl that he would drop her in her home. The girl hesitated and told him that she will walk to her home (just 1 km from the company). But he had forced the girl to sit in his bike and took her. On their way, Arul Jothi had stopped near Pallacheri Nelli Thoppu; the girl told him that it is dark and she has to go home immediately. But he was conversing with the girl about his love proposal and told her that he would marry her. Meanwhile, three youths (names unknown and can be identified) came towards them and asked why they were standing there. They immediately attacked on her face and made the girl to put knee down on the floor. They had also pulled her hand and holded Arul Jothi’s hand. 

Meena was brutally attacked by two accused persons and they tried to remove her upper cloth and she refused and ran away towards the railway track. But the two men chased behind her and caught hold her legs.  During this incident, she had sustained heinous injuries at her buttocks. They had brutally attacked her face, hands and finally called the 4^th person to Pallacheri. Totally there are 5 accused persons, the two accused persons forcefully removed and threw her chudidhar pants and panties (Jatti) and raped the girl without her consent one by one. Meantime one of the accused told the other that he should take out his genitals and should not leave any serum in her vagina (sexual organ of the girl) which will lead to formation of the fetus. The other accused agreed to do the same. After the gang rape, she got unconscious and fainted to the ground. Arul Jothi along with the 3^rd and 4^th accused persons were standing nearby and looking whether anyone/any person are coming on the Nelli Thoppu Road.

In the meantime, the girl’s sister Subashini got worried as Meena did not return home from work. Later she had called the Contractor Saravanan (person who helped Meena in getting job in the good night company) and she had asked for Arul Jothi’s mobile number. But his mobile number was not reachable and had tried to Arul Jothi’s brother Kalidoss. Finally around 11: 00 pm they got the location of Meena through Kalidoss. The contractor Saravanan along with the girl’s uncle Kumaran immediately went to Pallacheri Nelli Thoppu. Arul Jothi made the girl to wake up and helped her in wearing her pants. Saravanan and Kumaran reached the spot and brought her to the hospital. 

The girl was admitted as in patient at Manakula Vinayagar Medical College Hospital, Mathakadipattu and was discharged forcefully by the medical officer on 20.06.2019 at 6 pm. Later she was admitted to the JIPMER hospital on the same day at 8:00 pm. The complaint was received by the Station Officer Kandamangalam and AWPS police. The FIR was registered with the Crime No: 288/2019 u/s 342, 323, 354 (a) 376 IPC r/w 511 and 4 of TWHA Act, 3(1)w(i), 3(2)(va) SC/ST PoA Amendment Act 2015
