Case summary

The complainant, Smt. Sabubai Digambar Parse, aged 60 years, residing at Dombwadi, Taluka Parli, District Beed, stated that she and her husband, Digambar Parse, earned their livelihood through agricultural labour. They have four sons, namely Parmeshwar Parse, Sanjay Parse, Ashok Parse, and Vajanath Parse. Their son Parmeshwar Parse was engaged in sugarcane harvesting work at Ahmedpur, and therefore the complainant and her husband were also working there as sugarcane labourers.
They were employed under the sugarcane harvesting contract of Mukadam Vaijnath Rode and Bhagwat Pawar. On 02 December 2023, after receiving information that their daughter had been admitted to the Government Hospital at Ambajogai due to a road accident, the complainant and her husband came to Ambajogai to visit her. After meeting their daughter, they left for Parli by bus.
On 10 December 2023, at about 9:00 p.m., the complainant received a phone call from Mukadam Bhagwat Pawar, who informed her that her husband, Digambar Parse, had fallen down and had become unconscious. Upon receiving this information, the complainant and her son Krishna Mahadev Parse immediately went to Dombwadi, where they found Digambar Parse lying unconscious. Although there were no visible external injuries on his body, he was in a critical condition. They first brought him home and, on the following morning, 11 December 2023, shifted him to the Government Hospital at Ambajogai for treatment. From there, the doctors referred him to Swarati Hospital, Latur, for specialised medical care.
At Swarati Hospital, the doctors informed the complainant that Digambar Parse had sustained a severe internal head injury caused by a forceful blow to the head. Despite continuous medical treatment, his condition did not improve, and on 22 December 2023, at 2:42 a.m., he succumbed to the injuries while undergoing treatment. His post-mortem examination was conducted at the Government Hospital, Latur, on 23 December 2023.
The complainant alleged that on 10 December 2023, while her husband was travelling from Ahmedpur to Dombwadi, near Anandwadi Pati, Vaijnath Rode and Bhagwat Pawar, for reasons best known to them, assaulted him with a wooden stick by striking him on the head with the intention of causing his death. As a result of the grievous head injuries sustained in the assault, Digambar Parse died during treatment. Accordingly, the complainant lodged a report against Vaijnath Rode, resident of Navawadi, Taluka Ambajogai, and Bhagwat Pawar, resident of Dombwadi Tanda, Taluka Parli, District Beed, alleging that they intentionally assaulted her husband, leading to his death.
