I. Summary of Fact Finding:
The complainant, a woman belonging to the Chambhar caste, states that she and her husband Ramdas Ganpat Adsul reside together at Sadalgaon, Taluka Shirur, District Pune. An earlier atrocity case bearing Station Registration No. 610/2025 dated 25/08/2025 had already been registered against Sagar Hanumant Pawar and Gulab Ashok Pawar, who are residents of the same village and are aware of the complainant’s caste.
On 14/11/2025 at about 07:45 pm, while the complainant and her husband were present at their house, the accused Sagar Hanumant Pawar and Gulab Ashok Pawar unlawfully entered their house. Sagar Pawar was carrying a wooden stick and abused the complainant’s husband, kicked him on his knees, and struck him on the head with the stick. Out of fear, when the complainant tried to go upstairs, Gulab Pawar caught her hand, dragged her down, and caused injuries to her neck, waist, ribs, upper back, and left hand. During this assault, Gulab Pawar touched her thigh, chest, and private parts, thereby outraging her modesty. At the same time, Sagar Pawar abused her using caste-based insults, threatened her with dire consequences, and stated that he would kill her, thereby intentionally humiliating and intimidating her on the basis of her caste.
After the assault, the complainant informed her son Santosh Ramdas Adsul, who came to the house and took both injured parents to Shirur Police Station to lodge a complaint. As directed by the police, they first went to Shirur Rural Hospital, where primary treatment was given and they were referred to Sassoon Hospital. While proceeding for further treatment, the complainant developed serious breathing difficulties and was later admitted to Shri Varadvinayak Hospital, Fedgaon, Taluka Daund, District Pune, where she received treatment in Special Ward No. 3.
From the facts stated, it is found that the accused persons intentionally trespassed into the complainant’s house, assaulted the complainant and her husband, caused physical injuries, outraged the modesty of the complainant, and abused and threatened her using caste-based language.
