Dalit Woman Denied Public Passage and Attacked

    Smt. Kiran Devi (27) W/o Mangal Raajk, resident of Sakin-Mujapur village, GP/Po Dih-kushumbha, P.S Korma, Dist-Shekhpura, Bihar, hails from Scheduled Caste (Dhobi) community. She is a housewife and her husband is a marginalized farmer. Agriculture farm of the victim is located adjacent to the land of Shravan Hahanto, belongs to BC (Dhanak) community. There was a passageway stuck between the land of Shravan Mahanto and the victim family, which the people from the neighbouring villages used to pass through. Conversely Shravan Kumanr blocked the path, therefore the public found out another way, which crossed through the land of Kiran Devi. Consequently she had to put up with gross loss of corns from the farm.

     

    Therefore Kiran Devi removed the blockage from the way in order to make way for the public This act Kiran was very irritating to Shravan. On 31.12.06 Shravan Mahanta S/o Muna Mahanta, Bilo Kumari D/o Muna Mahanta, Ingoli Kumari D/o Shravan Mahanta abused her with filthy language, Caste name and brutally beat Kiran Devi and her sister-in-law (Gotini in Bihari language). Due to the attack Kiran Devi became unconscious.

     

    On 05.01.07 Kiran Devi and her husband went to Munger P.S to lodge complaint. The P.S Incharge registered the case u/s 342/341/324/504/354/447/448/379/34 IPC & 3 (1) x SC/ST Act on 8.01.07 and it was sent to Korma P.S for investigation. The culprits have not been arrested yet; even the victims have not received any compensation by the administration.

    Case in Brief:

     

     Agricultural farms of Babulu are adjacent to the residence of Venkayamma.  He diverted the excess water of his farm to her house.  When she has gone to question him, he abused her and her family in the name of caste and attacked her.

     

     

     

     

    Recommendations:

    •      SC/ST Act should be included in the FIR. 
    •      Accused should be arrested and compensation should be paid to the victim.

A Dalit Crushed Under a Vehicle for Objecting to Land Encroachment

    Deceased M. Dhainydu (38), S/o M. Satyam, belonging to Mala (SC) caste is r/o Bachepalli village Allagadda Mandal, Kurnool District. He is a brother of M. Elisha and daily wage labourer. Elisha has a piece of land where the accused G. Pedda Pamulati and G. Chenna Pamulati & others were constructing a house, Therefore, the victim brought injunction from court to stop the construction. On 24-12-06 night around 9:00 PM S. Laxminarsima reddy, S. Chandra Shaker Reddy, S. Rameshwar reddy, S. Bhaskar Reddy, N. Chenna Obanna, T. Venkataiah, N. Venkateshwarlu, G. Pedda Pamulati and G. Chenna Pamulati came over in a  jeep and attacked the deceased M. Dhainyudu.  Dhainyudu fell down and the jeep ran over him causing grievous injuries. While he was on the way to hospital, Dhainyudu died due to injuries. The brother of the deceased gave a complaint before Allagadda police station and a case was registered in Cr. No 131/06 u/s 147,148, 324, 302, r/w 149 & 3 (1) (x) SC ST Act, 1989.

     

    A case was registered in Cr. No 131/06 u/s 147,148, 324, 302, r/w 149 & 3 (1) (X) SC ST Act, 1989 before Allagadda police station. After filing of the charge sheet the case was numbered as SC No. 33/2008 before the session’s court. Sec 3(2) (V) was added and an express FIR was issued to all the concerned Police Department. Representation Sent to all concerned officers.   Case is pending for trial before the court of special Judge for SC/ST cum 1st ADJ, Kurnool.

A House of a Dalit Family Set on Fire Following Previous Enmity

    Pemaram (50) S/o Sukharam resident of village Ballada, District Jaisalmer hails from a Scheduled caste (Meghwal) family. He survives with 4 daughter, 2 sons and a wife.

     

    On 21.12.06, Pemaram was sleeping with his wife and children. At 12 o’clock Bijraj Singh s/o GajyeSingh who belong to Rajput set fire to 2 huts build by Pemaram. FIR was registered in Pokaran district Police station on 23.12.06, u/s436 IPC & 3(2)(iv) of SC/ST (PoA) Act.. The case has been investigated by C.O. we came to know about the fire when Kanaram S/o Bagtaram Meghwal who is neighbour raised an alarm saying that your huts were set on fire.

     

    Since they come under below poverty line, the government built a house. They only used to sleep in that house since they did not put the door. So they did not keep any vehicles and thinks He was not at home. The person who did this is Beejaraj did this work through the people who seen the footprint of C.O came to the spot and also seen the foot print. A value of Rs 85,000/- was lost. Famine calamity Relief work Beejarj did not add the Pemaram name and he added the names of the people who he likes. Because of this incident the enmity raises between them and in the court case is under trail. Two days before the incident when Pemaram went to the hearing for the court Beejaram gave pressure to compromise in the case but Pemaram denied, because of this perpetrator done this.

     

    Since they lost all the amenities they do not have anything to eat or drink. Village people support the victim with food for the morning and night. Sarpanch has given a sack of wheat. The administration did not provide immediate relief for them. The family members of Perpetrator claim that Beejaram is a mentally affected person. Victims are bailed out after 7 days from the jail. The case is under trial. Victim filed a Complaint against Rajputs in the court.

Inter Caste Marriage Leads to Life Threat and Flee From the Village

    Indu Devi (20) D/o Amirik Ram resident of Ithamanikpur Village, PS- Murauna, Dist- Supaul, Bihar, hails from Scheduled Caste (Chamar) community. Village Ithamanikpur is situated 80 kms away from its District headquarters. Indu Devi (20), fell in love with a Dominant Caste youth named Ranjan Yadav S/o Laxman Yadav of the same village. According to the Hindu customs and rituals the couple married on 15th Dec’06 at the village temples. After the marriage the newly wedded couple stayed together at groom’s family.  The family members of the groom did not object to their son to marry a Dalit girl.

     

    On the contrary, the villagers namely Mohan Yadav S/o Kamta Yadav, Suresh Yadav S/o Kamta Yadav, Suraj Yadav S/o Ramjit Yadav, Manoj Yadav S/o Ramjit Yadav objected to their marriage. Accordingly on 20th Dec’06 they, the above mentioned persons encircled Indu Devi at the alleys of her Basti and abused by her caste name and said that she ought to not be married to a Dominant caste guy, for being a Dalit girl. That’s why they warned her to be separated from her beloved for being a Dalit lady and flee from the village or else they would kill her and her family members too.

     

    Indu Devi and her beloved went to Supaula police station to lodged complaint against the perpetrators. Even the couple met to District Collector with an appeal letter to ensure security for their lives on 28th Dec’06. The District collector assured them to protect and prevent them from further harassment, done by the assailants. But the District collector did not initiate any action against this until now. Neither the FIR has been registered nor have the victims been ensured protection by the administration.FIR has not been registered and DM of Supaul has not, initiated action against this
