A Dalit Woman Confined in the House for Two Days without Food when She demanded for Her Due Wage

    On 7th Oct 2004, A Dalit woman Borra Laxmamma (38) R/o Ananthasagaram village, Athmakur Mandal of Nellore district, Andhra Pradesh state. When she went to Araveedu jangalapalli village to collect the due amount from Sudhakar Naidu and she was abused and disrobed locked in a room for 2 days. Borra Laxmamma (38) W/o Penchalayya residing at Ananthasagaram Village, Athmakur Mandal, Nellore District, belongs to SC-Madiga community. She has two sons & six daughters. Being first daughter got married remaining children are living with them. Since last 2 years her husband is working under Kallu Sudhakar Naidu, a Coal Merchant who is from Araveedu Jagalagaapalli village, which is north side, 45 KM away from Athmakur Police station. Her husband cuts trees and makes it into pieces and turns out into coal.

     

    Once Laxmamma eldest daughter fell sick so, she was taken/admitted in the Govt. Hospital, which is located at Athmakur. Sudhakar Naidu who comes to know about this and since he is payable of Rs. 1000/- as due to Penchalaiah (Coolie amount). he told penchalaiah, that he will pay Rs. 1000/- at Araveedu Jangalapalli village for his daughter’s medical treatment. On 7th Oct 2004 (Thursday), since penchalaiah fell sick, he sent his wife Laxmamma to collect Rs. 1000/- from Sudhakar Naidu. Therefore she started in the morning and reached Araveedu Jangalapalli village.When she asked Sudhakar Naidu to give Rs.1000/  he  said, that “Iam not due/liable to pay the amount” and started abusing “Eppudu pani Aggodatharu Dabbulu kavalante Maathram Poddunne vastharani”(always bunks the work but if only money is wanted then comes early) humiliated her. He did not stopped with this, also used vulgar words on caste name “Madiga Lanja” along with this he had pulled her hair, beaten her with chappal on her head & back and also kicked her with his leg on her abdomen and disrobed, locked her in a room.

     

    Even after one/two day passed i.e.8th Oct 2004/9th Oct 2004 (Friday/Saturday) Laxmamma did not returned home, therefore her husband got worried and then informed village heads dated 10th Oct 2004 (Sunday). The village heads sent Borra Ramanayya & Kamatham Chinnayya who is relatives of Penchalaiah, to trace her out. On 11th & 12th of Oct 2004, Borra Ramanayya & Kamatham Chinnayya approached Sudhakar Naidu’s house and traced about, in the beginning there was no answer from Sudhakar Naidu but finally when they warned him that they will file a case against him then, his niece agreed to show her. When they saw her, she was very weak and could not utter a word. They consoled her and said, that they come back to her and then left Athmakur. Borra Ramanayya & Kamatham Chinnayya informed about the condition of laxmamma with the village heads. On 13th Oct 2004, village heads immediately lodged a complaint on Sudhakar Naidu at Athmakur Police station. When village heads and relatives of Penchalaiah came to inspect/search the house of Sudhakar Naidu, by seeing of these people entrance, Sudhakar’s niece thrown out a saree to her through window to cover her body. Even though the police registered the complaint immediately, the proper sections were not kept. Thereafter she was sent to Govt. Hospital, Athmakur for medical checkup.

     

    The case was filed U/s IPC 355, 323, 342 with Cr. No. 57/2004. After the pressure & demand of Bala Chenniah & Venkateswarlu who are Dalit leaders & member of Anti SC/ST Atrocity committee, on Dist. SP, DSP to put proper/related sections of SC/ST Act 1989. Then 3(1) (x)(xi) of SC/ST Act 1989 sections were included in the case. Later on, under this Act she received Rs. 30000/- as compensation.

A Dalit Girl Gang Raped and Killed

    Late Manju Devi d/o Ramchandra Ram and his wife Sharda Devi, belonging to Chamar caste, in Madaha village, Rustampur outpost, Raghopur Taluk, Vaisali district, Bihar state was gang raped and a week later killed by the perpetrators. Her father was a daily wage labourer.

     

    On August 17, 2004 one of the perpetrator Nanhuk Rai s/o Rambabu Rai ( Yadav) had invited the village ladies for taking out the weeds from the vegetable field. Manju Devi was one among them. She was a good-looking lady. She felt thirsty and went alone to drink water at the nearby hand pump. Then the chance for the perpetrators Nanhuk Rai and Uday Rai went towards her. On the way back they caught her, took her to a Jinora (plant) field and raped her. She told her parents all about that. On 19.08.2004 the FIR no. 84/04 was lodged under the section 376 and 34 IPC. After the FIR the perpetrators threatened Manju Devi and her family constantly but the local police did nothing to them. After a week from her rape, on 26.08.2004 at 4.00am when the deceased went for her second call the perpetrators Rambabu Rai s/o Nagina Rai, Salim Rai s/o Nagina Rai and Nagrina Rai s/o Satyanarayan Rai from Pirmuhammadpur village which falls under the Rustampur police station in Vaisali district, caught her and tied her neck with a thin towel and killed her ruthlessly.

     

    On the same day of her killing the FIR no. 88/04 was filed under the sections 302 and 34 IPC against the killers. The police came over there and took the dead body for the postmortem in Sadar Hospital in Vaisali. Only the perpetrators mentioned in the first FIR were being arrested and the perpetrators of the second FIR are not being arrested. The government has granted the compensation of Rs.1.75 lakh. One Indira Awas and a plot of land are given to the family. The charge sheet and the diary have been submitted in the court. The case is under trial. Now the SC commission is handling the case. After the gang rapes the FIR no. 84/04 was registered under the sections 376/34 IPC. The accused were arrested and the incident is attached to the SC/ST PoA 1989 section 3 (1) xi and xiii.

Dalit woman robbed and raped in Sibnagara village

  • Summary:: Rama Kanti w/o Raju is a dalit women and resident of Sibnagara Village in Hardoi district in Uttar Pradesh. There was fight between Raju and Gangaram s/o Ram Bharose, on 11.08.2004, Raju had gone out and Rama Kanti was alone in the house. So Gnagaram came to her house and raped her and stolen Rs.3250/- Police did not file her complaint so the victim has appealed to the chief minister and with the order of Chief Minister the FIR was lodged against the accused.

Rape of a Dalit Woman

  • Summary:: Ramakanti (30), w/o Raju (32) belongs to the Chamar community and resides at Village- Shivnagra, P.O. Amartali, Ps. & Tehsil Sandila in Hardoi with her husband having 5 children. The family was a daily wage labourer in a brick kiln. They also run a petty shop near their house. On 10/8/04, Ganga Ram s/o Ram Bharose Pal of the same village went to their shop to buy a packet of tobacco and asked for her husband. She told him that he had gone to meet her father in law. On 11/8/04, at about 10pm, she took her youngest son for toilet to the nearby field. Then both of them came back home and when she was lighting the lamp, Ganga Ram s/o Ram Bharose entered the house, caught hold of her, closed her mouth, pushed her down and raped her. When she tried to call for help, he threatened her by pointing the country made pistol on her throat. Meanwhile her children woke up and he pointed the pistol on them too. He threatened them not to cry. After raping her he abused her and her caste and demanded for Rs. 3000. She refused to give him. He started searching for money. And finally, he found the money in cupboard and took away the money. She shouted for help but no came at her rescue. He ran away. The next day morning when her mother in law came, with great difficulty, she told her about the incidence that had occurred to her. But she was not ready to go to the police station. Later she found the towel of the accused and kept that as evidence. Her husband returned home after 4 or 5 days from the visit of his relative’s village. She told him all about the incidence. Both of them went the Sandila Police Station. They narrated the incident and asked the officials to register a complaint against the accused. They were assured to the registry of the FIR. They waited for two days. But no FIR was registered. Again they went to the police station to inquire whether their complaint was registered. The FIR no.544/04 was registered in Cr. No. 323, 376, 392,452, 506, 504 IPC and SC/ST POA section 3(2) v on 3/10/04. The police came to their house after two days and took the towel of the accused. On 15/09/2004, when she was returning from his work, the accused had threatened her husband to withdraw the complaint and go for a compromise with him. On 16/09/2004, she went to the police station and informed the police about the things that had happened with her husband. On 5/10/2004, the circle officer sent a message to me that she would give a statement in the police station. When she went to the police station the Diwan threatened that he would inject that she would not be able conceive any more. She narrated the incidents to the circle inspector. She underwent a medical checkup. She came to know that the accused was arrested and he was granted bail also after the six months. She had received Rs. 25,000 from the Social Welfare Department.

Dalit Mother & Her Daughter were Stripped Naked and Beaten up Following Previous Enmity

    Maina w/o Vishwambhar Dayal & Neelam d/o Vishwambhar Dayal, belong to Sunthak community is the resident of village Naghodi under Shahjahanpur P.S. in Alwasr Dist. On the day of the incident on 11.8.2004 in the morning, Neelam and Maina her mother were going for the Natural Call towards the jungle. While going they were abused by Saroj d/o Ghoomiram Yadav. The victims did not respond to their abuses and walked away quietly. When they were returning from the natural call Saroj Yadav and her mother Lili Yadav caught them. The accused started beating them and knocked them down into the gutter. They stripped naked. The persons involved in the heinous act were: smt. Lili w/o Ghoomi; Ajit s/o Ghoomi; Babli w/o Surendra; Yogesh s/o Ramkishan; Ramkishan s/o Hiralal; Surendra s/o Ghoomi; Gyarashi w/o Hiralal; Ghoomi s/o Buharam; Saroj Devi d/o Ghoomiram; Anita w/o Ramvir; Ramrati s/o Ramkishan. They are Yadavas and reside at Naghodi, Alwar.

     

    The reason behind the incident was based on the past incident. Once Jillu s/o Ghoomi committed suicide, and Neelam was understood to have played the major role and had relation with the deceased. The accused were threatening the victims that they would murder the brother of Neelam Surendra and take the revenge for the death of Jillu who was the brother of Saroj. The villagers witnessed the incident but no one had the guts to protect the victims because that was the question of their caste. The same day the report was filed at Shahpura police station.

     

    The adverse effect of the incident was that the engagement of Neelam was disrupted. Now the family of the victims is looked upon with a disrespectful manner. The police had done the medical checkup of the victims and arrested the accused but no compensations have been given to the affected family.

     

    The local police had called the doctor in the police station and had the medical checkup of the victims. The SP of Alwar has not yet visited the victim’s family and no protection has been granted to them. Only the sum of Rs. 25,000 is given to the victims under the SC/ST (PoA) Act.
