Murder of a Dalit on Theft Allegation

  • Summary:: Ramanayak was a Chamar (SC) belonging to Rashanganj village. Ramnayak had borrowed a plastic pipe on loan for irrigating his land from Srikanth Yadav. And he had irrigated his land ten days before the incidence took place. He was an agricultural labour. The village is consists of about 500 houses. And about 100 houses are that of Dalits and 30-90 houses are of minorities. And the 10 houses belong to the upper caste people. The Dalits of Roshanganj are affected by natural disaster and by feudalism and neo-feudalism. Here casteism also is in practice to a large extent. The incidents of theft are very common over this village. Ten days before the incident Ramnayak had brought the pipe on loan from Shrikant in order to irrigate the land. After having irrigated the field the field he gave the pipe to Virendra the accused. And on the third day again he needed to water the field so Ramnayak went to him asking for the pipe. Virendra did not give the pipe instead he abused him a lot. He told him that somebody stole the pipe. On that the deceased demanded for the pipe because he had borrowed the pipe from Srikanth. Both of them were adamant on their words. The tension was created between them. Virender went on argueing with him saying that he should pay for his pipe that was adjoined with the pipe of Ramnayak, which was quite illogical. The tension grew so grim that the accused could not reconcile with that. On 8.2.04 in the morning while Virender was ommiting a lot of abuses the son of Ramnayak heard on his way back home and he intern abused Virender. On that Virender felt humiliated. And left from there and after meeting his friend Subash Yadav thought of a larger scheme of incident with a deadly effect. On the same date at 8pm Ramnayak, accompanied by Jagdish had gone for the night watch to the field but the tragedy was that that there Virendra Yadav together with Subhas Yadav waited for Ramnayak. As soon as they reached there both the accused started beating them. Somehow Jagdish managed to escape from them. He took some of the villagers and went to the site. By that time the perpetrators had beaten him with the sticks and run away leaving him half dead. The people came there and took Ramnayak to the police station and the police told them to take first to the nearby hospital and they would file the case. By the time they reached to the hospital Ramnayak had died. The villagers came back to the police station along with the dead body and the FIR no. 41/04 was filed under the sections 304/ 504 IPC and SC/ST POA section 3(2) V against the Virendra Yadav s/o Harishchandra Yadav and Subhas Yadav s/o Radha Yadav. Immediately the police arrested Verendra Yadav but the other perpetrators still on run.

Dalit self-immolates himself in Dediya Village

  • Summary:: Victim Bajranglal (40) is a dalit and resident of village Dediya, Khanpur PS in Jhalabad district. Bajranglal was very poor man, had 5 children. He applied in the panchayat to sanction him a house through Indira Awas Yojona scheme. According to the scheme they sanction 2000 to the person eligible to avail the scheme, wheat value of Rs.10000/ and 10000 cash. Bajranglal was sactioned the AWY facilities but it was agreed as per the rule that he will get Rs.10000/- cash after the completion of building the house. The money was given by Sarpanch, Gram Sevak and vice Sarpanch. After building the house when Bajranglal went to the sarpanch and asked for the money her husband who handles her official work (she is sarpanch just for name sake) gave him only 8000. When he asked him for another 2000, Sarpanch’s husband, Gram sevak, and vice sarpanch Nathulal scolded him and threatened him not to complain, they told him they will send him jail if he complain. They used to threaten him every day and he was very sacred. On 26.01.2004, Sarpanch’s husband, Gram sevak, and vice sarpanch Nathulal came to Bajranglal’ house and thretend him like anything that he could not eat or sleep the whole night. On 27.01.2004, Bajranglal’s wife Chandrakanta had gone to Khanpur Hospital for her daughter’s treatment. Bajranglal was so much frustrated in his life because of the threatening that he put Kerosene on himself and lighted match stick. When the fire started he started to shout, by the time people gathered there to help him he was burnt 80% and became senseless. People came running and tried to put off the fire from his body and informed police, Police came and took his statement and took him to the hospital and he died there. Police arrested Nathulal but he came out on bail then police arrested Sarpanch’s husband and Gram Sevak and put them on jail. Bajranglal’s family has received compensation of Rs. 150000 in two installments. The case registered under SC/ST act.

Dalit Woman Paraded Naked Following Previous Enmity

  • Summary:: This incident is from Jaharkhana Street, Sub-Ps. Sadar, Mathura District, UP. The 40-year-old Kamlesh w/o Indal was working as sweeper in St. Dominic School and her husband too working as a sweeper in the station headquarter. When our country was celebrating its 54th Republic Day, Kamlesh was paraded naked in the Street under Mathura district, just because she was a relative of Ravi, on whom the responsibility of the rise of enmity lied. He had committed the crime of falling in love with a Muslim girl Zareena with whom he had run away. Ravi is the son of Kamlesh’s brother in law Shri Shyam. Ravi and Zareena eloped on 24th January 2004. After Zareena’s father lodged a complaint against Ravi, police searched for both of them and caught them on 25th January 2004. They both were put under the police custody. As Ravi was under the police custody, the family members of Zareena could do nothing to him. Therefore they targeted the family members and his relatives. The people of Muslim community came in mob and attacked the family of Ravi. On the process of attacking and destroying the things belonging to the family of the victims, caught hold of Kamlesh and tore her clothing. She was made complete naked in the public in the street she lived. Someone from the roof threw a shawl to her so that she could cover her naked body. With that she wanted to reach to the police station but as approached near she saw a big crowed of people there and so misunderstanding them to be the crowd of Zareena’s father, she directed herself to the house of her relatives and there she covered herself fully and returned home. She could register the FIR no. 17/04 under the sections 395, 354, 504, 506, 427 IPC and SC/ST POA section 3(1)(iii), only after the media covered the story. Soon Kamlesh was sent for the medical checkup. Police Station SO was suspended for not taking action on time. The compensation under SC/ST POA 3(1)(iii) Kamlesh has received Rs. 25,000 as 50% of the compensation. The rest of that is still to be paid. The case is under evidence. Charge sheet was sent to ASP, Mathura on 6/2/2004. The victims were arrested and bailed out.

    The victim Bhim Singh a resident of Ghaldana Kala, P. S. Singhana was a Govt. employee and worked in “The Ganga Nagar Sugar Factory” for 15 years.  Though the factory supplied 2 bottles of bear to the workers, Bhim Singh never drank, instead gave to his friends. 

     

    On 3 Jan, 2004, with bottles of bear he went to one of his close friends, but he never came back. In the next morning 04.01.2004 he was found dead.  Sangita (nice) inform the family over phone.  Dharmpal (38) from Bhobia, Tehsil Chirava, and District Jhunjhunu, who knew Bhim Singh since 1998, lodged complaint in Singhana police station. A criminal case was registered No. 04/04.  The wife of the victim was at the village Ghaldana, so a day after the murder Sangita informed her over telephone. The diseased and Dharmpal (38) s/o Jagnaram has good relation, so he used to call him brother in law.  They become close to each other within a few days.

     

    The police did not worry about the murder, and then some relatives of the diseased, together with the family staged a ‘Dharma’ in front of the office of the District Collector.  Taking the benefit of doubt police arrested Dinesh Kumar Kumawat and he admitted that he alone murdered him following previous enmity. In the mean time the grandfather of the Victim met the speaker of State Legislature assembly Sumitra Singh talking the assistance of Om Prakash Aabusaria (BJP worker) who lived near Veeru Singh Circle.  Their intention was to settle the case at any cost.

     

    GPF money of Bhim Singh was withheld accusing Bhim Singh involved in criminal activities.  There is no such evidence found in this regard. On the other hand the wife of the victim is suffering from Cancer and no aid is offered to her from the DC. The Supervisor of the Women’s Commission, Dr. Pavan Surana wrote a letter to grant the medicines free of cost in Sawai Man Singh Hospital and she is still getting it.

     

    The Police have arrested Dinesh Kumar Kumawat (24) on account of doubts and he accepted his fault. The District Collector has announced Rs.50, 000/- as an aid to the family but the benefit is not reached yet. Case is going on in the court.

Dalits denied access to drinking water in Chourupura village

  • Summary:: The incident is of Chourupura Village in Tank district in Rajasthan. Mohini Bairwa w/o- Pokhar Bairwa of the village, on 13.12.2003, Mohini had drank water from the government hand pump which is situated near the pond called Chollyabali in the village. She had gone pasturing the cattle and drank water from the pump. Then Banna lal Jat s/o- Ramnath Jat and Ramdev s/o- Bhura Jat abused Monini in the name of the caste and insulted her. She came home and inform in the community. Then at night the Jat community gathered together and had a meeting they sent two people to call the dalit community for the meeting. So Ramratan Bairab, Narina Bairaba, Harjiram Bairaba and Pokar Bairaba went to the meeting. The village head told the dalit community what do you want your women are drinking water from the hand pump. Then the dalits responded that the hand pump is common so what we drink water from there./ With that Ram Karan s/o- Chhitar jat got angry and started abusing them in the name of caste and came to beat them but some of the Jat stopped him. Then the Dalits came back from the meeting and filed complaint against the Jar but no action was taken about it so they went to the district collecter on 26.12.2003 and informed him but no accused were arrested. The case forwarded to court but they are not called for the hearing. The dalits now get drinking water from 15km far place and theie children study in a different school due to discrimination
