Rape of a minor Dalit girl in Nallan pillai

  • Summary:: Sandiya is a dalit girl who is 17 years old and lives in Sethavarai Village, Gingee taluk of Viluppuram District. The village is comprised of around 350 Vanniyar families, 140 Paraiyar families and 7 Arunthathiyar families. One Ms. Santhiya (17) who is a differently able (dumb, deaf and mum) was staying in her step father Das’s house in the same village. She had written her twelfth standard examinations. Her parents Anthonysamy and Anthoniyammal are working in Bangalore as daily wage labourers. On 16.04.12, around 4 pm there was a government function for the free distribution of Mixer grinder. The villagers went there. Sandiya’s step mother and grandmother went to PDS shop for buying grocery. She thought that her grandmother could not carry the grocery and hence she proceeded to the PDS shop. Seeing this one Mr. Devaraj belonging to the Paraiyar community took her to a school old building and raped her. She sustained bite injuries on her lips, mouth, neck, chest and on her vigina. Devaraj also shot this in his mobile phone. Knowing that her granddaughter was lying down with injury in the old school bathroom Sandiya’s grandmother and step parents rushed to the spot. Around 9.30 pm they called for the government ambulance service and took her for treatment. On the way, the ambulance people asked them to get down in Vettavalam market road and asked them to go to some hospital nearby. They were struggling to get a vehicle to reach hospital till the next day morning. On 17.04.12, around 4 am they got an auto and took their daughter to Nallanpillai Petral Police Station around 6.30 am. The police men received the complaint from them and took no action till 5.30 pm. Almost after 11 hours of waiting in the police station, they asked Santhiya’s grandmother to Viluppuram Government Medical College Hospital. The family reached the Govt. Mundiyambakkam Hospital around 7.30 pm in a rental vehicle. Sandiya was admitted there as inpatient till 24.04.12. She was sent home even before the wounds were healed. The accused Devaraj was arrested and out on bail. The Police are yet to file the charge sheet. When the accused was detained in Sathya Mangalam Police station, the whole village was asking Santhiya’s parents for a compromise. Also the accused had threatened Vimala, sister of Santhiya that if she reveals anything to her parents, he would do the same thing to her.

Velmurugan Custodial Violence Case

    Velmurugan belongs to dalit community. He reside at Mettu st, Villiyanallur, Chidamparam taluk in Cuddalore district. He was a one of VCK party member. He displayed VCK banner in pudhuchathiram. Those banners were damaged by social criminal. Since he was given petition to take prober action but police not responding properly. Hence VCK party members protest to arrest the accused. On 15.04.2012 he was arrested by police, he was brutally assaulted custodial violence by pudhuchathiram police. Pudhuchathiram police were filed false FIR against dalits. He given petition against police to file case against those who were involved and custodial tortured but pudhuchathiram police did not filed case.

Social Boycott with Dalits Faridewala

  • Summary:: Village Faridewala few labourers demanded higher wages for paddy transplantation which was fixed at Rs. 1200 per acre. Landlord was determined on not to increase the wages at any cost. The labourers went to attend the nature’s call in the open field of the landlords. There was a verbal encounter between the six labourers and the landlord. It turned out to a bloody encounter between labourers and landlord. The labourers were fired by the landlord in which two of them received fatal injury and four others sustained severe bullet injuries. DDVA lodged a complaint with the Chief Minister of Punjab to take action against the accused and also demanded Rs. 10 lakh as compensation amount for those who died and Rs. 2 lakh as compensation for the injured. Mob Attack and Negligence of Police

    Case in Brief:

     

    Periyayeepalayam belongs to Palangkarai panchayat, is in Avinashi Taluk, Tiruppur district. Periyayaeepalayam is home to nearly 80 dalit families and nearly 820 caste hindus Mudaliyar/Boyar/kounder families. Drinking water for this village is supplied from Pachaampalayam village. The drinking water supply is administered by Palangkarai Panchayat. Pachaampalayam village, home to onlyn 250 families are getting water supply once in two days, but Periyayaeepalayam villagers are supplied once in every 20 days. So Periyayaeepalayam filed many petitions regarding this bias and negligence and requested for regular supply of drinking water. When the Periyayaeepalayam villagers asked Panchayat president Senthil Kumar and vice President Nataraj to ensure regular supply of drinking water. But the responsible officials have not addressed the issue. Hence on 11/04/2012, Periyayeepalayam villagers including dalits organized a protest and road blockade. Nataraj and Senthil Kumar infuriated by this assertion, instigated their associates to assault the agitators. Hence Thulasimani, Chandirika and Ravikumar belongs to caste hindu Mudaliyar community were assaulted by the Nataraj’s associates. Rathinam and Saraswathi belongs to dalit community were verbally abused by Nataraj referring derogatory regarding caste. Both were also assaulted by associates of Nataraj. But have not entertained the complaint given by the dalits. Dalits statements were not included in the FIR. A case was registered only on the complaint given by Thulasimani, Chandrika and Ravikumar. Again on 27/04/2012, Periyayeepalayam villagers including the dalits organized a protest demonstration in front of the district collectorate demanding supply of drinking water once in two days.

     

     

    Legal Standard Breached:

     

    1.       Voluntarily causing hurt to and assault or another person is an offence Sec.323, 326, 342,355, 34 of IPC
    2.       Whoever  commits,  the  offence  of  criminal  intimidation  shall  be  punished  with imprisonment of either description for a term which may extend to two years, or with fine, or with both. (Sec. 506 of IPC).
    3.       A person, who is not a member of a Scheduled Caste or Scheduled Tribe, who intentionally insults or intimidates with intent to humiliate a member of a Scheduled Caste in any place of public view, is guilty of an offence under the Act ( sec. 3(1)(x) SC/ST (PoA) Act).
    4.       Whoever, being a public servant but not being a member of a Scheduled Caste or Scheduled Tribe, willfully neglects his/her duties required to be performed by him/her under this Act, shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to one year [sec. 4 SC/ST (PoA) Act].
    5.       Whoever denies a member of a Scheduled Caste or a Scheduled Tribe any customary right of passage to a place of public resort or obstructs such member so as to prevent him from using or having access to a place of public resort to which other members of public or any section thereof have a right to use or access to; - - shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to five years and with fine. (sec. 3(1)(xiv) SC/ST PoA Act).
    6.       No citizen shall, on grounds only of religion, race, caste, sex, place of birth or any of them, be subject to any disability, liability, restriction or condition with regard to - the use of wells, tanks, bathing ghats, roads and places of public resort maintained wholly or partly out of State funds or dedicated to the use of the general public. (Art. 15(2)(b) IC-FR).
    7.       No one shall be deprived of his/her right to life or personal liberty except according to procedure established by law. No one shall be subjected to arbitrary detention or imprisonment [Art. 21 IC-FR, Art. 9 UDHR, & Art. 9(1) ICCPR].
    8.       Everyone has the right to life, liberty and security of person [Arts. 3 UDHR, Art. 6(1) ICCPR & Art. 5(b) CERD].
    9.       No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment [Art. 5 UDHR and Art. 7 ICCPR].

Dalit in bondage

    Sher Singh S/o Lekhu Ram R/o Village-Togaheri, Sub-division- Bhawanigarh  District- Sangrur .  He belongs to Ramdasia caste which has been declared as Scheduled Caste by the Punjab Government. Sher Singh is working for Somjeet Singh S/o Romi Singh belongs to Jat Sikh community & residence of Village-Ghumand Singhwala, Sub-division- Bhawanigarh  District- Sangrur  as agriculture labourer, called “Siri” from last 8 years back (since 2004). 

    Sher Singh was engaged in work by advancing bonded debt Rs.500 (Five Hundred rupees) by the employer.  Sher Singh used that advance for his domestic needs.  Sher Singh was a servant on call & back. The employer was providing him food. He was work continuously work for long hours. The employer. When debt amount was given to Sher Singh, employer took his signature on some legal instrument which was not known to him because he is an illiterate person. The employer never paid his earns wages.  He worked day & night during the season of wheat and paddy transplantation. After the season he worked from 5 a.m to 9 p.m for the employer including three times meals.  Somjeet Singh did not allow him for weekly rest. He worked day and night and started falling ill. The employer  did not grant him leave on account of sickness, nor paid him any money for  treatment. Bonded labour cannot do the agriculture work day & night .Sher Singh was suffering with stomach pain. The doctor operates his stomach. So Sher Singh does not work. Still employer demands Rs. 20,000/- bonded debt from the bonded labour. 

     

    DDVA filed a complaint to District Magistrate Sangrur & Station Police Officer Amargarh  on 4/4/2012.  He is free from bonded debt.
