- Summary:: Kamal Kishore(49) s/o- Chaganlal Regar, is a auto driver who lives in quarter no. 153 in Ajad Nagar, Kotda with his family. On 18.06.2011 when Kamal Kishore woke up in the morning and washing his face he saw Kunja Sharma (45) s/o- Ramdas. Kunja Sharma then asked him why you are looking at me then he replied I am not looking at you. With that Kunja Sharma started to fight and beating Kamal Kishore, Kunja said you are Regar( dalit) why you are staying here I will make sure to take you out of the place and will ask people to kill you. Their Neighbor came and settled them there. But Kamal Kishore and Kunja Sharma were not in good term because Kunja had a bad eye on Kamal’s wife and was misbehaving her. After the incident at 8.30am Kamal Kishore took out his auto and went for work, by the time his sister Sabitri(45) who is the resident of Ashok Nagar, Ajmer and her Son Gyanchandra (22) were also coming to his house after getting the information from Kamal’s wife over phone. Kamal and his sister met on the way near luvkush garden; while Kamal was sharing about the incident to his sister, Kunja Sharma with Umesh Sharma reached there by his auto and started slapping Kamal. When Sabitri Protested and stopped him, he threatened them to take out the gun and kill them. With the fear Sabitri snatched the Auto Key from Kunja and he tried to get it back, when he could not get it he asked them to settle the issue at home. Kamal believed Kunja and asked his sister to give back Kunja’s key. After getting the key Kunja started his auto and was driving towards Anasagar Road when Kamal and sabitri tried to stop him, he stopped there and attacked Kamal with a Knife on the right thigh; he was severely injured and lost his sense. When sabitri and her son came to his rescue Kunja also attacked sabitri and her right palm got injured. With the help of a passer by Sabitri took Kamal Kishore to Jabaharlal Nehru hospital, but because of severe injury he was referred to SMS Hospital, Jaipur. With the fear accused went to police station and report about the incident by the time police get the information from the victim’s family over telephone and arrested Kunja Sharma.

Dalit Student Rajamani Denied Education

R. Rajamani (16), d/o Late Ramasamy, resident of Sambaravallipudur, Karamadai Union, Metupalayam Taluk, Coimbatore district, belongs to dalit Arunthathiyar community. She is studying 12th std (Ist Group – Computer Science) during the calendar year 2010-11, in Pethikottai Government Higher Secondary School. Since her father died due to heart attack and due to their impoverished condition, her elder sister Backialakshmi is pursuing B.Sc with the financial support of the villagers. Due to the poor health condition, Rajamani was admitted in the Kovai Government Hospital and received treatment for nearly two months. After the medical treatment, Rajamani sought permission from the Head Master Selvaraj, to continue her education. But Selvaraj sighting her long leave, asked her to continue her education next year in the same school by choosing third group( Accountancy and Commerce). He forced them to receive their Transfer Certificate. Rajamani and her mother Thangamani, asked the HM to keep the TC with him and they will continue the education next year. But Selvaraj forcefully gave the TC back and asked them to join next year. But the School Education sent Hall Ticket for Rajamani to attend the 12th std public examination. But Selvaraj have not informed about the arrival of Hall Ticket to Rajamani. When Rajamani approached Selvaraj to seek admission for the 12th std during the calendar year 2011-12. Selvaraj refused to give admission, saying that she already completed her 12th std in the school and the hall ticket to appear for the public examination was already sent to the school. Hence Selvaraj told Rajamani to continue her examination by joining in any private tutorial college. When Rajamani explained her family financial condition and their inability to afford private education by paying fees, Selvaraj verbally abused her saying, continue your education by paying fees or to work as a daily wage labour. Being humiliated by this denial of education, Rajamani and her mother Thangamani, filed a petition with the District Magistrate seeking permission to continue her education in the same school. As the District Administration failed to take action in this regard, Rajamani, the villagers and the students staged a protest demonstration against the Head Master and the District Administration. Hence District Educational Officer gave an order to give admission in the same school and promised to take action against the Head Master Selvaraj.

Attempt to murder of Dalit woman Panchayath president

- Summary:: Krishnaveni belongs to Arunthathiyar communtiy, she was contesting elections in 2006, Krishnaveni has been facing lot of harassments / discriminations from the dominant communities. From the time she became president, she faced discriminations including not allowing her to sit in the chair allotted for the panchayat president. Since May 2007, she has filed more that 12 complaints to the police and the district administration for the independent functioning as president. Except few actions taken by the District Administration, no major action had been initiated by the police. On 13.06.2011 after completing her work of signing old age pension forms she came by auto to her residence around 10.00 pm. When she almost about to reach her house (50-100 feet away) she was stopped by 3-4 members and attacked by deadly weapons including sickle in 15 places on her body. The auto driver ran away out of fear. When neighbours came, she was lying in a pool of blood and part of her right ear was cut. On 14.06.2011, Police filed an FIR U/S of 341, 294(b), 323, 324, 307 IPC & sec 4 of Tamilnadu Prohibition Harassment of Women Act 2002. In her statement, she identified Subbu @ Subramanian and his 2 brothers, and Sulthan maitheen of Thalaiyuthu village. So police arrested Subbu @ Subramanian and Sulthan maitheen, u/s above and 3(2) (V) of SC ST (PoA) Act, remanded them in the Palaymkottai prison. Later, five nadar youths were surrendered.

Victim Amrita Kumar d/o- Ramji Ram had gone to see a marriage procession on 12.06.2011 at 08pm. There accused raped her, victims brother came to know about the incident and informed in the family. Then the victim’s family came in search for her and the accused left her and runaway from the place.
Legal Standard Breached:
- Rape is a criminal offence [sec. 376 IPC r/w. sec. 3(2)(v) SC/ST (PoA) Act].
- Punishment for voluntarily causing hurt- Whoever, except in the case provided for by voluntarily causes hurt, shall be punished with imprisonment of either description for a term, which may extend to one year, or with fine which may extend to one thousand rupees, or with both [sec. 323, 334 IPC].
- Assault or use of criminal force on a woman with intent to outrage her modesty [sec. 354 IPC].
- Uttering any word or making any gesture intended to insult the modesty of a woman [sec. 509 IPC].
- Being in a position to dominate the will of a woman belonging to a SC/ST with intent to dishonor or outrage her modesty [sec.3 (1)(xi) SC/ST (PoA) Act].
3. Voluntary Causing grievous hurt – whoever, voluntarily causes hurt, if the hurt which he intends to cause grievous hurt [sec. 325 IPC].
4. Rape- A man is said to commit ‘rape’ that, except in the case hereinafter excepted, has sexual intercourse with a woman without her will or without her consent [sec.375 IPC].

- Summary:: Shanmuganathan(18), is a student of the Periyar Law College, Periyar Nagar from the Hindu Arunthathiyar community, Nallichettipalayam village, Annoor panchayat, Coimbatore District. On 12.06.2011 he went to Kurukiyaampalayam village to take drinking water from the public tap for his sister’s puberty function. This village is 10 kms away from his own village. When the villagers saw him taking water, they prevented and shouted at him saying “Chakliyar should not take water” from this tap. Shamuganathan replied,”This is a public tap, from which anyone can take water”. The villagers replied that,” the place will be polluted,, and in the past they had only poured water into the containers whereas at present the chakliyars have come directly to collect water. The dalit youth attempted to talk further, the villagers especially women shut his mouth by saying that “they would drag him to the Police Station and lock him up by giving false complaint that he misbehaviored with the women”. Shanmuganathan returned home without taking any water. VasanthaKumar a friend of Shanmuganathan heard about this incident and went to the same village on 12.06.2011 with his friends from the Periyar Dravida Kazhagam. Again the villagers belonging to the chettiyar caste prevented him from taking water. Thirumeni, the Inspector of the Annoor Police Station who heard about this and warned the villagers that cases will be filed if they continued their objections.The villagers said that “if the chakliyars take water, the water will be polluted, the rain will be insufficient, thefts and robberies will increase, the goats and cows will not become pregnant. Therefore, they should not take water”. They also assaulted Radhakrishnan special wing police for condemning their action. Vasantha Kumar unmindful of all their statements continued to take water and was assaulted by Dhamodaran chettiyar and other women. Based on the complaint given by Vasantha Kumar, only Dhamodaran Chettiyar was arrested.
