Case summary

The informant Ajit Kailas Salve, aged 26 years, resident of Matoshri Nagar, Ranjangaon Shenpunji, Taluka Gangapur, District Chhatrapati Sambhajinagar, stated that he is employed at Sonni Yessar Private Limited, Jambard Chowk, MIDC Waluj and resides with his parents and brother Bhushan Kailas Salve.
On 31/12/2023, his brother Bhushan Kailas Salve and Gayatri Balasaheb Gayakwad, aged 20 years, left together. Thereafter, Gayatri's mother lodged a missing complaint at MIDC Waluj Police Station. On 01/01/2024, the informant's father Kailas Salve, Gayatri's father Balasaheb Gayakwad, Gayatri's uncle Ganesh Gayakwad, and Gayatri's maternal uncle Shinde went to Nagpur in search of Bhushan and Gayatri but could not trace them and returned on 02/01/2024.
On 03/01/2024, the informant, his father Kailas Salve, Arun Kharat, and his mother Shilpa Salve went to MIDC Waluj Police Station to lodge a missing complaint regarding Bhushan Salve. As they did not have Bhushan's photograph, the informant went to Ranjangaon to collect it. When he returned to the police station, his father was not found there. After searching for him outside, they returned home at about 11.00 p.m. without lodging the complaint.
In the intervening night of 04/01/2024, between 12.00 a.m. and 1.00 a.m., Balasaheb Gayakwad telephoned the informant and informed him that his father was lying near Hotel Aditya Bar, Pratap Chowk. The informant went there and found Uddhav Gholap and Arjun Fingale, friends of Ganesh Gayakwad, present. Arjun Fingale allegedly caught hold of the informant, while Ganesh Gayakwad and Uddhav Gholap assaulted his father by fists and slaps. When the informant requested them by stating that Bhushan Salve and Gayatri Gayakwad had voluntarily left together and both were majors, Ganesh Gayakwad and Uddhav Gholap also assaulted the informant. The informant somehow escaped from the clutches of Ganesh Gayakwad, Uddhav Gholap and Arjun Fingale, placed his injured father on a motorcycle, and took him home.
While returning home, Kailas Salve informed the informant that Ganesh Gayakwad and Uddhav Gholap had assaulted him demanding that Gayatri be brought back. After reaching home, Kailas Salve did not take food and went to sleep. Though the family requested him to seek medical treatment, he refused. He repeatedly complained to the family that Ganesh Gayakwad, Uddhav Gholap, and Arjun Fingale had assaulted him on the head, due to which he was suffering severe pain.
On 08/01/2024, when the informant tried to wake his father to go to the police station for lodging the complaint, he found that his father was unconscious and not responding. He immediately shifted him by auto-rickshaw to MIDC Waluj Police Station, from where the police issued a medical memo and referred him to Ghati Hospital. Kailas Salve was admitted in Ward No. 19 and was unconscious. During treatment, the doctors informed that the CT Scan revealed bleeding in his brain, due to which he had become unconscious.
The informant alleged that Ganesh Gayakwad, resident of Matoshri Nagar, Ranjangaon, along with his friends Uddhav Gholap and Arjun Fingale, assaulted him and intentionally assaulted his father on the head with the intention of causing his death.
