Deceased Santosh Kumar (20) s/o Jagjivan ram (Dusadh) is resident of Darihara Bhual village, P.O. Darihara under Dariyapur P.S in Saran (Chhapra) Dist. belongs to Dusadh (SC) community. The Dominant caste people murdered Santosh Kumar since he was in love with a girl belonging to Dominant caste.

A murder crime was registered in Dariyapur police station against the murderer on 17/12/2008, No. 102/07, u/s 302 IPC & 27Arms Act but the provisions of SC/ST (PoA) Act were not attracted in FIR. Charge sheet was filed on 06/09/2008. The accused was convicted for life term imprisonment but appealed in High Court and got bail. 

Mr.Palanisamy S/o Natchi is a coolie laborer belongs to Arunthathiyar community reside along with his wife Sivakami daughter Ms.Geetha (Married), Kavitha (15), who is studying 11^th standard and son Elangovan in Podarampalayam Harijana colony, Paranjer Vazhi Panchayath union, Kangeyam Taluk, Erode district. As usual he went to his daily work on 14.12.2007 and he returned his home on evening around 5.0    0 o’clock. Then he took both in his home and he went to roadside around 7.00 pm for watching T.V, where Mr.Mani Gounder S/o Karuppanna Gounder had come and told him near to the canal which is been located 2 K.M away from the village, wher he stopped him and told him that “hey palani I brought 2 bottles of Minitor Brandy, so let we drink then we can go” “but Mr. Palanisamy replied him that just you finish it sami (Sir) because I don’t drink, so I go to my home first to bring spade to do this irrigation work”. But Mr.Mani Gounde nicely has spoken with him to drink brandy. But Palanisamy refused that. Hence Mr.Mani Gounder forced him to drink Brandy and forced him to eat Pork. Then he has drunk due to the force and compulsion of Mr.Mani Gounder.

After some while Mr.Mani Gounder scolding him that you bloody “Sakkiliya why did you not come to work in my garden,” I called you many times but you never came. Why? Are you brave too? But Mr.Palanisamy pleaded him that Sami you shall not speak like that, but Mr.Mani Gounder told him, you bloody Sakkiliya how dare are you arguing with me?. Said by Mani Gownder. Then he sowed red chilly powder on his face and immediateely he attacked Mr.Palanisamy with more aggressive manner. Mr.Palanisamy was fell down, even though Mr.Mani Gounder was not leave him, apart he beaten him continuously on his face, hip and his back side of the body using by the stick and his both hands. He told him that I won’t leave you unless if you die, this was happened for more then 20 minutes. Then he caught his legs and pulled him near the canal where he pushed him into that. Then he slowly reveled that he was brutally attacked by Mr.Mani Gounder.

Then he took him into Dr.Veluchamy doctor in Natahakadaiyur village where he diagnosed him that he is in very serious condition so he advised them to go to the Erode Government Hospital. He was admitted in the causality ward and he shifted to general ward in the next day morning. Then police filed FIR against the Caste Hindu. This case was acquitted because of insufficient of evidence in Erode sessions court.
