Case in Brief
Shilpa was playing with other children in a house under construction, near to her house. Sri Ramulu habitually comes to that village for gambling. On 6th November 2007, he was consuming alcohol and sitting near Sri Rama Temple where Shilpa was playing. He called her towards him saying that he would give chocolates and took her inside the house which was under construction. There he removed her clothes, made her lay down and raped her. Meanwhile, the owner of that house, Auto Subbarayudu happened to come there and on seeing that incident, he shouted at Ramulu for what he was doing. Ramulu pushed him and escaped from that place. Shilpa was already bleeding and was crying. He immediately went to the place where her parents work and informed them. They came home and saw that the genital organs of the girl were bleeding and the girl was shocked of the incident. The villagers searched for Ramulu and found him hiding in the godown in the village. They caught hold of him and beat him. He did not answer to any of the questions and the villagers and parents of Shilpa lodged a complaint in the Kamalapuram PS and handed him over to the police. An FIR u/s 376 r/w 511 of IPC and u/s 3(1)(xi) and 3(2)(v) of SC/ST (PoA) Act was registered. The SI sent the girl in ambulance to RIMS hospital for medical examination. The accused is arrested.
DSS Intervention:
Yellabelli Eswara Rao (35) s/o L. Appanna, Salapuvanipalem, Parawada Madal, Vishakhapatnam District belongs to Scheduled Caste (Madiga) and lorry driver by occupation was abused by his caste name and beaten mercilessly. The accused Marepudi Apparao s/o Sanyasi Sandi belonging to Kapu caste has a piece of land and adjacent to the house of the victim Yellabelli Eswara Rao. The accused was transporting gravels to the field in front of the victim’s house. As a result, the canal at the east of the house was damaged. Thus, there were pits in front of the house and the rain water stagnated there that breeds the mosquitoes.
On 3-11-07 at 11 am, the victim asked the accused not to transport the gravel in front of his house. Therefore, the accused got angry with the victim and began to abuse him in his caste name saying “you, Madiga bastard, son of a bitch, who would save you if I beat you now”. While the women belonging to the Dalit community were passing through the field of the accused, he retorted by saying “I will make those bitches naked there itself”. Saying so, he went towards the victim to beat him. The accused Marepudi Apparao and his brother-in-law Gundala Kanna Rao made a fence with thorn bushes across the way abstracting the customary passage. There were Malla Chinna Demudu and Marepudi who actually saw the incident. The victim went to the village sarpanch and informed him about the incident, but he refused to take any action against the accused by saying that he will not listen to me.
After that Yellabelli Eswara Rao lodged a complaint before the police Anakapalli Rural and police registered a criminal case in crime No. 164/ 07 dt. 6-11-07 u/sec 3(1)(ii)(x) of SC/ST (PoA) Act. The police arrested the accused at the investigation stage. Compensation has not been paid to victim and charge sheet not filed.
Pannivella Arjunamma & 12 other Dalit families are r/o Lakkavaram village under Chodavaram P.S. in Visakhapatnam Dist. After the land settlement survey, 12 dalit families of Lakkavaram were conferred 5 acres of Subarna Rekha Tank bed land rights bearing plot no 39 to 46; however this was not appealed to Nadigotla Kalyanam Senapathi Sreenu Sarpalli Vermaraju Palle Jagarnthathdam belonging to dominant caste of the same village. Once, the above mentioned persons destroyed the crops of Dalits. Then a complaint was lodged and compensation was paid to the victims in a comprised reached between them. And again the victims resumed the enjoyment and raised banana, brinjjal, sarugudu plantation in the field.
On 28/10/07 at about 8 a.m. the victims Pannivella Arjunamma, Mudi Ramuluamma, Erravarapu Parvathi and Korupalli Pavani, Erravarapu Mahalaxmi, Peddamatla Devudu, Uppmaka Satibabu, Korupalli Yesabu, Latala Chinna Devudu, Eravarpu Shimhachalam went to the field to water the plants. The accused namely Nadigotla Kalyanam Senapathi Sreenu Sarpalli Vermaraju Palle Jagarnthathdam abused by caste name and beat them by saying that the land belongs to them.
On 28/10/07, a criminal case No 128/07, u/s 3 (1)(x) SC/ST (PoA) Act & 323, 324, 384 of IPC was registered at Chodavaram police station. Accused have not been arrested. Compensation not paid to victims. Charge sheet not filed
