On 06/07/2007 Bhanwarlal Gujjar (35) a resident of Bilia village, Fulia Kalan (PS), Bhilware (Dist.) murdered a Dalit youth named as Banna Bairwa of the same village. The Gujjar’s of the village were divided in two opponents and Dalits of the village always became the victims of their rivalry.
In fact the murder of a dalit youth is substantiated with the continued trend. Banna Bairwa was working under Bhanwar Gujjar as his tractor driver 2-3 yrs ago. The reason for leaving the job of a tractor driver is stated that the perpetrator had allegedly accused Banna Bairwa for having borrowed Rs. 2, 000,00 from him. Fearing Bhanwarlal Gujjar, the victim went to Jaipur for work . Sometimes he used to come to the village to see his wife and his three children.
On 5/06/07, while Banna Bairwa and his wife were coming back their home, Bhanwar Gujjar from behind, on his tractor, stopped them at a gunpoint nearby his field. He took Rashali Devi w/o Banna Bairwa to a far off place, raped her and left them threatening of their lives if they disclose the incident to the villagers.
The perpetrator nexus with the SHO Karan Singh Khagarot at Fulia Police Station refused to register the case rather chased her out the police station accusing and scolding her of telling lies. Finally she went to Sahapura Court and with the court’s intervention the case was registered on 27/06/07, but no police officer came for the investigation. In the meantime many a times Bhanwar Gujjar was forcing Banna Bairwa to withdraw the case.
On 6.7.2007 Dwarka Prasad,- One of the villagers, was on his way back to home after visiting a Ration Dealer on his Motorbike from Saransh, offered lift to Banna Bairwa and Banna Gujjar .Meantime, the accused - Bhanwar Gujjar accompanied with three of his friends followed them on a motorbike. Bhanwar Gujjar took a pistol and shot at the three. In the process Banna Bairwa was shot dead. Whereas Dwarka Prasad was seriously injured in the incident and now he is under the treatment. The police informed the wife of the dead that Banna Bairwa was murdered and asked her to get the dead body at 11 pm. On 7.7.2007 the police has registered the case.
On 8/07/07 while Rasali Devi was sleeping at her in-laws house she heard the sound that somebody was knocking at the door so her brother-in-law complaint to the Sarpanch who came along with the village people and waited for a while and went back. Till today Rasali Devi is under threat since the police have not arrested Bhanwar Gujjar.
Charge sheet in the case has been filed on 11/10/07. Compensation of Rs. 1,50, 000/- paid to the victim as per SC/ST (PoA) RULES1995. One of the accused belonging to dalit is arrested and languishing in jail, two other accused absconded. Trial of the Case is pending disposal. Investigation conducted by DSP Kailash Singh Sandhu.
Parvati Navnath Kamble is r/o Chamar Vasti, Near Stand, Bhutashte, Tal-Mhada, Dist.-Solapur, belongs to Chamar (SC) caste. Parvati Navnath Kamble was going for toilet at evening about 8.30pm Jagdhish Kashinath Yadav (Maratha) grabbed her from behind and forcefully floored her and raped. In this entire move accused father Kashinath Yadav was also present. When the victim tried to scream out for help, Kashinath Yadav clutched her mouth tightly.
A case has been registered against the rapist in Madha police station on 07/07/2007, No. 57/07, u/s 376,34 IPC & 3(1)(xi) of SC/ST (PoA) Act. Char sheet has been filed. The perpetrator was released on bail. Case is under trial and evidence is going to be completed. Compensation Rs. 25000/- was given to victim. On 21/2/08 collected the Judgment copy from the court, perpetrator has been acquitted.
Vinod Devi (35) w/o Brahamadat, SC (Medhbal) is a resident of Hejampura village, Jhunjunu. Since her husband went abroad for a job, she has been living with her Mother-in-law (Sri Godavari) and two of her children (Somu & Monu).
On the night, on 02/07/2007, while Vinod Devi was sleeping with her mother-in-law and two kids around 1.30 a.m., Giridhari Gujjar (35) s/o Nathu Gujjar, Caste-Gujjar of the same village, entered into the room of Vinod Devi. He approached her, removed her Lehenga(Dress), and attempted to rape her. Startled, she got up from her bed and started to shout. Hearing her voice, her Mother-in-law woke up and both of them tried to catch the man, but he abusing them with their caste name and warned them that he would kill both of them if they kept shouting. Hearing his voice, Vinod recognized him as Giridhar Gujjar. He left and she called all her neighbours for help, but they could not find him.
After this incident Giridhar (the perpetrator) started threatening them that he would kill them if they filed any case against him. After some days, Giridhar’s father Sri. Nathu Gujjar went to the village people and apologized for his son’s misdeed and said that his son would not commit the same mistake anymore. Then all the village leaders (Seduram, Malaram, Sajjanram, & Chandagi Gujjar [Uncle of the perpetrator]) came to Vinod’s house and told her to compromise. They even warned her that if she would not compromise then she will be socially boycotted from the village. Having no alternative, Vinod Devi agreed to compromise.
On 14/07/07, Suman, Co-sister of Vinod and a social activist, came to her home. After coming to know about this incident she took Vinod to Bagad Police Station and filed a complaint against Giridhar Gujjar. On 15/07/07, the police came for the investigation. The village leaders came to her again and threatened her that she must take money from the perpetrator (as a bribe to remain silent) or she will not be allowed to stay in the village. Then Vinod (the victim) said, “I am already insulted so now I don’t want to compromise.” Currently, Vinod and her family are in a very great fear because all the villagers are against them, including the Police.
Fulwanti w/o Laxman is r/o Tal-Morshi, Dist. Amravati, belongs to Gond (SC) caste. On 01/07/07 evening at about 5pm the victim was working in the field of the perpetrator, while her husband went to a flour mill in village. Taking the advantatage of her helplessness & loneliness the perpetrator forcibly took the victim to his hut & committed rape.
The crime is registered in Mahuli police station against the accused person on 13/08/2007, No. 29/07, u/s 376, 506 IPC & 3(1)(xii) of SC/ST (PoA) Act. The accused was arrested and now released on bail. The government has approved an amount of Rs.25000 as compensation to the victim but so far she has not received from social welfare department. The case has been acquitted on 25/01/08 because of lack of evidence.
