Case in Brief

Pothula Nagalakshmi is 30 years, native of Gundepudi village, Allavaram mandal, SC Mala by caste.  Her husband Appa Rao is a social activist.  They have a son.  Their village is dominated by the non-dalit community Raju, Kapu, Setti Balija.  All the dalits stay united.  In the recent Panchayat Elections, the village panchyat was reserved for SC Women.  Nagalakshmi won the election with huge majority as sarpanch against the candidate supported by the non-dalit community.  Since then the non-dalits wanted to take revenge on Nagalakshmi and her supporters.  They started opposing in all the developmental activities for the village.  The non-dalit community willfully closed the way to the burial ground which caused inconvenience to the dalit community.  This lead to rivalry between the dalit and non-dalit community and the village secretary made a compromise between them.  The non-dalit community used to threaten and harass the village secretary though he is a government employee.  

A proposal was made in the village meeting to construct a drainage system in the village.  But non-dalit community opposed it.  Though it was approved, Gunturi Sitarama Raju, Gunturi Sivarama Raju, Kotturi Ranga Raju opposed the activity saying that it is their land.  Nagalakshmi said that the land belongs to panchayat.  The accused abused her in the name of caste saying that “Amey Mala lanja neekenta dhairyam, maakee eduru cheptaava?” (You mala bitch, how dare you oppose us?)  Finally they stopped her from constructing the drainage system.  

She complained in the Allavaram PS and the police registered an FIR u/s 7(1) (d) of PCR Act.  When the DSS team asked to include SC/ST (PoA) Act, the police said that they did not register it because she was not attacked.  

Mr.Karthikeyan S/o Kanjimalai belongs to dalit Community, reside at Salaiyur, Thittampatti  Village, Udumalaipettai Taluk, Coimbatore District. On 06.06.2007 there is a common Madurai Veeran Kovil festivel. The people of the villagers were participated in the activities of the temple. Mean while Dalit youth Karthikeyan went to Maligai shop of Muthupandi Nadar near the Salaiyur bus stop to drink cool drink. Mean while Caste Hindu Krishnasamy came to the spot.

He had a quarrel with the Karthikeyan in connection with the affair of the temple festival by saying “How dare dalit dogs can celebrate this function”? and abused filthy words, he derogatory referred by caste name saying that “ Dalit prostitute son” . He was brutally attacked by hand with help of deadly weapons and threaten to kill by Caste hindu Krishansamy . He had a several injuries in his body. He was admitted in Government hospital in Udumalaipettai. Following that he filed a complaint in Kongampalayam police station against Krishnasamy and others. The accused also filed counter case false case against Karhtikeyan. But both the cases were acquitted in Coimbatore sessions court. 

Barla Ramulu s/o Kotaiah & Chennamma w/o Ramulu are the wife and husband r/o Khanapur village under Bijinepali P.S. in Mahabubnagar Dist. They belong to Mala caste-Scheduled caste. On 4-6-07 both of them were collecting black soil from the tank to deposit in their field. This work was done under the NREEGS programme. While they were doing the accused, Swamy, came to them and said\\\" you Mala bustard who would give you a tractor to transport the clay .then Ramulu told him not to hurl abuses at him for this he got very angry and gave heavy slap on his cheek. In the evening when they were coming home the accused, Swamy, Stopped them and demanded them to pay the amount of 400 rupees which the victim owed to him saying so he tied both wife and husband to stone pillars. He abused the woman saying \\\" you mala bitch, you are speaking a lot\\\". Then Uppari Kurumaiah and golla Madulaeti rescued them on their assurance of paying the amount.

There after Ramulu lodged a complaint before the police Bijinepalli which was registered on 04-06-07 as a criminal case in crime no. 48/07 u/s 342, 323,504,506 IPC & 3(1)(x) SC/ST (PoA) Act. The accused arrested. Compensation not paid. Charge sheet not filed.

Thirumoothy (26) belongs to dalit communtiy, He resides at Molakoundan puthur village which is near to Muthur, Kangeyam Taluk, Erode district. On 3^rd June 2007 Mr. Periyasamy came and told him that day before yesterday Sivasidh package paper company workers have beaten his younger brother Mr. Thangaraj.

On 4^th June 2007 around 1 p.m he asked Arumugam who was the supervisor at Sivasidh packing paper company about why they beaten his brother. When he was talking with Arumugam, around 50 persons came near to him. He asked them, why you were beaten my brother. They told that you were beaten our worker when they came for music porgramme. So Mr. Shanmuga Raj ( Caste hindu Gounder community) who is the manager of the that company was instructed to attack him since all those were beaten . They started beating him and somebody told that kill him at the time his another brother Mr. palanisamy came there. They were brought iron rod and attacked him, when the palanisamy tried to protect him. They were assaulted palanisamy itself with steel weapons. They derogatory referred by caste name “Chekkili prostitute, Instead of living, better you can die”. Then his wife and his brother’s wife came and admitted  them in Erode government hospital. On 4^th June 2007 night around 8.30 p.m. police officer from vellakovil police station came and investigated. The caste hindus also lodged the complaint against Dalit youths.
