  • Posted by: NDMJ-Bihar
  • Date of incident: 06-08-2006
  • Create date: 22-03-2014
  • State:: Bihar
  • District:: BHOJPUR
  • Police station:: Nagar Police station Ara
  • Chargesheet:: F.I.R- 06.08.06, No. 165/06, u/s 379, 411, 34 IPC of SC/ST of (PoA) Act., Chargesheet- 12.11.08
  • Summary::

    Four young nuts Pappu Nut (16) s/o Bangali Nut; late Pappu Nut s/o Babulal Nut; late Santosh Nut (17) s/o late Bhadai Nut and late Deepak Nut (17) s/o Lalan Nut held from Ara in Bhojpur District were allegedly beaten unto death by the dominant villagers in the presence of Police personnel. The cruelty of the police is reflected by their mere words, “What are you looking at? Kill all the four thieves.”Nevertheless, the Nut community enjoys no proper basic needs. They are engaged in selling fire wood, petting buffalos and selling them for their livelihood. They are looked upon as the community of thieves by the non Dalits in and around the village. In fact at the time of this inhumane act, the stealing of pet animal esp. cows and buffalos was at its peak. Consequently, the four Dalit youths belonging to Nut community had their last breath as they were caught by the villagers alleged of stealing buffalos on 06.08.2006. Early in the morning on the same day, Bhanu Yadav s/o late Babulal Yadav saw the four taking a buffalo. He asked them to stop but they did not listen to him instead leaving the buffalo behind, started running away from there. Looking at their running, he called out for the help to catch them. ‘Catch the thieves! Catch the thieves!’ was his shout.

    Meanwhile these four nuts were caught by the public and they were allegedly murdered due to their attempt to steal a buffalo. It was more shocking as the police there did not take any step to prevent the crime. It is said that the whole scene was created by the main accused Rajesh Rajak s/o Maherdra Ram, the village chief of the Ramapun Sanadiya Panchayat. The reasons behind this incident were (1) that the cousin sister in law of Bireder Nut and the wife of Satyender Nut was attempted to rape by the perpetrators Lalbabu Yadav, Kameshar Yadav, Rameshar Yadav and Nunhak Yadav vill. Badki Sandiya and the victims’ family had registered the case against the mentioned perpetrators (the case is under trial in the court) and (2) that the perpetrators wanted to take possession of the land belonging to the victims and making them evicted from the village. The above reasons were the cause for the murder of four Nuts. The attempt to steal a buffalo became the means of taking revenge and evicting the Nut families from the village. The murder of the four nuts spots out the dark side of the police administration there in Bhojpur district of Bihar that police too played a fair role in the crime. So far the police have not taken the case seriously. The police are arresting the people belonging to Nut community in this case by break opening the doors of Nuts even at midnight. Case is not register under SC/ST Act. Victim did not receive any compensation or relief. One accused is in the jail and another accuse not arrested. Case is pending in the court.

  • State:: Uttar Pradesh
  • District:: PRATAPGARH
  • Police station:: Patti
  • Summary:: Deceased Chakrasen (21) S/o Late Bawan, a resident of Vadewara Village, Post Odeyadihi, PS- Patti in Pratapgarh District, Uttatar Pradesh, belongs to Scheduled Caste (Chamar) community and professes Hindu religion. His father expired many years back, therefore he along with his two younger brother and mother were staying with his grandfather, Shivmurthi who struggled to bring up the children after their father’s death. Chakrasen was the eldest son of his parents and was doing his education in Allahabad University in UP. On 1st Aug’ 07 in the morning at 5.30 a.m. as usual Chakrasen went for a morning walk. Santosh Mishra (55) S/o Hrudayanarayan Mishra, Akash Dube (18) S/o Karunesh Chandra Dube, Indrajit Saroj (35) S/o Matadin Saroj, members of Dominant Caste, were waiting for Chakrasen on the way with a conspiracy to kill him. The perpetrators took hold of Chakrasen, dragged and tied him up with a Neem tree, beat him with sticks and stabbed him with a screwdriver. When his grandfather, mother and two brothers heard about the incident from Raj Kumar Mishra, a local newspaper seller from neighboring village Shekhpur, they rushed to the spot, but the perpetrators threatened his mother with dire consequence that they would kill her other two sons too if she does not go home back. They went to the Patti police station to report the matter; however the police reached the spot very late and the perpetrators had already run away from the spot. The police took the dead body to Patti police station and after a while the victim’s parents also reached Patti police station. The S.H.O Babu Chandra Rajak made them sit for 2 hours in the police station and asked them to go to The Government Hospital in Pratapgarh along with police for the post mortem of the dead body. The S.H.O also threatened Shivmuthi and Agnisen, one of the brothers of deceased Chakrasen that you must cremate the dead body as soon as possible and you must not take any legal or advocacy measures or else I will ask the perpetrators to kill the other two younger brothers of Chakrasen too. The victim’s family came home from Hospital at about 4.00 p. m after the postmortem and cremated the dead body. The perpetrators have not been arrested, and the police have been trying to dismiss the matter quickly. Therefore the local villagers agitated against the inaction of the police and also for the immediate arrest of the culprits. After the protest on 03.08.07, the FIR was registered u/s 302,304,506 IPC & 3(2) v of SC/ST Act against the culprits and the S.H.O of Patti police station has been suspended from his duty. Again on 07.08.07 the police officials went to victim’s house and threatened that you must not to take any action against the perpetrators, and we will give some financial assistance to you. Dubey and Mishra and the Chakrasen have been fighting over a PDS shop for ten months. In the year 2004 Dubey and Mishra were the owner of the PDS shop, however due to corruption the villagers withdrawn them from the ownership PDS and handed over to Shivmurthi, the grandfather of Chakrasen. They could not bear the fact that a Dalit became the ration shop owner instead of them. They often used to forcibly take food grains from the shop without any paying anything and used to sell it in their shop at a higher rate. When Chakrasen heard about this, he used to go to the village every month to oversee the sale and ensure that every villager got his PDS quota. The accused even got angry when he got admission being a Dalit to the Institute of Engineering and Rural Technology in Allahabad. They used to threat him that Chakrasen would never be able to become an engineer. Chakrasen was 21 and he was doing his BA while preparing for his Uttar Pradesh Technical University entrance examination. S.H.O Mr. Babu Chandra Rajak has been suspended. The District administration has not given security to victims
