    Sonu S/o Shinda R/o Village Karalia, Tehsil: Ajnala District Amritsar. Sonu belongs to Mazhabi Sikh caste which is recognised by the State of Punjab as a Scheduled Caste.He was employed by Partap Bricks Udyog Samiti located in Bhalla Pind, Ajanala road, Tehsil Ajnala Dist: Amritsar. The name of the occupier of the said brick kiln, as per his knowledge, is Shri. Sukhdev Singh S/o Partap Singh. He along with his family members were employed as a Pather in the above mentioned brick kiln in December 2012 on payment of an advance amount of 65,000 (Sixty Five Thousand). This amount also included the debt advance from a previous employer which was passed on to Partap Bricks Udyog Samiti at the time when he was employed. The names of his family members are as under;

    Due to the strike of the brick kiln in the State of Punjab, they were not given any work although they were employed and presented for work. They were not allowed to take up employment of their choice and were compelled to remain present in the brick kiln. They were made to sit idle at work place from December 2012 till first week of April. No compensation was given by the employer for the loss of wages. After this, the employer, Shri Sukhdev Singh, also known as Deva, stated pressurising him  to put his thumb impression on some papers. Being illiterate, they do not know the contents of the papers on which the employer was forcing to place his thumb impression. He was afraid that the employer would deny them their rights and wages if they put his thumb impression on these papers and he refused to do so. When the strike was over, they worked continuously for three week in the first week of April. After this, the employer, Shri Sukhdev Singh, also known as Deva, stated pressurising him to put his thumb impression on some papers. Being illiterate, he did not know the contents of the papers on which the employer was forcing to place his thumb impression.

     

     

     

    He was afraid that the employer surely mis use of his thumb impression and he refused to do so. Thereafter, the employer, without notice, threw us out of the brick kiln with the help of local police from Ajnala Police Station. Some trucks were hired by the employer and his family and he were removed from the brick kiln forcefully. They pleaded to employer that their livelihood should be given to them, but the employer did not listen to their request.They have no other choice to work else where, as the employer at Partap Bricks Udyog Samiti demanded the debt amount of Rs 65,000 from him. There was instruction from the previous employer Pratap Bricks Udyog Samiti to no to employ them any where in the entire area. Now, they are not employed. His family and he are in a state of starvation as they are denied employment in any brick kiln in Amritsar and elsewhere due to their debt obligation. Being Pathers, the only skills they have earn their livelihood, is that of brick moulding and their life and liberty is in danger to the social boycott imposed by the employer. They only mistake, it seems, is that they stood up for their rights. For the past 5 months his family and he are in state of despair, being denied their right to life and livelihood.

A Dalit was Beaten to Death Falna

    Diseased Mohanlal (40) s/o Waqtaram Meghwal was living with his wife and 4 children in an old building of his father near a pond at Falna village, under Falna police station in Pali Dist. Mohanlal was a daily wage labourer.

     

    Once, Savita Devi (40) w/o Mohanlal along with her children had gone to Pihar. On 4 Dec, 12, at about 9.00 p.m. while diseased Mohanlal returning home back from Vijayanagar  Falana station, on the way near Vijayanagar Falna station, the accused persons Imran (30) s/o Faruk Khan and his friends attacked Mohanlal. Due to server injury on head, Mohanlal became unconscious and fell to the ground. Meantime, the accused run away from the place. After a while, Mohanlal regained conscious and with much difficulty, he managed to go home by a tempo of Ashok Kumar Meena, the villager.

     

    Mohanlal breathed his last at around 11.00 p.m. due to sever injury on his head. Jeevan Kumar, the brother of diseased lodged complaint in Falna police station against the accused persons. The police seized the dead body and sent for postmortem

     

    The police arrested Imran (30) s/o Faruk Khan and sent to jail, however the co-accused persons are still on run. A criminal case has been registered on 6 Dec, 12, case no. 164/12, u/s 302 IPC & 3(2)(v) of SC/ST (PoA) Act.

     

    The case is under investigation. The administration has not given any assistant to the victim’s family yet.

The name of the occupier of the said brick kiln, as per his knowledge, is Shri. Sukhdev Singh S/o Partap Singh. He along with his  family members were employed as a Pather in the above mentioned brick kiln in December 2012 on payment of an advance amount of 55,000 (Fifty Five Thousand).     They pleaded with the employer that their livelihood will be jeopardised, but the employer did not heed to their please.

     

    Having no other choice, his family and he tried to take employment elsewhere as the employer at Partap Bricks Udyog Samiti demanded the debt amount of Rs 55,000 back from him. To their shock and dismay they all were denied by the employers in the entire brick kiln as instructed by the occupier of brick kiln. His family and he is in a state of starvation as they were being systematically denied employment in any brick kiln in Amritsar and elsewhere due to their debt obligation. Being Pathers, the only skills they have earn their livelihood, is that of brick moulding and their life and liberty is in danger to the social boycott imposed by the employer. Their only mistake, it seems, is that they stood up for their rights. For the past 5 months his family and he were in state of despair, being denied their right to life and livelihood. The complaint was sent to the DM, Amritsar and the persons were physically released but no FIR was registered against the employer. A Dalit Was Killed & Buried over an Argument

    Diseased Nainaram (25) s/o Dharmaram, was residing at outskirt of Chamunderi, P.S. Nanna in Pali Dist. who used to work in brick kiln of Bhimaram to meet his family needs.

     

    On 1 Dec, 12, Hiraram (35) s/o Bhimaram, Ramesh (30) s/o Bhimaram Kumhar, Prabin (20) s/o Bhimaram Kumhar, Ringaram (48) s/o Chatraram Meena arranged a party, near brick kiln where the Diseased Nainaram was invited. As the party was going on, a quarrel was picked between Hiraram (35) s/o Bhimaram and the victim. Enraged Hiraram hit Nainaram on his head with a spade from back side. Due to the heavy blow, Nainaram fell to the ground and became senseless.

     

    Taking the advantage, Hiraram (35) s/o Bhimaram, Ramesh (30) s/o Bhimaram Kumhar, Prabin (20) s/o Bhimaram Kumhar & Ringaram (48) s/o Chatraram Meena unanimously beat Nainaram to death and then made a chasm on the ground close to brick kiln, put the dead body in it and covered the surface of chasm with bricks. After the crime, Hiraram (35) s/o Bhimaram informed the victim’s family Nainaram went to another place for work; hence you too need not come for the work.

     

    But, as to their fate, Dinesh s/o Dharmaram, happened see his brother Nainaram with accused on the incident day. He also knew that the accused persons have had arranged a party near their brik kiln, where his had been invited. Hence, based on the statement of Hiraram (35) s/o Bhimaram, Dinesh sensed that something bad has happened to his brother.

     

    Thus, taking the matter in confidence the victim’s brother Obaram lodged complaint in Nanna police station against the accused persons. The police took Hiraram (35) s/o Bhimaram, Ramesh (30) s/o Bhimaram Kumhar, Prabin (20) s/o Bhimaram Kumhar & Ringaram (48) s/o Chatraram Meena and kept them on police custody on suspicion of murder and while the police interrogating,  the accused admitted that they have had killed Nainaram and hidden in a  chasm near brick kiln.

     

    On 13 Dec, 12, the police recovered the dead body and sent for postmortem. A criminal case was registered on the same day, case no.236/12, u/s 302,201 IPC & 3(2)(v) of SC/ST (PoA) Act. The case is under investigation. Charge sheet has not been filed yet. Even the victim’s family has not received any compensation from the administration.

Dalit woman abused and beaten in Kusthal

  • Summary:: Gyarsi Devi (32) w/o- Balchandra Balai (35) lives in the village Kustal with her family. She belongs to dalit community, dalits in the village have very less land and the non dalit has more land that is the reason dalits are dominated by the non dalit in the village. On 10.11.2012 Gyarsi Devi and her husband were working on their field, she was cutting a babul tree which was on the boundary of their field. Beside their field there is Rameswar and Mohan Kumabat’s(45) field. Around 10.30 am while she was cutting the tree Mohan and his two sons came and asked her not to cut the tree claiming the tree is on their boundary so Gyarsi said no it’s on my boundary. Then Mohan and both his son Madan and Kishan beaten her severely and abused her in the name of caste and pulled her to nearby pool tried to put her. Her husband Balchandra heard the noise and came to rescue her from them, and then they also started to beat them. Rameswar and his wife Sampat was also working on their field they came running and saved the victim couple from Mohan and his son. They filed FIR about it police took them for treatment and medical report but no action has been taken place about the land and the accused are not arrested.
