Dalit Sarpanch Locked up in a Room & Thrust Following Election Related Dispute

    Krushna Kumar Meghwal (37) s/o Harjiram Meghwal, Parashram (32) s/o Sardarram are the resident of village Pahadi, P.S. Bahroad in Alwar Dist. belong to Scheduled Caste (Meghewal) community.

    On 13 Oct, 12 at about 10.00 p.m. Krushna Kumar Meghwal (37) s/o Harjiram Meghwal contacted Dr. Sunil Kumar of the same village, over phone for medicines for her ailing mother, Puja Devi. Dr. Sunil Kumar said that he is not in the clinic now, so asked him to meet his wife at his residence, who would give them medicine.

     

    As per his instruction, Krushna Kumar Meghwal along with his paternal cousin Parashram (32) s/o Sardarram, the former sarpanch went to the residence of Dr. Sunil Kumar. The victims while waiting for Dr. Sunil sitting in the room, Pappuram s/o Lilara, Pawan Kumar s/o Pappuram, Ravindra Kumar s/o Pappuram, Vijendra Sharma and some villagers, belonging to Dominant Caste suddenly closed the door from outside, where the victims were sitting. When the victims asked the reason for it, they said that they would teach them a lesion. Victim Parashram, passed the news to Dr. Sunil Kumar, Yogesh Gurjar, the husband of present sarpanch and to his family members over phone.

    The family members of the victims reached there and requested Vijendra Sharma to let them out, but the accused persons abused, brutally attacked and chased them out from the place. Till now injuries scares are there on the back of Gokulram s/o Harjiram, one of the victims. The victims’ family members reported the matter to the police. After getting the news the police reached the spot at 2.00 a.m, however seeing the mob, the police went back.

     

    Then, the accused persons brought them out one by one and brutally thrust them with lathi, knife, rode etc. as a result Krushna Kumar Meghwal & Parashram got fractured on their legs and hands.

    The Bahroad police went to the spot again at 7.00 a.m. and reased the victims and adminted them in Bahroad Hospital for treatment. Till 7.00 a.m. the victims were kept in confinement.

     

    The police registerd a case on 14 Oct, 12, case no.545/12, u/s 323,342,379 IPC & 3(1)(x) of SC/ST (PoA) Act. A counter case of molestation was registered against victims on the same day, case no. 544/12, u/s 457,341,323 IPC. The case is under investigation. However none of the accused was arrested. The reason behind the incident attack is said to be following previous enmity over an election.

Atrocity against dalits

    Both the victim and accused resides in same block, the accused blamed the victim for cutting cleaning water facilities and abused her in the name of the caste and threatened her to beat her. The case is under investigation.

    1.       Everyone has the right of life, liberty and security of person [Art. 3 UDHR and Art. 5(b) CERD].
    2.       General recommendation 19 of CEDAW relates to gender-based violence and recommends amongst other things that states should take all legal and other measures that are necessary to provide effective protection of women against gender-based violence including effective legal measures (including penal sanctions), preventive measures (including public information and education programs) and protective measures.

Attack on a Dalit woman & her son because of past-enmity- Una Sadar

  • Summary:: Karishna Devi (35) w/o Moti Lal of Village Dangera, P.O. Smur in Una District belongs to Chamar (SC) community. Karishna Devi, destitute lives along with her three children at Dangera village. On 30/09/2012 at about 4 p.m, while Suresh Kumar s/o Karishna Devi was on his way back home from School, Sunil Kumar s/o Pawan Kumar abused by caste name and attacked him following previous enmity. Some of the neighbours, who were engaged in road construction work, informed Karishna Devi about the matter and she rushed to the spot in rescue of her son and thus she too was brutally attacked by the perpetrator. Somehow, the victims escaped from the hands perpetrator and went home. Again at about 8 p.m, Sunil Kumar along with his cousin went to victim’s house and attacked Karishna Devi with a weapon on her head. She sustained severe injury on her forehead and she fell to the ground after being senseless. On seeing, the assailants escaped from the place of incident. Suresh Kumar s/o Karishna Devi called No. 108 Ambulance and she was admitted in Una Hospital. After that Suresh lodged complaint in Una Sadar police station against the assailants. A criminal case was registered against the perpetrators. So far none of the perpetrators has been arrested. Victims not receive any compensation and relief, the case is under investigation. SC/ST (PoA) Act is not invoked in FIR.

Murder of a Dalit Surendranagar

  • Summary::

    The village named Thangad is situated in the district of Suredranagar. There are Dalit families living in the village. Most of the dalits are surviving on labour work. There is a Charan caste which belongs to schedule caste.

     

    The complainant Natubhai Aababhai Parmar residing at Thangad is an uncle of diseased Prakashbhai who was killed by the Police officer. On 21/09/2012 there was a fair in Thangad and during that time there was quarrel between Bharwad and Dalit community. Thereafter, on 22/09/12 again there was clash between the same communities. One Dalit named Pankajbhai was killed near Dholeshwar Mahadev by PSI Jadeja and the other accused. Therefore the people of Dalit communities approached the police station to make representation but the accused threatened them to kill. In spite the threat from the accused persons Dalit went to police station, at that time near crossing police started firing and Mehulbhai was killed. Prakashbhai was also with the dalit people and he too was shot dead by the police. Thereafter, the offence was registered against all the accused under section 302, 114, 120B, 147, 148, 149 of IPC and 3(2) (5) of the SCST Prevention of Atrocities Act.
