Harchundram (65), Darshanram (30), Jhimo Devi (60), Ramesh (7), Kailash (5) and Devpal (3) and other belonging to Scheduled Caste (Meghwal) community are r/o Vill/P.S. Pokaran in Jaisalmer Dist. A dalit family members and neighboring Dalits were attacked on the eve of Holi on 14.3.2006. The reason behind the attack is stated to be the assertiveness and a little challenging approach to oppose the dominant caste persons belonging to Rajput community of the village, against the practice of untouchability, discrimination and dominancy attitude toward Dalits.  

Exhibiting their dominance, the accused Shaitan Singh, belonging to Rajput community entered the house of Harchand and tried to molest the women and verbally abused them. Darshanram Meghwal together with the family members caught hold of the accused and tied him with rope on 18/02/ 06. This engraved enmity among the Rajput community against Dalits. On 14.3.2006 the Rajputs attacked Dalit families with Axe, sticks, and molested the women members. Many Dalits were severely injured. The case is registered in Pokaran police station on 14 March, 2006, No -43/06 u/s 143, 323, 452 IPC and 3(1)(x) & 3 (1)(xi) of SC/ST (PoA) Act 1989. No accused are arrested so far.

Charge sheet filed in the case on 29.04.06. Case is investigated by the DSP.  Accused arrested and bailed out. Total Compensation of Rs.6250/- paid to the family under SC/ST (PoA) RULES 1995.

Case in Brief:

According to Katari Chinnaiah, father of the deceased Katari Kalyani, the deceased was studying Intermediate 2^nd year and aged about 17 years.  The deceased was residing at Janalapalle Colony, Atmakuru Mandal, Nellore District. There was a love affair between Gaddam Venkata Reddy S/o, China Reddy, aged about 35 years.The deceased and himself, both belong to same village.  In the month of March 2006 the mother Lachamma and younger brother Hari Reddy threatened the deceased by knowing the affair in between her and Venkata Reddy.  They abused her in filthy language that she trapped the Venkata Reddy only to grab their property after that the deceased intimated the same to Venkata Reddy i.e., threatens of his mother Lachamma and younger brother Hari Reddy but the Venkata Reddy did not respond properly and supported his mother and brother for that the deceased shocked and she committed suicide by consuming rat poison.  Before committing suicide she made a suicide note to Venkata Reddy regarding her death and even on that letter also she wishes Venkata Reddy to be well.  On that Atmakur Taluq P.S. police registered a case against Gaddam Venkata Reddy,   mother Lachamma and his brother Hari Reddy under section I.P.C. 506 SC, ST Prevention of Atrocities Act 3(1) (X) and the same was pending on the file of special court, Nellore.

Meanwhile on 2^nd August,2006 the said Venkata Reddy and his family members set fire to their house and thrown it upon the family members of the deceased and at the same time on SC people who were present there at the incident.  People residing side by the house of the Venkata Reddy came there and trying to comedown the fire meanwhile the brother of the Venkata Reddy i.e., Hari Reddy abused Katari Surekha who is nothing but maternal aunt of the deceased Kalyani by touching her caste and that incident i.e., burning of their house was also because of them only.  On that Venkata Reddy and his family made a report to the police with an intention to put pressure upon the family members of the deceased Kalyani and to get over from her suicide affairs on which they being the accused and pending before the Hon’ble Special Court, Nellore

Katari Surekha also gave a report to the police for the atrocity committed by Hari Reddy against her.  But, the sub divisional police officer did not register her case and advised her and all SC people who belongs to that village to compromise with Venkata Reddy family.  Other wise they have to face consequences and for that he would not be responsible.

In that event dominant caste elders of that village also entered and they are all threatening SC people in favor of Venkata Reddy family.  One Kancharla Sri Ramula Reddy who is nearest relative to Venkata Reddy   threatened the SC people that in their village in recent feature there is a chance of repeating the incidents like Karamchedu and Tsundur

As the appropriate authorities did not respond properly the petitioners   having no alternative reports before this commission.

The said Gaddam Venkata Reddy his aged about 35 years has twice than that of the deceased Kalyani.  Infact the Venkata Reddy did not love the deceased Kalyani and only with an intention to cheat her acted to be love.  The said Gaddam Venkata Reddy got a Government Job and doing as a teacher at Thada village and Mandal by claming himself as SC.  There are all things that clearly shows the criminal attitude and mentality of the said Venkata Reddy. 

Case in Brief:

Ontimi Missamma, aged 50 years, W/o Ontimi Daveedu, R/o Near Satyagouri Theatre, C/o Lakshmi Lightings, Main road, Anaparthi, SC Mala by caste has purchased Commercial Lighting Set from the accused Grandhi Prasad Rao, aged 35 years, S/o Grandhi Subbarao, R/o Anaparthi Main Road, Anaparthi, East Godavari, OC Komiti by caste for Rs.6,00, 000/- and paid complete amount.  They have entered into a contract that the accused would divert all his customers to the victim and would not carry on the same business in that area at least for one year.  But the accused soon after he has sold his business assets to the victim, started to carry on the same business in the same area with the same customers.  Also he hired the equipment from the victim thrice and failed to pay the rent amounting to Rs.1, 50, 000/-.  

The victim has given a complaint 6 months back for the rent amount to be paid by the accused but the case was not registered and no further action was taken.  After DSS has intervened complaint was lodged for the breach of contract.

Sonia Devi w/o Raju Ram belonging to Chamar caste in Mondiha village, Nokha Ps and Taluk, Rohtas district, Bihar, was gang raped and killed by the perpetrators Sunil Pandey s/o Vidya Pandey, Ramniwas Pandey s/o Rajdev Pandey, and Suredra Pandey s/o late Jagarnath Pandey from Manipur village, Maudiha post office, Nokha police station in Rohtas district, Bihar, on one of the days between February 14 and 17 in the year 2006. The deceased was the secretary of the women self help group. Her husband was a wage labourer. She was a lady of social orientation and bold in nature.

Once she had gone to attend the marriage ritual of the son of Munmun Pandey at Manipur village. After the ritual had been over she was on the way back her home accompanied with Surender Pandey, the brother of Munmun Pandey on 14/02/2006 at 11pm. She did not reach her home. On the next day, the villagers found looking at the destruction of the mustard field, that late Sonia Devi was gang raped in the field and murdered. And so the father in law of the deceased went to the police station to lodge complaint, which was registered No. 39/06 u/s 302 and 34 IPC against the rapists Ramniwas Pandey, Sunil Pandey and Surendra Pandey, on 16/02/2006. The police came and claimed a plate, broken bangles, slippers and her artificial hair along with food from the mustard field. On 17/02/2006 at 8am people saw the dead body of Sonia Devi in the canal at Jokhinipur. The information was given to the police and the police took the body to a hospital in Sasaram for the postmortem report.

 Under the leadership of the secretary of Navjeevan Vikas Kendra, sister Jyotsana all the members of the women self help group staged a Dharna at the police station. As a result the police arrested the culprits on 02/04/2006. Since the perpetrators had nexus with the police, after bribing them they came out of the jail after three days on 05/04/2006. All accused bailed out. No compensation to victim.
