Doongar Sikrai village has 40 Dalit families and 90 non Dalit families. Out of these 90 families mostly are Brahmins. Manbi Devi has three children and her husband (Man Singh) has gone abroad for job and working as a laborer there. Manbi Devi lives separately from in laws joint family. On February 8, 2006 at about 1 p.m. Manbi went to mustard field owned by Somotya Bairwa to pluck some mustard leaves. All of a sudden Santosh s/o Dwarka Prasad Sharma turned up to the field and clutched Manbi Devi in his arms, pushed her on the ground. Manbi Devi did not understand this sudden attack & what Santosh is going to do with her.
Santosh clutched her mouth with his hands and stripped her lower garment and brutally raped her. Manbi Devi literally screamed but Santosh did not leave her & threatened to kill her and her family members if she will disclose this to anyone. Listening Manbi’s cries other field workers namely Somotya & Prem Chand rushed to her. Santosh ran away before Somatya & Prem Chand arrived to the place of incidence. Manbi Devi narrated the whole incident to them and same day Manbi Devi went to police station to lodge an FIR against the accused Santosh. Knowing that Manbi Devi has lodged FIR against him, he started threatening Manbi and her family members to take back the complaint otherwise or they will be killed.
Accused and his family with the help of community members and some powerful personnel started creating pressure over Manbi Devi and family. They pressurized her family, specially her father to compromise with accused and close the case and however they succeed in it with the help of Local leader Mr. Ram Kishan Jatav and one Advocate Ms. Seema Punjabi. They influenced Manbi’s father and compelled Manbi to compromise with him. Manbi protested at her level and denied to obey the wicked order of her father. Seeing Manbi’s attitude, her whole family stood against her and did not support her. She was pressurized and kept confined at her home. At last Manbi gave up; she killed her spirit and compromised with accused. Manbi’s father charged little amount of Rs. 30,000 from accused on account of compromise but after compromising he did not even receive it. Manbi’s own family killed her voice and did not help her in coming forward against violence.
The offence was committed on February 8, 2006 and FIR was lodged on February 10, 2006 but the local police did not arrest the accused due to pressure from upper caste community people and top politicians. Many a times Manbi and her family presented memorandum to local police and Superintendent of Police to arrest Santosh Kumar but the local police arrested Santosh after seventy days of the incident on 29th April 2006. With his power and pressure Santosh was out of bars and humiliated Manbi and her family to compromise. The police arranged medical examination of Manbi Devi on February 10, 2006 at 11 p.m.
The perpetrator’s family tried to build pressure on victim to compromise the case. Finally, the accused succeeded to get a written statement from victim’s family for compromise of case. The case was compromised in the court.
Muli Devi w/o Late Hardev (74), is a Housewife is resident of Karadtah, Dataramgarh sikar and belongs to Scheduled Caste (Khatik) community. On 31/01/06, while sleeping in her house in the night, someone called from outside saying jaji, jaji open the door, I’m Bhanwar lal. Then she opened the door thinking that her son might have come, because her son used to call her jaji. But suddenly somebody entered into her house and started beatomh her & asked money. Initially she couldn’t recognize them because electricity was cut off during time. Later when she heard the voice, she could recognize that was Rama Singh s/o Vhaga Singh Thakur residing in the same village, who had stolen twice from her house previously. He started beating& punching her in her chick & also tied her neck with a rope which was lying in the cot & then took the key from her, opened the (alamirah) & took Rs.15, 000/- and anklets (ornament for feet), by the time she was senseless.
On the following day morning on 1 Feb, 2006 at 7 a.m. her neighbour Mulchand’s daughter-in-law saw the condition of Muli Devi while going to bring milk. She called all the peoples of the village & the Sekhawat (former sarpanch). Ramlal Khatik, Ramchand Khatik went to Dataramgarh police station & registered a FIR, but they couldn’t able to give the perpetrators name, because by that time victim was senseless. They took her to the nearby hospital & later to S.K Hospital & then to S.M.S Hospital at 2:45p.m., when her sense came back they asked about the incident and the perpetrator. She said that was Rama Singh s/o Vhaga Singh Thakur & his mates, but she couldn’t name them. Mohanlal s/o Ramchandra (40), his brother-in-law Motilal Sankhala (60) resident of chomu, nephew Omprakash s/o Syokaran (40) Prahalad Khatik took her by an ambulance to S.M.S Hospital Jaipur at 9:30. P.m.
On 2/2/2006 at 1p.m. the perpetrator was arrested & sent to jail. On the same day Madanlal parik A.S.I police station Dataramgarh took the statement of Muli Devi & she has mentioned the name of perpetrator. Charge sheet has not been filed.
P. Mareamma belongs to Madiga (SC) community. On 29 January 2006, Potrra Shekar Ramesh, Venkateshwrarlu and two others kidnapped, drugged, gang raped and attempted to murder her. Her genitals were slashed and she was blackmailed. The victim was standing at the bus top when a car came by and asked her destination. When she mentioned that she was going to Telaprolu, they replied that they were also going to the same place and said that they would give her a lift. When she got into the car along with her eight year old daughter Mounika, one of the persons in the car introduced himself as Ramesh and offered her a sweet, due to which both of them fell unconscious. When they became conscious, she found herself in a room with Ramesh. Ramesh asked her to have sex with him. When she refused, he gave her something with which she became unconscious. He then raped her when she was unconscious. After being psychologically disturbed, she ultimately consented to the wishes of Ramesh.
One day Ramesh brought four persons and forced her to have sex with them. When she refused, she was sedated by injections and they then had sexual intercourse with her. When she shouted that she would lodge a complaint they removed her clothes and tortured her entire body with heated metal instruments. When she pleaded with Ramesh and promised that she would never reveal their names, they took her by car to Hanuman Junction and after staying there for a day, he moved her to a doctor’s house in Pamarru. She was kept there for 15 days. In Pamarru also they forced her to have sex with three persons. Later they sedated her, cut her genital organs and badly injured her head and fled thinking that she died. When she regained consciousness, she went to a nearby Dalit colony and lodged a complaint.
Cr.No.155/06, u/s 324,376(g) IPC, 3(1)(xii) SC/ST (PoA) Act, Police Station Pamru. The accused A1 was convicted and sentenced to two years in prison. The prosecution invoked the IPC not the SC/ST (PoA) Act, which they were legally bound to do. Three accused persons were acquitted for lack of evidence. The victim got Rs. 25,000 as compensation.
