Geeta Kumari d/o Charitra Chaudhary and Pyari Devi, belonging to Pasi caste, in Kari village, Shekhpura Ps & Taluka, Shekhpura district, Bihar was raped by a dominant caste member of the village namely Jarik Bind s/o late Harkhu Bind (Bind caste). The family of the victim is involved in the wage labourer.
It was the time of the Dussera festival. The victim had gone to the groundnut field to keep the animals away from there. The rapist Jarik Bind came on the day (October 12, 2005) to the field, carried her on his arms to a nearby pulse’s field and forcefully raped her. A person from the same village Chotelal Yadav s/o late Kesho Yadav saw him running away after the rape. About 1.30pm Geeta Kumari came crying. When she was asked the reason for the crying she narrated the whole incident giving the name of the victim Jarik Bind. Pyari Devi, the mother of the girl took her and went to the police station and filed the FIR no. 255/05 under the section 376 IPC. The police sent them to Sadar Hospital in Shekhpura but there were no doctors available. Again the girl was taken to the Barbigha holpital. There too was the same problem. Finally she was taken to the Sadar Hospital in Munger where she had her medical checkup only after a day of the incident.
The police had visited only once for the arrest of the rapist and appeared no more there. No compensation has been given to the family. No charge sheet has been submitted to the court. The police have made no arrest so far. Geeta has stopped attending school.
Harijana Ramanjinamma (20) D/o Chinna Hanumanthaiya, belongs to scheduled caste community. On 01 October 05 around 6:00 pm, Narsimha Murthi brother of Harijana Ramanjinamma drove their cattle in the barren field of Kuraba Suresh. He beat the cattle by throwing stones at them on that Narasimha Murthy and Kuraba Suresh quarreled. On seeing this H. Ramanjinamma and H. Chinna Hanumanthappa rescued Narasimha and brought him to their house. After some time all the accusers K. Suresh, K. Ramanji, K. Lakshminarayana, Beereaogalli Narasi Reddy and G. Narasimha Reddy formed themselves into a group, armed with sticks and stones and trespassed into the house and beat Narasimha Murthy with sticks and caused injuries. Also beat H. Pedda Hanumanthappa and abused H. Ramanjinamma and others in vulgar language by humiliating their caste in the public and threatened high handedly. All the accused pushed H. Ramanjinamma and H. Lakshamma and beat them with hands and legs. Later the victim complained in Penukonda, Police station and FIR was filed.
A Case was registered on 01/10/2005, Cr.No 130/05 u/s 147,148,452,323 r/w 149 IPC, 3(I)(x) SC&ST Act in Penugoda Police Station. Arrested the accused remanded and released on bail. Charge sheet filed. Compensation not paid. Case No 68/07 is under Trial. Petition filed under 44 Cr.P.C Petition file under 173(1) Cr.P.C& Rule 7(2) SC&ST (PoA) Act. Representation to collector & Concerned Authorities has been made.
Dhapu Devi the victim, w/o Rawal Ram belongs to Meghwal sub caste and resides at Lodta Achlawta, Tehsil Dechu, Dt. Jodhpur, Rajasthan. On 21.9.2005 at 3.30pm Dhapu Devi was coming from a village half a kilometer from Jogmaya Manidar. Daulat Singh Rajput who was sitting at the dealer’s shop, followed her the way back home. She sensed his intention and began walking a bit faster. Since the bushes embanked the way, the rapist ran after her and seized her soon. She shouted for help but he put the kerchief into her mouth and knocked her down. As a result she got the injuries on her body. Not only that but he beat her too. At last he raped her. Dhapu Devi shouted again. Listening to her shout her aunt Suwa Devi came running. By the time she came the site Dhapu Devi had fallen unconscious. Suwa Devi took her home in that same state. When she came to the consciousness she narrated the whole incident. Later on Dhapu Devi, accompanied by her husband Rawalram, went to the police station Dechu and filed the FIR. Seventeen days later the police arrested the rapist and referred him to the court in Jodhpur on 12.10.2005. The victim has been sanctioned the compensation of Rs. 50,000 but she has not received it yet.
The police did not interest FIR. The family of the victim had to stage the Dharna after seventeen days. The police arrested the perpetrator. The police did not grant any protection to the victim and so she had to go to her parents’ house. The state has not promoted the SC/ST (PoA) Act 1989. The Case is going on the Jodhpur court.
