Police Atrocity on Dalit Couple B7 Ramanathapuram – Kovai.

    Mr. Marimuthu and his wife Mrs. Devi, residing in Balasubramanian Nagar, Puliankulam, Coimbatore District, belongs to Dalit Pallan community. On 10/12/2011, While Marimuthu and Devi were in conversation near the Puliankulam Vinayahar Temple, Subasini, a police of B7 Police station, who came on that way, told Marimuthu, to move away. She shouted saying, Bitch! get away from the place. When Marimuthu raise objection to such utterance, Subasini brought Police Ramesh, and beaten him with the lathi. Devi, who came in the defense of Marimuthu was also manhandled. The Police men took them to the Police station and brutally assaulted them. The Police dragged Devi by her hair and beaten her. The public and the relatives of Marimathu begged the police to leave them. But the Police personnel have not listened to their demand. On the same day the filed a false case and imprisoned them in the Kovai Cenral Jail.

     

    The general public, social activists, and political party members sought permission from the District Collector Mrs. Hema Karunaharan, to organize a protest march against this attack. But the Distr ict Administration denied the request. Then with the approval of the High Court they

    conducted a protest movement opposing this police atrocity on 20/01/2012. District Administration have not taken any action regarding this incident. Police personnel indulged in this atrocity were not implicated and punished for this atrocity. Prior to this incident one Nelson who was brutally tortured and humiliated by the B7 Police station police personnel, committed suicide. B7 Police target Dalit people and ill-treat them. Very often atrocity against dalits were orchestrated by this police station.

Ban on taking drinking water from public well in Mosukaraipalayam sakkill Kinaruthottam

  • Summary:: In Mosukaraipalayam village of Erode Block, Erode district about 60 years ago the village elders and the Panchayat leaders dug a well between Rengasamy Gounder and Poosari Gounder’s land in sakkill Kinaru thottam to enable the Dalit Arunthathiyar get drinking water. The Dalit Arunthathiyar used the well for the past 60 years. In 2003, Ramasamy Gounder’s son-in-law Annadurai Gounder got a declaration and a stay order from the High court, Chennai preventing others to use the water from the well. On 30.06.2003, the Dalit gave a complaint to the Collector, Erode district following which excepting brief problems, the Dalits were using the well water. Last year on 06.06.2011, 13.11.2011, 04.07.2011 the upper caste people submitted a petition preventing the Dalits from using the well. On 20.06.2011, the Dalits gave complaint to the Sub-Inspector, Malaiyampalayam and got a receipt for the same. They did not get any written declaration to use the water. The Dalits filed a petition under RTI with Mohan as the petitioner regarding actions taken on the complaints. The Thasildar of Erode district directed the revenue Inspector to convene peace meetings but without any such meetings he declared that the well belonged to Annadurai Gounder on 04.07.2011. On 09.12.2011, arround 10.30 a.m when Mohan was taking water, Annadurai Gounder attacked Mohan. Mohan received severe blows on his head and a report was filed in the Police station. The DSP conducted an enquiry and said that, the case does not have sufficient witness. He also enforced a prohibition not allowing the Dalit people from taking water.

Caste discrimination and Threatening to murder

    Victim Ajay Rajbar is daily laborer and resident of Chiksiya in Bokaro district. On 02.12.2011, three of the CCUSED Dinesh Sharma, Bikas Sharma and Gayaram Sharma asked him to go to field and reap the crop. But Ajay refused to go because of ill health. So the accused told him it important to reap the crop so you have to go. If you will not agree then we will sister and mother and spoil your reputation. They abused him in the name of caste and told that they will not allow victim or his family to enter either pond or the field.

    When he did not go to the field, three of the accused came in the evening to victim’s house with some weapon and shouted at him shay we will finish you today. The victim and his whole family got very frightened and locked themselves in a room. The accused then broke down the wall, kitchen and all the belonging of the house and threned them to kill. By hearing the noise when the neighbor came, they all left victims house while abusing him.

    1.       Everyone has the right of life, liberty and security of person [Art. 3 UDHR and Art. 5(b) CERD].
    2.       General recommendation 19 of CEDAW relates to gender-based violence and recommends amongst other things that states should take all legal and other measures that are necessary to provide effective protection of women against gender-based violence including effective legal measures (including penal sanctions), preventive measures (including public information and education programs) and protective measures.

Police Atrocity on Dalit Woman Panrutti PS

    Vinayagam, is resident of  Sathayamurthy Nagar, Panrutti Taluk, Cuddalore District. He was accused of robbery in a Jewelry Shop in Tindivanam. During interrogation he told that, he had given the stolen jewels to his wife residing in Sathyamurthy Nagar. To investigate the matter further 3 police men of the Tindivanam Police station went to Sathyamurthy Nagar, Cuddalore to interrogate Sivakumar’s Wife Malliga. In Sathyamurthy Nagar without proper verification they mistakenly arrested one Malliga W/o Vinayagam and brought her to the Tindivanam Police Station. They carried out this investigation and interrogation without getting approval  or providing any information to the Panrutti Police station. Malliga w/o Vinayagam was subjected to sexual and physical torture by the three police men in the police station. During the investigation after realizing that they have mistakenly arrested Malliga W/o Vinayagam instead of Malliga W/o Vinayagam, they brought her back to the village. Infuriated general public chased away the police men. Panrutti Police men managed to escape the attack and ranaway from the spot.

     

    Panrutti Cirlce Inspector Mr. Anand Babu, refused to entertain the complaint given against the Tindivanam Police Personnel regarding the abduction of Malliga w/o Sivakumar. Higher police officials were negligent to take against the erred police men regarding this wrongful abduction and sexual assault.

Attack on a Dalit Because of His Caste Identity

    Ruparam (40) s/o Dalaram is the resident of village Parakhia, under Sumerpur police station in Pali Dist. belong to Scheduled Caste (Meghewal) community. He is a daily wage labourer. On the incident day, 2 Nov, 2011, at about 2.00 p.m. Ruparam was passing through Hotel Javani which is located aside of National highway no. 14. by his motorbike. Unfortunately, the tube of motorbike got punctured near Hotel Javani, hence he stopped and went to a garage which is aside the road, near Hotel Javani to pump up the tube.

     

    While taking out the tube from motorbike, the villagers of Naitra, namely Deelip Singh (32), Karan Singh (35), Babu Singh (40) and Bhima Singh (30) went over there and harassed Ruparam. When the victims retorted, the accused persons abused in caste lines and brutally beat him and threatened him to kill, if he reported the matter in the police station.

     

    On the next day, on 3 Nov, 11, Ruparam went to Sumerpur police station to lodge complaint. a case was registered No.379/12, u/s 143,341,323, IPC & 3(1)(x) of SC/ST (PoA) Act. against the assailants, however the police did not take any action against the them because the perpetrators are very much influential politically.

     

    None of the accused was arrested in this case. The case is under investigation. The victim has not received any compensation from administration.
