A Dalit Limbs Chopped off, When he Objected to Land Encroachment

    Charan Singh (42) s/o Bhagchand is the resident of village Arouda, under Nadboi police station in Bharatpur Dist. belong to Scheduled Caste (Jatav) community. Charan Singh owned a piece of land along the road side, which passes through his house. He did also plant some trees on the road side, close to his land.

     

    On the day of incident, 19 Oct, 2011, when the Charan Singh was at home, Bharat Singh & Gyana Singh s/o Malkhan Singh, belonging to Jat community, went to victim’s house and pulled out a stamp, which was being used for tying domestic animals. When Charan Singh and his family objected to it, the accused persons threatened to the victims by saying this land belongs to us, if you bring any objection against us, we will kill you

     

    Then the accused persons went back, but after 15 minutes, a gang of people namely Bharat Singh & Gyana Singh s/o Malkhan Singh, Man Singh, Pul Malkhan, Rajesh s/o Phoji, Malkhan s/o Dariv, DeshRaj s/o Phoji Malkhan Chandrabati w/o Phoji Kashalya w/o Malkhan, went to victim’s house again well armed with deadly weapons like lathi, rods, farsa and attacked the entire family of Charan Singh.

     

    The accused attacked Keshula w/o Charan Singh with farsa on the head. Keshula run inside the house and hid herself in a darkened place to save her life. The accused also chopped off hands and legs of Bhag Chand with farsa. In critical condition Keshula and Bhag Chand were admitted in Rajkiya Hospital in Bharatpur.

     

    On 19 Oct, 2011, Charan Singh lodged complained in Nadboi police station, thus a case was registered, case no. 491/11, u/s 143,323,341,452,354,379, IPC & 3(1)(x) of SC/ST (PoA) Act. When the accused persons came to know that a case has been registered against them in Nadboi police station, they again went to victim’s house and set his house on fire and broke drinking water hand pump too. Charan Singh lodged complaint in Nadboi police station again, but the police did not register. The perpetrators were arrested and sent to jail. However, the victim’s family is under threat of perpetrators. The victim’s family has not received any compensation yet.

Dalit Bonded Labour of Pathankot

  • Summary:: Sarvan Kumar, Prakash Ram, Harjinder Singh & Raju came to our office on 10th October 2011. They told that they are working on the brick kiln of M/S Aggarwal Bricks Company, Village- Jungla (Dina Nagar to Bharota road), tehsil & District-Pathankot. They gave their complaints in writing to the VSJ (DDVA). In their complaints they were previously working on another brick kiln & they were brought to this brick kiln by M/S Aggarwal Bricks Company through one Jamadar Raju by paying the alleged bonded debt to the previous employer. They were facing very hardships including the economic hardship as the employer was not paying them enough money to buy two square meals a day. One of their colleagues Sita Ram was beaten by the employer at the worksite after that Sita Ram & his family members sought their freedom through The District Magistrate, Pathankot. All the four went to the nearby market to buy some food stuff, they all were rounded up by 20 to 25 goons accompanying Raju jamadar (Agent) and the employer Sonu & started beating them. The victim workers manage to escape from there they had the phone number of Sita Ram who was also inhabitant of Rajasthan. They called him who guided them to go to the VSJ office. The Dalit Dasta Virodhi Andolan an offshoot of Volunteers for Social Justice made four complaints separately and sends them to the National Human Rights Commission on 15/10/011. The NHRC was pleased to register the case as case no.916/19/6/2011-BL/UC and notice was sent to the District Magistrate, Nagaur & the similar directions were given to District Magistrate, Pathankot to submit the report within 15 days. The copy of the order passed by NHRC is placed as annexure-“A”. On 17th October 2011 the wife of the jamadar named Kamla Devi W/o Raju lodged FIR No:101, dated 17/10/011 at Police Station- Kalwan, District- Pathankot under section 324, 323 & 34 of Indian Penal Code against two bonded labourers Sarvan Kumar S/o Kheta Ram and Eshar S/o Sarvan Kumar. Both the bonded labourers were in the police & judicial lockup from 17th October 2011 to 20th December 2011. The brick kiln workers were facing a big hardship at the brick kiln & the victims who were living in the Volunteers for Social Justice Office got information that their children are sick without food and constantly being tortured by the Jamadar & employer. A criminal Writ petition No: 2269 of 2011 titled as Raju S/o Sarvan Versus State of Punjab & others was filed before The Punjab & Haryana High Court, Chandigarh. VSJ persuaded the matter and send a reminder to NHRC, New Delhi. After this on 25/3/2012 the Police Station-Kalwan, District- Pathankot has registered a case against the Ramesh Aggarwal S/o Sh. Roop La Aggarwal proprietor Aggarwal Brick Company, Village- Bhiwani under section 16 & 17 of the Bonded Labour System (Abolition) Act 1976. Mr. Jai Singh have received summons from the police station to appear before Pritam Singh, Assistant Sub Inspector of Police for recording of his statement. The case is still pending.

Custodial death in Virugampakkam police station

  • Summary:: Muthu S/o. Kuppusamy belongs to Hindu Adhidravidar Community and a native of Cuddalore. He migrated to Chennai and has been working in private companies and shops over 20 years. Off late he has been working in the Cinema Industry. When a theft took place in Bhimas jewelery, Vadapalani the police arrested one Shahul Hamid of Athirampattinam, Tanjore. Getting a statement from him Muthu was arrested. Muthu was taken from his home on the pretext of enquiry on 30.09.2011 around 11pm from his home in Vadapalani. Buvaneswari, who was with Muthu’s that time questioned the police as to why Muthu was being taken in the night. The police beat her and took away Muthu forcibly. On 01.10.2011 Muthu was taken in a police van. On the way the police picked Jeyakumar and Siva from Koliyanur. Then they went in search Muthu’s relative Raju in the native village Attrankarai. Muthu was brutally tortured by the police from Cuddalore to Chennai. The police took him to Virugampakkam Police Station and locked him up. Around 4.30pm he was found dead in the cell. SASY has sent a telegram on 06.10.2011 to Chief Minister, Home Secretary, SP, and DGP. Muthu’s Mother Rajammal also sent complaints to all police and state officials on 07.10.2011. The police filed FIR under suspicious death and resistance for arrest. The Inspector of Police, Sub-Inspector of Police and Head Constable have been suspended. A Magistrate enquiry has been conducted. Muthu’s mother and four other relatives recorded their witnesses. The social activists, Human Rights Organiations along with Viduthalai Chiruthaigal Katchi Orgainised a dharna before District Collector Office demanding the arrest of Police.

Dalit family assaulted- Bara Khurd village

  • Summary:: Village Bara is situated 45km far from its district Bharatpur and 2 km from police station Halena. In the village most of the people are working as daily labor and some are depending on cattle rearing too. 50family gujjar and 50 family jatav reside in the village, and sarpanch is from gujjar community. Victim Harbati (46) w/o Amarchandra Jatav is from jatav(Dalit) community. On 28th September 2011, Harbati was alone in the house her husband Amarchandra Jatav had gone to work. Around 1pm Chandrabhan Gujjar s/o- Gopal Gujjar came to the victims house and took away their buffalo, when Harbati protested and asked someone to call her husband Amarchandra. Chandrabhan beaten the victim and her husband with rod and injured them; he also abused them in the name of caste. As the accused family has criminal record he also gives trouble to the dalits in the village. The victims are now afraid of the accused and flew away from the village.

Murder of a Human Rights defender

  • Summary:: The Tamilnadu government acquired land for housing of Arundathathiyar community of Thaneerpandal village of Avinasi Taluk, Tiruppur District in the year 1996. These lands were acquired from the dominant communities. The Arunthathiyar families were living in that land for eight years. But the government did not measure, and allot the housing sites for the dalits so the dominant community in 2011, burned all the houses and bulldozed them using JCB machines. The dalit people gave a complaint to Thasildar, District Sessions Judge and SC/ST commission on 01.06.2011, 22.09.2011 and 16.12.2011 respectively. The social activists and Human Rights Organizations staged a dharna in Sevur Kaikatti. Complaints were also sent to Chief Secretary and Adidravida Department. So far no action has been taken on the officials who neglected their duties or on the people who were involved in destruction of the dalit village.
