    Brief Details of the Case:

    Divya Sri is the daughter of Vara Prasada Rao and Jayamma, residents of Mangalagunta Palem, Narsapuram, W G Dt. They are agricultural workers. As they did not have children they adopted Divya Sri from a hospital when she was an infant. When she has grown up they came to know that she is mentally retarded. As they have to earn their daily livelihood, they were forced to leave Divya Sri alone at home and go for work. One day Ella Rambabu of the same village mason by occupation came to the house of Vara Prasada Rao’s house for construction of wall. Ram Babu is married and has two children. Having noticed the situation that Divya Sri is mentally retarded, stays alone at home during day time, he sexually exploited her. As Divya Sri had vomitings her parents took her to the doctor. They were astonished when the doctor informed them that Divya Sri was 3 months pregnant. Having come to know that it was Ram Babu, Vara Prasada Rao and his wife Jayamma went to his house and asked him. Ram Babu and his family members reacted seriously and said how dare you come and ask me, abused them on the name of caste. He also said that he satisfied the lust of his daughter on her instigation. He also warned them of dire consequences and said to go and complain with whomever they want.

    With the help of DSS, Vara Prasada Rao approached the police and lodged a complaint on 22nd May 2010.  The case was registered in Narsapur Rural Police station of West Godavari district.

  • Summary:: Vellaisamy S/o Perumal belongs to Arunthathiyar community, he resident at perundurai in Erode district. He was working as a lorry loading man in perundurai area. He have a union in perundurai, In perundurai union loading members only doing this loading and unloading work others not allowed to do this work. Sakthivel belongs to caste hindu auto driver. On 18.05.2010 sakthivel tried to unload the lorry since vellaisamy asked to stop the work, Immediately he yelled at him calling abusive words including casteist language (how dare a sakkiliyans can stop me).He was brutally attacked. On 21.05.2010 he given compliant in perundurai police station and they assured that surly action will take but till date FIR not filed by perundurai police.

    SVSP Manikkaraja Devar, a self proclaimed Junior Jamin resident of Kayathar Union, Kovilpatti Taluk, Thoothukudi district, practices caste based discrimination and atrocities against dalit communities. Perumal belonging to Dalit community, elected as the Union Chairman was not allowed to function independently. Perumal being a obedient servant of Manikkaraja never complains about the dominance of Manikkaraja. The TATA SUMO provided to the Chairman was taken over by Manikkaraja and used for his personal purpose. Since 2006, he was hoisting the National Flag during the Independence day and Republic Day functions. The District Administration largely ignored this undue practice of him. Even though he practices untouchability in the Kadambur region, Police department never initiated against him. He proclaim himself as the Union Chairman and have his name inscribed as the Chairman in some of the Boards.

     

    Manikkaraja is affiliated to AIADMK Party and he is the party secretary for the Kovilpatti constituency. Raman, belonging to Dalit community lodged a complaint against Manikkaraja accusing his discriminatory. Hence Manikkaraja threatened him and intimidated him to withdraw the complaint. Anti Caste Dominance Federation staged a district level protest movement against the culprit. They have filed a petition with the High Court seeking action against him, with the intervention of the High Court a case was filed against him.

  • Summary:: Subbulakshmi W/o Krishnamoorthy residents in Tharuvai village, Palayankottai on Tirunelveli district. She belongs to dalit community, working as a wage labour. Iyyakatti belongs to Devar community. On 12.05.2010 while she was working in agriculture filed Iyyakatti took her into agricultural field and attempted rapes her. When she was shouted he escaped from the place then she filed case in police station in Munnerpalayam police station on 17.05.2010, on next day DSP investigated this case. He was arrested and remanded 15 days in palayankottai prison.

    The victim asked about the plan by JCB near the School area, so the accused abused and beaten the victim. The accused also tried to urinate on the mouth of the victim and they called him in his caste and taken his watch. They always suppress him as a lower dalit community person.

    1.       Everyone has the right of life, liberty and security of person [Art. 3 UDHR and Art. 5(b) CERD].
    2.       General recommendation 19 of CEDAW relates to gender-based violence and recommends amongst other things that states should take all legal and other measures that are necessary to provide effective protection of women against gender-based violence including effective legal measures (including penal sanctions), preventive measures (including public information and education programs) and protective measures.
