DALIT MINOR GIRL KIDNAPED AND SEXUALLY ASSAULTED IN AHMADNAGAR DISTRICT OF MAHARSHTRA

Dalit minor girl Kumari Saskhi Jamdhade, age 9 years, belonging Mahar caste (SC) was sdudying in 4^th class at Chatrapati Sambhaji School, Gautamnagar, Suregaon, Tq. Kopargaon, Dist.Ahmadnagar was usually went to school on dated 13^th December 2019. Her parents went to farm for labour work. When her cousin brother went to school by the evening around 5 pm, the Sakshi was not there. Then he informed her parents and they searched her. One person from the village telephonically informed that one boy took her on bike, her parents went to police station and lodged a missing complaint at Kopargaon PS. The police searched her and she found next day on dated 14^th December 2019. Police Officer sent her for medical examination with her parents and sexual intercourse is found in the medical examination. They arrested the accused who belongs to Maratha community. Police lodged FIR under POSOA, IPC and POA.  

Selvanayaki (19) and her younger sister Meghalaya (13) are the daughters of Periyasamy and Sellammal couple residing in Jambothi village, Ginger Block of Villupuram district. Manivannan (21), of Hindu Vanniayar caste (most backward caste) fell in love three months ago while working in a Saravana store canteen. The two have returned to their hometown on 22.09.2020. On 05.10.2020 at around 08.00 am, Selvanayaki was shocked when a woman named Vanitha from Melsevalampadi village of Melmalayanur Block called and told her that Manivannan was in love with her.

But Selvanayaki immediately rushed to Manivannan’s house and she was stopped by Mannivannan. But she did not listen and came in a two-wheeler and knocked her down. She stumbled and fell down and he had taken her to his sister Manjula’s home. He had sexually abused Selvanayaki who was unconscious all night. She was taken to a private hospital on 06.10.2020 and left her at around 07.30 am that morning. After that Selvanayaki speaks like a mentally ill person with a serious head injury. Later a complaint was lodged at the Ginger Police Station. At around 07.00 pm that night she was admitted in Gingee Government Hospital and later shifted to Mundiyambakkam Government Medical College Hospital for further treatment and was discharged on 15.10.2020. They were later interrogated at the Gingee police station, a case was registered and the accused person was arrested and kept in Villupuram jail.

Mr. Pongavanam (60) S/o Mr. P. Ponnusamy is a resident of Chidderi Village, Melmalayanur Block of Villupuram District. He is belonged to the Irular caste (sub caste of Scheduled Tribes). Pongavanam along with former Panchayat Leader Mr. Selvaraj, S/o Mr. Ranganathan, Arumugam S/o Pongavanam Rajendran S/o Ramanujam, Ramakrishnan S/o Pongavanam, Mani S/o Manikkam from Vadavetti village had lodged a complaint with the District Superintendent of Police and Valathi Police on 29.07.2020 alleging that Thanigaimalai, a member of the Vanniyar community, had placed his photograph on the national flag and distributed his visiting cards.

Based on the complaint lodged, six persons have been asked to come to the Valathi police station on 08.08.2020 for investigation. However, the suspects were interrogated at the Valathi police station on 09.08.2020 at around 10.00 am.

Following this, on 10.08.2020 at around 06.15 am, while Pongavanam was returning after pouring milk, he and his wife Mathi were verbally abused in derogatory and filthy language referring to the caste names and were brutally attacked by the caste mob.

Tamil Selvan (23) S/o Mr. Gopal is married to Kalpana, aged 19, of Pacharpalayam village, Malaiyapalayam village panchayat, Sultanpet panchayat union, Sulur Taluk of Coimbatore district. He is belonged to the Hindu Arunthathiyar caste (Sub Caste of Scheduled Castes). After completing his 12^th standard, he has been working for the last 5 years as a tractor driver with a weekly salary (4000-four thousand) to Rakiyappan, a member of the Kongu Velalar counter caste in the nearby Malayapalayam.

M.R. Palanisamy, a 50-year-old of Kongu Vellalar Gounder caste is residing near the Rakiyappa Gounder’s house in the same hill station, is a member of the ruling ADMK party and is working as a contractor to put roads and small bridges in village panchayats. Tamilselvan has been working as an Acting Driver for the tractor M.R. Palanisamy Gounder and only one day in the month of Sunday on the request of Rakiyappa Gounder’s for only one day in the month of October, for which Tamilselvan did not pay them on M.R. Palanisamy Gounder.

In this situation, on 28-10-2020, Tamilselvan went to the house of M.R Palanisamy Gounder in Malaiyapalayam and asked for his salary for a day\'s work a month ago, but it has come to light that MR Palanisamy Gounder was not at home. He called and said that the night Tamilselvan had gone to Chencherimalai. When he left, MR Palanisamy Gounder went in front of him in a two wheeler and immediately Tamilselvan stopped at Palanisamy Gounder and asked for money for the work he had done for a month by driving a tractor and in turn he had verbally abused him in filthy and derogatory language referring to the caste names in public. Prabhakaran, a native of Tamilselvan\'s hometown, said the incident took place when Tamilselvan was slapped on the left cheek with his right hand about five times, kicked about five times, kicked down and spit on the face.

Arunthathiyar Tamilselvan, went in a two-wheeler with the help of his friends that night and was treated at the Palladam Government Hospital at around 10-00 pm, but the doctors refused to treat him as an inpatient saying that the injury was not serious. He came out of the hospital and went to the Sultanpet police station to lodge a complaint. MR Palanisamy Gounder went to Tamilselvan along with the ruling ADMK party Malaipalayam panchayat leader Mahendran, Rakiyappan, Rakiyappan son Balasubramaniam, Rakiyappan Machan Manthirachalam called Malaipalayam, Sencherimalai Gounder and tried to compromise and also threatened him not to lodge a complaint at the police station.

The next day (29-10-2020) Prabhakaran, Dharmaraj, Naveen and his lawyer Suriyakumar, who were witnesses to the incident, took about 30 people to the Sultanpet police station and filed under the SC/ST PoA Act. Sub-Inspector Ravi has lodged a complaint (CSR No: 120/2020) against Tamil Selvan and the Dalit organization for delaying the case in favor of the dominant caste without filing a case against the MR Palanisamy Gounder. FIR No: 404/2020 at Sulthanpettai PS u/s 323,506 (i) IPC r / w 3 (i) (r), 3 (i) (s), 3 (2) (va) Sc / St PoA Act-2015.

Also counter FIR has been registered against the victim Tamilselvan on the complaint lodged by M.R. Palanisamy Gounder and no arrests were made on either side.

Mathaiyan, 50, S/o Karuppan is resident of Erode district, Anthiyur, Bargur post, Kongadai, Sundamedu hill. Appreciating his grandfather’s work for scavenging (village dandal) in the Bargur Hills (now Erode District, Anthiyur Circle, Kadampur Hills) in the Continuum Mountains, he was given about seventeen acres of land on the Kongadai Sundapodu Hill in 1917 to cultivate and survive for the last time. The dominant caste Hindu in the area did not like the fact that so much land was given to a member of the Arunthathiyar caste (Sub Caste of Scheduled Castes). There was a son named Karuppan, Karithottaiyan Thambidi and Chinnamara Thambidi, two members of the Lingayattu community (MBC) of the Hindu caste who were close to expropriating the land from their son Karuppan after Thevarayan had died of old age, and the family had severely threatened to write off the land if Karuppan did not allow them to cultivate his land. They have threatened to burn him to death, and have threatened him with various forms of caste-based atrocities and conspiracies to demand the bond of the land.

Mr. Karuppan had two daughters and three sons, the eldest of who was Mathaiyan, who was abducted and brutally beaten and murdered in the Kadampur hills. Mathaiyan is married to Myithili. Thinking that he and his family\'s life would be in danger he made his family to stay in a rented house in Ennamangalam village near Anthiyur and cultivating his land. Thambidi heirs Ganesathambidi, Murugathambidi, Rayanthambidi, Thottayanthambidi, Nagathambidi and Chinnamarathambidi exerted their political influence. Yanpadthi Madhayan and his brothers are not allowed to plow the land to cultivate their land, no one is coming to plow the land by threatening to grab the keys of the tractors, and Lingayathar has filed a case in the Chennai High Court against the lower house for plotting to obstruct the land grab for about three generations. On 28-11-2020, he was abducted by a mercenary in a car and taken to the Kadampur police station in the Padimadu forest reserve. He was taken to the Golmalam forest reserve in the Vaithiyanathapuram section of the road leading to the Sushilkara Kadampur forest and tortured, hit in the head with a stone and killed him.

Kodukalsamy reported Mathaiyan’s body on 29-11-2020 and informed the Gormalam Wildlife Sanctuary Senthil about the incident. Mathaiya\'s body was found and he was sent to the Erode District Government Medical College Hospital for autopsy.
