Mr. Munusaamy and his wife Amsavalli belonged to the Scheduled caste and resident of Melmalaiyanur Block Melachrery village in Villupuram District. Their elder son Nithishkumar had gone to his grandmother’s home in melacherry village on 19.07.2020 around 5.30PM. Nithishkumar took a pakoda from his grandmother lakshmi and went near the Village Panchayat office and started eating. And then Anbazhagan of Uudaiyar caste (dominant caste) asked Nithish Kumar that “who are you, why are you eating pakoda here?”, Nithishkumar had replied him that he has come to his grandmother lakshmi’s house. The next moment Anbazhagan had verbally abused Nithishkumar with filthy words and abused by referring to the caste name. Anbazhagan and karthikeyan brutally attacked Nithishkumar with a knife, wooden logs and iron rod. Nithishkumar was severely injured in the brutal attack. That same night around 8.00 PM Nithishkumar was admitted in Gingee government hospital as an outpatient and got treatment and returned home. Next day 20.7.2020 at 11.00PM Nithishkumar had lodged a complaint at Gingee police station. The accused persons were arrested under SC/ST POA amendment act -2015. 

on 20.07.2020 FIR has been registered at the Gingee PS with the crime no: 2577/2020 u/s 147, 148, 294(b),323, 324, 427,506(ii) IPC r/w: 3(1)(r), 3(1)(s), 3(ii)(Va)  – SC/ST PoA  Act.

यह घटना जिला ऊना की तहसील घनारी के गांव राम नगर (नकडोह) बार्ड न० 1 की है. यह गांव ऊना मुख्यालय से 50 कि०मी० की दुरी पर है. राज्य हिमाचल में जातिय व्यवस्था पर आधारित छुआछूत की घटनाएं थमने का नाम नहीं ले रही है भारत को आज़ाद हुए 70 वर्ष के करीब हो गए है पर ऐसी घटिया मानसिकता रखने वाले लोग आज भी समाज में मौजूद है. घटना सिथित इस गांव में चमार जाति के 15 घर, राजपूत जाति के  25 घर, ब्राहमण जाति के 4 घर, बाती (OBC) 250, लोहार जाति के 3 गुज्जर जाति के 20 घर. जुलाहा जाति के 20 घर, झीर जाति के 4 घर है.

             इसी गांव में दलित चमार जाति में से वीना कुमारी पत्नी श्री राकेश कुमार रहती है राकेश कुमार राजपूत जाति से सम्बन्ध रखता है, इन दोनों ने प्रेम विवाह करवाया है. इन दोनों की शादी 12 फरवरी 2009 को जिला ऊना की तहसील अम्ब के कोर्ट में हुई है. इन दोनों की अंतरजातीय शादी को लेकर बीना और राकेश कुमार के परिवार वाले सहमत हैं. बीना देवी के 2 बच्चे हैं एक बेटा और बेटी. इसी गांव में बीना देवी के घर परिवार से लगभग 200 मीटर की दुरी पर चैंचल सिंह अपने परिवार के साथ रहता है जो की अपने मामा मामी के घर में रहता है. चैन्चल सिंह की पत्नी का नाम सलोचना देवी है सलोचना ने सन 2011 में बीना देवी को धीरे धीरे बातें सुनानी शुरू कर दी की देखो वो जा रही है चमारी जिसने हमारे राजपूत लडके से शादी की है. इसके बाद हर आये दिन सलोचना देवी ने बीना देवी को तंग करना शुरू कर दिया. इस बात को लेकर राकेश कुमार ने कई सलोचना देवी की मिन्नत की की वह इस तरह की अभद्र टिप्पणिया ना किया करे पर इस पर सलोचना ने को बात ना मानी और अपने अभद्र व्यंग जारी रखे जिस पर बीना देवी का घर से आना जाना दुशवार हो गया जिस पर बीना देवी ने तंग आ कर 23.1.16 को पुलिस थाना अम्ब में अपनी शिकायत कर दीऔर उस दिन बीना देवी के साथ सलोचना देवी ने अपनी गलती मानते हुए राजीनामा कर लिया इतना होने की बावजूद भी सलोचना देवी अपनी घटिया मानसिकता से बाज़ नहीं आई और हर आये दिन बीना देवी को जातिय टीपनी करती रही

     बीना के घर पक्की सड़क तक 200 मीटर का कचा रास्ता है और बहुत साड़ी जंगली झाड़ियाँ है जबकि सलोचना देवी का घर बिलकुल पक्की सड़क के साथ है जब बीना व उसके पति ने पंचायत से मिलकर कच्चे रास्ते की सफाई के लिए 1 लाख रूपये पास करवाए और 8.8.20 को रास्ते की सफाई हेतु पंचायत ने लेवर लगा दी इतना देख सलोचना देवी उन्हें गालियाँ निकालने लगी और धमकियां देने लगी जब वीना ने इसका विरोध किया तो सलोचना कहने लगी के मैं तुझे जेल बिजवाउंगी चक्की और इस रास्ते को कभी पका नहीं होने दूंगी तू चमारी हमारे राजपूतों के बीच आ गई है. सलोचना बीना के साथ हाथापाई पर उतारू हो गई. और कहने लगी तेरे पति को अपनी बेटियों की छेड़खानी करने के आरोप में फसाउंगी.

         फिर बीना ने अपने पति को साथ लेकर थाना अम्ब में अपनी शिकायत दर्ज करवाई और सलोचना देवी के खिलाफ FIR दर्ज करवा दी पर अभी तक सलोचना देवी के खिलाफ अभी तक कोई कार्यवाही नहीं हुई है.        

Details of the Case:

Buddamolla Satteyya and Sunitha are residents of Vubagunta village, Shabad Mandal, Ranga Reddy district.  They are S.C. Mala by caste and he works as a plumber.  As there was no sufficient earnings in the village, he shifted to Milardevpalli, Rajendra Nagar mandal and settled there in Rajiv Gruha Kalpa works.  On 28-05-2020 Sunitha suffered pains and sprains in the hands and legs.  She was taken to “Sri Srinivasa Multi Specialty Hospital” opposite to police station of Milardevpalli.  This hospital was inaugurated about 6 months ago and it belongs to the relatives of local M.L.A. Prakash Gowd.    At the time when Sunitha was joined in the hospital one Mr. Raghavendra Gowd was on duty.  He treated her and by about 11.00 a.m. Sunitha got relief and felt cured.  Then the doctor told Sunitha, her husband and relatives that though it is cured now, for permanent cure it is necessary to know the actual cause by examining blood reports.   Sunitha and her relatives agreed and got the blood tested.  The reports came in the evening and at about 8.00 p.m., Dr. Raghavendra Gowd and another doctor examined the reports and informed them that Sunitha has sodium deficiency and that it is necessary to give sodium injections.  They said that it is necessary for her to be admitted in the hospital for three days treatment.  Then they started giving her glucose.  At about 8.30 – 9.00 p.m. Sunitha felt severe pain and cried.  She asked them to remove glucose saline.  Husband and relatives of Sunitha approached the doctor and told him that Sunitha was feeling pain and crying. 

Then the doctor told them that there would be pain while administering medicines and asked them to go away from there, saying that Sunitha would not co-operate for treatment if they are present around her.  At about 10.00 p.m. the husband and relatives went to see Sunitha, they found her shifted from general ward and joined in ICU.  Shocked at the turn of events, they asked the doctor what happened and why she was shifted to ICU.  They asked the doctor to show her to them.  Then they all went to ICU and saw her and found her unconscious.  They questioned the doctors to tell them what happened.  The doctors said, nothing happened, she if fine and just they shifted her to ICU because there is A.C, there and that she is sleeping.  The doctors asked they to go away from ICU.  But after some time, the relatives noticed that the doctors and nurses are running around and were in commotion, they felt that something had gone serious and saw Sunitha in ICU.  They found her on ventilators and then they grasped that it was serious and that the treatment turned out to be spurious.   It was around11.00 p.m. at that time.   The relatives started shouting at the doctors for their misdeeds, then Dr. Raghavendra Gowd told that she was alright and that the pulse is fine and suggested them to take her to Apollo hospital.  Then they shifted her to their ambulance along with two nurses.  But the relatives insisted that the doctors should accompany them to tell the doctors at Apollo about the medicines and treatment given by them.  Then the doctors told them to go first and that they would follow.  But the relatives got suspicion and kept Mr. Sudhakar, the brother of Sunitha at the doctors to see if they would start or not.  As he was there and pressurizing them to start, the doctor started in his car along with Sudhakar and reached Apollo hospital. 

There he asked Sudhakar to get down and stay there while he will park his car and come back.  But instead of parking the car, he sped away in the car at a high speed.  At that time the Apollo doctors who examined Sunitha told the relatives that she was brought dead and she expired 15 minutes ago.  When the relatives of Sunitha asked the doctors at Apollo about the cause of death, they replied that they can’t say anything without examining case sheets and line of treatment.

All the relatives went back to Sri Srinivas Hospital by around 11.30 p.m., by then there were local politicians and police at the hospital.  The husband gave police complaint against the doctors at the Milardevpalli police station.  From then onwards until the afternoon of next day the politicians and the police attempted to convince the husband of Sunitha for a compromise.  The ACP himself gave Rs.50,000/ to Mr. Sudhakar, the brother of Sunitha telling him to utilize the amount towards funeral expenses.  The police themselves arranged a DCM and transported the dead body to their village.

Details of the Case:

Mr. Kelavath Devujya and Chavali Bhai are S.T. Lambada couple, residents of Chevudamma Gutta Tanda, Farook Nagar Mandal, Ranga Reddy district.  They have three sons and three daughters.  They eke out living as cultivators.  Their grandfather had property of 8.3 acres which he sold away to one Mr. Gobri long ago.  In the year 1999 Gobri sold part of the land to Vendiga Pentaiah.  This Pentaiah again sold 3 acres to one Mr. Sriram Reddy.  Kelavath Devujya purchased 19 kuntas of land from Gobri in 2010, thus he purchased a small chunk of land sold by his ancestors. From then onwards he has been cultivating that land and he erected fencing for his 19 kuntas land.  Over a time, the cost of the land in that area hiked and out of the remaining land owned by Pentaiah, he made a real estate venture and sold plots in 3 acres.    After the land values hiked and Pentaiah earned through real estate venture in the remaining part of his land, Sri Ram Reddy also appeared at the scene.  As he already owned 3 acres of land which he purchased from Pentaiah, he started purchasing the lands surrounding his land.  It should be noted that though Sri Ram Reddy purchased 3 acres from Pentaiah long back, he never visited his land.  Now he appeared there to make fast buck out of real estate ventures.  He purchased surrounding lands and he conspired to occupy the 19 Kuntas land of Devujya and with that evil intention, he removed the fencing surrounding the land of Devujya on 15-09-2019.  Devujya suffered loss due to the removal of that fencing and he complained to the Shad Nagar police on 16-09-2019.  After that on 10-10-2019 a false case of trespass was registered on Devujya and his son Lakshman, obviously at the behest of Sri Ram Reddy.  In this connection the police called Devujya to compromise with Sri Ram Reddy and threatened him several times.  The case is going on still.  Later, Devujya again re-erected fencing to his land.  On 02-01-2020 at about 2.00 p.m. Sriram Reddy, Raghava Reddy, Bobbili Krishna Chaitanya Reddy along with 20 members came to the land of Devujya and destroyed the entire fencing on his land.   Learning about the incident Devujya along with his wife reached his land and questioned Sri Ram Reddy about the removal of the fencing and asked him why he is interfering with the enjoyment of his land.  He further said, “this land is our ancestral land and ever since I purchased these 19 kuntas, I have been cultivating it.  If you have any doubts about the extent of the land and boundaries, you may get it measured officially and enjoy your land, leaving us our land”.  Sri Ram Reddy then became ferocious and abused Devujya and his wife in the name of caste.  He said,” you lambada Lanja kodaka, you don’t understand things.  If I want, I can kill both of you in no time and nothing happens, you don’t compromise, you exhibit your lambada caste nature”.  Meanwhile, Devuja’s son Lakshman came there.  Seeing him, Sri Ram Reddy and his companions abused him also, saying, “why did you come, you lambada bastard, what can you do, if you don’t go away, we will kill all of you”.   Terrified at the abuse and the group of henchmen of Sri Ram Reddy, Devujya, his wife and son calmly went away and approached the Shad Nagar police and complained.  But the police did not register the complaint.  They kept on going to the police for 15 days but the police did not register the case.  On the other hand, the SI of Police Mr. Deva Raj used to call Devujya several times and threatened him to compromise or else Sri Ram Reddy will kill their entire family.  Having approached the Shad Nagar police several times and as the SI was not registering the case and threatening him, Devujya sent a written complaint on 07-02-2020 to the SI, CI, ACP, SC, ST Commission and SHRC through registered post.  After receiving the registered post, on 12-02-2020 Devujya was called and case was registered in ACP office.  After all this also, the police are supportive of Sri Ram Reddy and on 09-02-2020 Sri Ram Reddy dug a bore adjacent to the border line of Devuja’s land.  Knowing that a bore is being dug, Devuja’s wife and daughter-in-law went to the site and stood at a distance to observe where the bore was being dug.  Seeing them, Sri Ram Reddy took a video of them and complained to the police that Devujya sent his wife and daughter-in-law to attack them and that the women threw stones at him.   The police immediately rang up to Devujya and threatened him that there was a complaint against him that he sent his women to attack Sri Ram Reddy and further that they have all evidence.  However, the case is registered and the situation is tense.
