Brief Details of the Case:
Mr. Krishna and Vijaya, are couple, residents of Yeddu Mylaram Village, Kandi Mandal, Sanga Reddy district. They belong to S.C. Madiga caste and have two daughters, elder daughter is Jhansi, studying 10th Class in the local Z.P. High School. Jhansi is all the time falling ill and the parents believe that it is due to witchcraft. They took her to several places for treatment. They used to stay a few days at places where they went for treatment and usually when out of place, she was well. She falls back to illness when they come back to their village Yeddu Mylaram. In these circumstances they shifted to Sankarapalli and resided in a rented house. They rented a house behind Mandal office and the house owners hail from Yelvarthi village. The house is a three storied building. In that three storied building Jhansi’s family stayed in the top floor. Parents Krishna and Vijaya, used to take Jhansi and the younger daughter to the school in their village and then go to their work. After shifting to Sankarapalli also Jhansi had fallen ill after a month. Mother stopped going to work to take care of Jhansi and they stopped sending the younger daughter also to school. After some time when Jhansi’s health picked up, her mother started going to work but let Jhansi stay at home without going to school. While so in the month of September 2019 on the occasion of Jhansi’s birth day they arranged dinner for all the residents of the three floors. That way the relationship with other in the building developed with this family. Jhansi’s mother while going to work used to request one Ms. Yashoda, residing in the ground floor to look after Jhansi. Taking this opportunity, Ms. Yashoda introduced her brother-in-law Mr. Sampangi Dasaradh to Jhansi. Mr. Dasaradh and Jhansi used to be friendly and chit chat the entire day. He used to get her fruits and other gifts for her health and slowly their friendship developed into love. They decided to marry. They planned to elope and on 17-11-2019 at night time they both went away. The next day morning, when the parents noticed Jhansi was missing, they searched for her and complained at Sankarapalli police station. They did not suspect the co-tenants in the building. Mr. Dasaradh who took away Jhansi joined her in a hostel, by name, Priyanka hostel, at Madhapur, Hyderabad. There at Attapur, he had a friend by name Sampangi Suresh, residing at Attapur. With his cooperation, Dasaradh used to take Jhansi to his house and have sex with her and leave her back in the hostel. This got leaked to the parents of Jhansi through a friend of Suresh. Then the parents of Jhansi requested him to give the number of Dasaradh and they called that number and spoke to Jhansi. They asked Jhansi to come back but she refused and said she would like to stay there with him. Then the parents approached police and gave them the phone number through which they contacted Jhansi. Police detected the location of the call and identified that she was in Priyanka hostel, Madhapur. Then the police, along with the father of Jhansi had gone to Priyanka hostel and brought back Jhansi. Then also she showed disinterest to go with the parents and refused to come. Somehow the police brought her and counselled her for three days and then handed her over to her parents. A case under S.C.S.T (PoA) Act was registered on Dasaradh.
Details of the Case:
Kandada Parvathamma and Padma Rao, residents of Ayyappa Reddy Gudem village, Sankarapalli mandal, Ranga Reddy district, have one daughter and two sons. They belong to S.C. Madiga caste. Padma Rao died in an accident 13 years ago. Elder son is physically handicapped. Parvathamma is employed in a school in Sankarapalli in the mid-day meals scheme. Daughter, Sailaja, is studying degree course in Jagrithi Degree College, Sankarapalli. They run a small provision shop in their home. The younger son, Naresh, looks after the provisions shop at home. One Mr. Chandippa Mahesh, belonging to B.C. caste, resident of the same village, is a close friend of Naresh and visits Naresh every day. Over a time, relationship developed between Mahesh and Sailaja. Naresh, knows that Mahesh had developed relationships with three other women earlier and cheated them. But he never suspected him that he would do such a thing to his sister as they were close friends. Sailaja and Mahesh used to meet at her college and communicate over phone. While so 2-09-2019 Mahesh secretly went to see a girl for an alliance at Tanguturu village and there he had photographs also with that girl whom he consulted for marriage alliance. Sailaja got information about this matter and spoke to him over phone. Later when Mahesh visited her home as usual, she checked his phone for the photos of his visit for marriage alliance. On that night Mahesh messaged her, “I love you”. Naresh, saw that message and warned his sister Sailaja and told her that Mahesh is not a good person and about how cheated other girls in the past. But Sailaja insisted that she would marry only Mahesh and that he promised her that he would marry her. Then Naresh summoned Mahesh and warned both Sailaja and Mahesh. Then Mahesh promised Naresh that he would not contact his sister in future. On 04-09-2019 Mahesh got engaged with the girl from Tanguturu. On 6-09-2019 Sailaja went out of the house saying that she was going to college. But, after some time, Naresh got a phone call from Mahesh and Sailaja, that they both came out of home and that they have decided to marry. They said that they are near BPL forest area. Immediately Naresh went to the location they told and shouted at Mahesh, how many women he cheats and brought back Sailaja. The same day evening both Sailaja and Mahesh again eloped and went out. Sailaja’s brother again went in search of them and found them at Kesa Mailaram forest area and bet both of them and brought back Sailaja. She was at home for about 15 days. On 24-09-2019 when the entire family were engaged in their work and were away, Sailaja committed suicide in the home by hanging with her saree. On 25th post mortem was conducted in Sankarapalli government hospital and the body was handed over to the family. A case was registered against Mahesh for cheating in the name of love.
Ms. Selvi (Panchayat President) W/O Ramesh belonging from caste Hindu-minority community and residing at Kondarasampalayam in Tirupur District. Mr. Kuppusamy belonging to the Goundar community in the same panchayat. Kuppusamy verbally abuses by using caste names in front of the public in the office of the municipality. Again Kuppusamy threatens to kill Ms. Selvi. The Darapuram Police Station has filed a complaint under the Prevention of Violence Act. It is noteworthy that the police have not yet arrested the accused Kupusamy.
Mr. Irulapoo Selvakumar is residing in the above mentioned address and belonged to the Irular Caste (Sub Caste of Scheduled Castes). He reside with his wife Krishnaveni (33) and children Logeswari (14), Megala (13), Kabilan (08). His daughters are studying 8 th standard and his son is studying 4 th standard. He is engaged in the social activities where working for the Dalits and Adivasi communities at the state level. Moreover, he is also holding the position of President in Palangudi Irular Peravai.
In these circumstances, on 09.05.2020 around 7 in the morning, he and his son Kabilan were riding their bike (TN 61 K 1372) for shop towards the Devanoor – Chitheri road. On their way a man named Chinnaiyan of Koovagam village was having a meat (pork) shop and saw a man named Rasakannu, S/o Chinnathambi of his village was standing near the meat shop. He stopped his bike and was conversing with Rasakannu. While he was buying meat from the shop a man from Devanoor – Pusari street belonged to the Vanniyar caste (dominant caste) had verbally abused him in filthy and derogatory language referring to the caste names and discriminated him in public view. Also threatened and was about to attack him that he would murder him for engaging in the social activities for the Dalit and Adivasi communities.
Immediately he screamed and told him not to attack and abuse him. Rasakannu replied that he had spoken against his uncle Raja Durai (30), S/o Selvarasu and had brutally attacked him at right side of his face and pushed him to the nearby bushes. Later he had also strangled his neck with his towel and he was suffocating for breathe. He had sustained severe and blood injuries at his shoulders, chest and legs.
Later a case was registered with the crime no: 773/2020 sections: U/s: 294(b),323,506(i) -IPC r/w: 3(1)(r), 3(1)(s), 3(ii)(Va) – SC/ST PoA Act and the police had arrested the two accused persons namely Selvaiah and Raja Durai. But the family members of the accused persons are stilling threatening the victim’s family.
Mr. Narayanan is residing in the above mentioned address with his wife along with his four children (2 sons ad 2 daughters). He belonged to the Hindu Arunthathiyar caste (Sub Caste of Scheduled Castes). His elder son Pandiyan (35) has got married and his wife is working as maid in abroad. They have three girl children Priya (10), Janani (8) and Marava (6) respectively. Pandiyan is working as constructional labourer in Chennai and also holding 40 cents of land.
There are only 5 Arunthathiyar families and more than 1000 families belonged to Vanniyar caste (dominant caste) are residing in their village. And most of the Vanniyars are holding acres of land, political leaders and also working in government sector.
Mr. Vengatachalapatty belonged to the Vanniyar caste of the same village is holding land near to Pandiyan’s land. Also Vengatachalapatty is having a four wheeler where he usually goes to Koyambedu market, Chennai for purchasing the groceries and vegetables. Since Pandiyan is also working in Chennai they both have regular contacts and communications.
On 30.03.2020 around 10: 00 he and his son Pandiyan was conversing to each other and Pandiyan got a call. Meantime, Vengatachalapatty had called Pandiyan (9585979145) and had called him to come to the backyard. Pandiyan had gone outside and he didn’t return home even in late night. And Mr. Narayanan had made a call to Pandiyan’s number and his mobile was switched off. And then he slept off.
The next day morning on 31.03.2020 around 7 a.m in the morning Mr. Arumugam, one of relatives of Vengatachalapatty had arrived there and told that his son Pandiyan has been found dead in the reserve land belonged to the forest department. He was shocked and terrified with this news and rushed to the place. Pandiyan was found dead with severe and brutal injuries at his legs; and blood injuries from his ears. Immediately he went to Vengatachalapatty to enquire about the incident since he was the one who had called him the last night (30.03.2020). On the way he found frozen blood in the canals of Vengatachalapatty’s chilly farm.
Subsequently, he had informed the incident to the Police Station and Palani, relative of Vengatachalapatty had told him to take Pandiyan’s body to home and around 8 a.m Pandiyan’s deceased body was brought home. Within few hours, he was asked to come to Vengatachalapatty’s home and Vengatachalapatty’s relatives Seethapathi (60), Marimuthu (55) (grocery shop owner) and Ganesan (50) had verbally abused him in filthy and derogatory language referring to the caste names and threatened him that they are more than 1000 families in the village and the 5 Arunthathiyar families cannot stand against them. They had asked him to immediately conduct the funeral of Pandiyan.
Later about 50 persons of Vengatachalapatty’s family members surrounded Pandiyan’s family and negotiated that they would provide Rs. 3 lakhs to them and forced them to bury the body. They had also asked them not to approach the police in this regard. Pandiyan’s family refused to get the money and did not agree for their compromise.
Vengatachalapatty’s relative again told that they would immediately give Rs. 50,000 and the remaining amount after the funeral and forced them not to reach the PS. In case if they reach they would burn/set fire on the 5 Arunthathiyar families.
Since Pandiyan’s family members were stern and with the help of their relative Murugan they lodged a complaint at Thirunavallur PS around 4: 30 p.m of the same day. Later the policemen reached his home by 5: 30 p.m and took Pandiyan’s body to Mundiyambakkam Government and Medical College Hospital, Villupuram District for postmortem.
Mr. Arun, S/o Mr. Arulantham, Village Administrative Officer, Nathamoordid not conduct any enquiry or investigation in this case, but made the case as Pandiyan was electrocuted when he went to catch rabbits and registered the case with the crime number: 235/2020 u/s 147, 201, 304 (ii) IPC, sec 135 (1) (a) IE Act. By the pressure of the dominant caste people in the village the VAO made the case as of electrocution. Pandiyan’s family members went to the Deputy Superintendent of Police and narrated the incident. He then investigated the case and arrested 5 accused persons and imprisoned them.
