Mr. Subramani belonging to the Dalit community is working as a Daliy Wage Labourer at Erode District. On 18.04.2016 when he was on his way to work he saw Mr. Subramaniam Gounder quarreling on money issue with Mr.Muthusami who is a friend of Mr. Subramani.
Mr. Subramani approached to Mr. Subramaniam Gounder and spoke on behalf of Muthusami and assured that he would repay his money very soon. The same day by 8 pm when Subramani on his way to home stopped at a small tiffin centre and had parotta. He also bought parotta for his family. Suddenly Subramaniam Gounder rushed to the tiffin centre and brutally attacked Subramani and verbally abused him with caste names.
Dalit Chinnasamy is working as a construction labourer for daily wages at Duraisamy Gounder\\\'s land. On 12.06.2016 a man named Palanisamy Gounder along with three men came to Duraisamy\\\'s land and warned him not to build the house and told that the land is under encumbrance. There was a quarrel among them.
Meantime Chinnasamy started to work at Duraisamy\\\'s land; on seeing this Palanisamy and other three men rushed near Chinnasamy, abused him in filthy language with the caste names and brutally attacked him. He had severe injuries at his right hand and head. He was then taken to the Perunthurai Government Hospital by Ms. Ponmani (w/o Mr. Duraisamy) and later was shifted to the Erode Government Hospital. The victim statment was received and FIR was lodged at the Perunthurai Police station with the crime number 314/2016 u/s 323, 324 of IPC r/w 3 (1) (r) and 3 (1) (s) of SC/ ST PoA Amendment Act 2015.
The accused Mr. Palanisamy had filed a counter case against the victim Chinnasamy, Duraisamy and Ponumani at Perunthurai Police station with the crime number 315/2016 u/s 324, 506 (i) of IPC.
Sunali Kandi is a 7 year old minor girl studying in class-IV. Her father Ranjan Kandi is a Trolley Rickshaw Puller. On 5.4.2016, the girl had gone to the betel shop on the edge of the village Patalada at about 11.0 AM. While she was coming back one young man Manoj Mallik S/O- Fakir Mallik Aged about 24years of the same village stopped her and gave her some chocolates. He dragged her to a nearby vacant house and kissed her. He told her that he will give her chocolates & money every day and unclothed her panty and raped her. She cried at this paint loudly and some people reached the spot. Seeing the people coming to the spot, the accused fled away. The girl reached her home and informed her family members about the incident crying in inconsolably. Her father took her to the police station and lodged the complaint. While they were going to police station, the accused saw them and threatened with dire consequences if they go to police and lodge complaint.
In receipt of complaint, the police went to the village to search for the accused, failed to locate him. The police officer carrying out the search operation at that time had taken Rs 200/-from the father of the victim. Secondly, the father of the victim requested a person namely: Suresh Charana Bastia to write the complaint. It is found that the FIR was very weak did not describe every aspect of the crime.
It was found that the Police has moved for booking the offences under section 376 of IPC, section 4 of POCSO Act and section 3 of SC & ST PoA Act, 1989.
The incident is of Village Lambhua, District Sultanpur, UP where a Dalit community is attacked by a dominant cast Jatt Community people on 09-06-2016. People from Dalit community got severe injuries during the attack, their houses are grossly ransackedand they are threatened of brutal consequences if they will try to report the same to Police. Victim community is under fear of life as no Protection is provided to them by district authority aas well as FIR is also not registered under appropriate sections. No designated official has visited the incident spot and no arrestings have been made in the case so far.
A poor Dalit labourer residing in the upper caste colony was murdered by a Brahmin on 30 January 2016 because they wanted to pressurize to leave the upper caste colony. The poor labourer resisted so he was shot dead on January 30 by his upper caste neighbour.
In this case the local police did not register the case under the SC/ST Act just to deny his survivors to avail of benefits under the SC/ST Act. However, after great efforts the sections of SC/ST Act were inserted in the Charge Sheet filed in the Court. In this Case to the main accused has not yet been arrested by the police and on the contrary supporters of the accused everyday terrorize and threatening the poor Dalit family members of Mr. Lekh Raj. The family of the Lekh Raj are now totally helpless as the administration has not yet paid them any monetary help as per provisions of the SC/ST Act.
