Duryodhan Naik aged about 72 years lives with his family in Brajarajpur village under Ranapur Police Station in Nayagarh district. He is a landless persons and in extreme poverty. His dilapidated house exists on the land belonging to his first wife, who died long back. He earns his livelihood by stitching ‘Kantha’. Kantha also spelled kanta, and qanta, is a type of craft (can be with embroidery) in the eastern regions of India, particularly in the Indian states of West Bengal, Tripura and Odisha as well as in Bangladesh. In Odisha, old saris are stacked on each other and hand-stitched to make a thin piece of cushion. This is used above a bed cushion or bedding or blanket. The house bears the mark of the poverty of the family.
After the death of first wife, Duryodhan married to another lady, namely Mina Naik and had offspring out of the marriage. The victim Sony Naik, aged about 15 years, is the eldest daughter out of the second marriage. She is studying in nearby Brajarajpur High School in Class-X. Mina Naik seems to be of unsound mental condition; but no medical evaluation or treatment has been done in that regard.
This is only Pana family in the village which is one of the Sub-Castes of Scheduled Caste categories. It is a pattern in the village to show discriminatory treatment to the family due to their Caste and economic status.In the last week of month of March, Sony confided her father that their neighbour had forcible sexual relationship with her. After more questioning, it revealed that he had been raping her repeatedly for last three months. The house of Babu Parida, son of Tapan Parida is situated in front of the house of the victim’s family. Babu is 20 year old youth and got married within two years back and having a baby of 8 months. Duryodhan informed the matter to the
Sarapanch of the Gram Panchayat and requested due justice. This matter was revealed to Debraj Nayak, one DHRD of the area who in turn communicated to ALVM. A fact finding team visited to the village immediately.
Despite information to the Sarapanch, when no concrete steps were coming through, Duryodhan went to Ranapur, Police Station to lodge the compliant. This message was spread and a mass attacked the house of the family. They forcibly bound the girl to n electric pole and assaulted her mother. The accused group also went to police station to lodge complaint that Babu Parida is being falsely implicated. Duryodhan coming back from police station unbound his daughter and again went to police station. Duryodhan gave another complaint written complaint with the information about mass attack. FIR no 77 U/s 376(3), 376(2)(n), 341, 294,323, 342, 506, 34 IPC with 4, 8, 12 POCSO Act and 3(1)(r)(s), (2)(v)(va) of SC & ST PoA Act was registered and 8 accused out of 11 were arrested and forwarded to judicial custody. Names of the accused persons arrested are Babu Parida, Rabi Parida, Sipu Total, Ashanti Parida, Sanju Parida, Sakhi Parida and Manju Matta. The mother was sent for treatment by the police.
Prafulla Behera, a physically differentlyable person, his wife Manjulata Behera, daughter Jayashree and son Balabhadra live in Tantisahi village under Sripurushottam GP under Delanga police station in Puri district. Jayashree Behera, is 14 year old minor girl who studies in Class-VIII in nearby school. They belong to Chamar Sub Caste under Scheduled Caste category. Prafulla Behera gets Disability Pension. All of them engage in making palm-leaf craft for their livelihood.
The family being in abject poverty cannot afford the luxury of a toilet and they go to field to meet the call of nature. On 19.3.22 in the evening, Jayashree was coming back from the field meeting natures call. At that moment the accused Sumant Barik pounced open her and put her on ground. He tried to disrobe her and rape her. She shouted for help and her mother came running to rescue her. Jayashree released herself from the clutch of Sumant; but the accused got hold of Manjulata, the mother and forcibly putting her down he tried to rape her. He threatened to kill whoever resist her and shouted that he will rape both the mother and the daughter. The girl put all her energy to rescue her mother and both tried to defend themselves with a stick. When he found such strong counter to his attempt, he ran away.
The matter was reported to the police on the same day resulting in repeated raids by police party during the nights. However written compliant was given in nextday morning which was registered as Delanga PS case no 85 dated 20.3.2022 under Sections 341,354A, 294,323,354,506 IPC with 8 POCSO Act and 3(1)(r)(s), (2)(v) Sc & ST PoA Act. The family approached Satyamanu Pradhan, an activist of nearby village and fact finding was conducted on 24.3.2022.
Mrs. Nyana Nayak aged about 52 years W/O- Dusa nayak of Dhabaleswar Gada, Adarsh Colony, PS- CDA Phase-II Dist- Cuttack. On Date-19-02-2022 morning Laxman Behera (50) S/O- Babaji Nayak SEBC caste of Bidanasi abusing her in obscene language like Ghodagehi, Bedhei, Hadiani etc. Laxman Behera says that where do we come from and are living here as an organization. He sells government land to people here. In the case we had complained about this to the police station. That is why he was speaking badly in opposition to usand in the media on dated 19-02-2022 at about 1.30PM to 2 PM that we sell government land to the people. He has damage our honor. Charge sheet will be submitted in this case soon. The case is under progress.
Statement of victim-
The victim name Jayanti Behera W/O- Amulya Behera At-palasia, Choudwar, Dist- Cuttack stated that the accused persons namely 1-nilu barik, 2-hada barik, 3-bibuna abrik, 4-Dhusa Barik, 5-Dunia Barik altogether used obscence languages, stated attacked , kicked to the minor victim younger son of informant severely indicated caste feeling words/gestures to the victims. Even threatened to kill & to burnwith pouring petrol.
This case pending before court for adjudication.
Mr. Mani – Irular Panchayat president has contested and won the local government elections held in December 2019 near Neelanthangal Village, KeelPennathur Union, Vettavalam Block of Tiruvannamalai District. For the last two years the Panchayat Secretary Mr. Sukumar has been intimidating the Panchayat President and getting his signature on the cheque. On 10.01.2022 at around 07.30 am the Panchayat Secretary has asked the Panchayat President to sign the cheque to withdraw money for Pongal expenses. But Mani had denied that he could not sign and immediately the secretary had verbally abused him in filthy and derogatory language referring to the caste names. The next day on 11.01.2022 he lodged a complaint with the District Collector. On 15.01.2022, the AD Panchayat, BDO, while conducting an investigation at the Nilanthangal Panchayat office, the Panchayat Secretary also attacked the vice-president Mr. Suresh. FIR was registered under the SC/ST PoA Act on 27.02.2022 at Vettavalam PS and the Panchayat Secretary Mr. Sukumar was arrested on 10.04.2022 and imprisoned in the Vellore Central Prison.
