Brutal Assault and Official Negligence

    Nallakattipalayam village, which is under the A. Periyapalayam Gram Panchayat, is in Avinashi Taluk, Tiruppur District. In the village dominant caste hindu Nayakkars practices untouchability and caste discrimination against Dalits. Most of the dalits are engaged as daily wage farm labourers in the agricultural lands of Nayakkars. M. Loganathan (49), resident of Nallakattipalayam, belongs to Dalit Arunthathiyar community. For the last 12 years he has been Tank Operator in the Nallakattipalayam village, without any official recognition. As per the gram Panchayat agreement, he was paid meager salary for the work. During the Panchayat Presidentship of Ms. Vasanthi, a petition was filed with the District Magistrate to appoint Loganathan as the Tank Operator in the Village Panchayat. But the negligent district administration largely ignored this petition. On 31/08/09, during the Greivance Redressal Meeting organized by the District Administration, Loganathan again gave a petition seeking to appoint him as the Tank Operator in their village.

     

    During the evening, as usual when he went to the Nayakkar neighbourhood to check the water supply, one Rangasamy Nayakkar (48), who could not tolerate the assertion of Loganathan seeking the appointment of Tank Operator, told him that hence forth you should not look after the water supply and we will appoint one from our own community. In return Loganathan asked, “Lord! how you are telling like this?. Intolerant and infuriated Rangasamy abused him saying, “Sakkili son of prostitute, how dare you question me”. Having abused him, Rangasamy slapped him repeatedly and hit him in his chest. On seeing the Panchayat Vice president Palanisamy, Loganathan cried for help. Palanisamy, instead of helping him, joined with Rangasamy, and pushed him down. Both the perpetrators brutally assaulted Loganathan. When Loganathan escaping from the assault, left his bi-cycle and torch light, reported this assault to Palanisamy’s friend Allimuthu and then he reported this through phone to Panchayat President Mr Rathnasamy. But Rathnasmay having no ear for the assault and told that we will discuss about this tomorrow.

     

    Loganathan hesitated to report this atrocity to police fearing that the caste hindus might prevent him from getting appointed as the tank operator. As he was unable to bear the pain, with the help of his son, around 12 am, went to the Tiruppur Government Hospital for medical treatment by arranging a private call taxi. But the Staffs of the hospital, denied to admit him and asked him to report this to the police in the first place and then to come to the hospital. Hence bearing the pain, around 2 am Loganathan went to the Uthukuli Police Station to file a complaint. On reaching the police station around 4am, after listening to the atrocity as narrated by Loganathan, Head Constable Pachaiappan called up the perpetrators to come to the police station. Police Pachaippan asked Loganathan to come to the police station in the morning with a written complaint. At around 9am Sub Inspector arrived and received the complaint and gave a medical memo to gain admission in the Tiruppur Government Hospital. He received medical treatment for the next five days. The police have arrested Rangasamy and Palanisamy and detained them in the Coimbatore Central Jail.

     

    Later the victim compromised with the perpetrators and choose to struck peace with them.

Dalit Bonded Labour Tarn Taran

  • Summary:: Amar Singh S/o Gura Singh is resident of Village- Kairon, tehsil-Patti, district- Tarntaran. He belongs to “Majhabi Sikh” caste which is declared as scheduled caste by the Govt. of Punjab. He was working with Baldev Singh s/o Bakshish singh (Jatt Sikh) resident of village-Kairon, tehsil-Patti, Distt- Tarntaran. Baldev Singh gives advance to Amar Singh of Rs. 5000/- in 1st year and in 2nd year Rs.35000/- to Amar Singh which he used during the marriage of his daughter Kuldeep Kaur. Baldev Singh fixed the salary of Amar Singh Rs. 18,000/- for 1st year and 2nd year and Rs. 27,000/- for 3rd year. Amar Singh worked 3 years continuously for Baldev Singh. Baldev singh never paid him full wages when Amar Singh demands his earn wages from Baldev Singh he gives him only Rs. 100/- or Rs. 200/- after one month Baldev Singh took the sign of Amar Singh on some blank documents.During the work period Amar singh went to his house for half an hour for some work. After half an hour he came back at work of Baldev Singh. When he came back Baldev Singh’s son Roop Singh came in the fields and abused him on caste basis and make four fires nearby his feet on the earth and threaten him that he will not allow him to go anywhere before paying the bonded debt, If he will go then they will kill him.The employer was not paying him wages, abused him on caste base and threatened him that he will kill him so Amar Singh was not interested to work with Baldev Singh.When Amar Singh demanded his earn wages from the employer he does not pay him any wages but He demanded Rs. 60,000/- bonded debt from Amar Singh.Amar Singh approached to VSJ through a volunteer and for his release and rehabilitation a Complaint was sent to DM, Ferozpur Ref. No. DDVA/5393/09dated: 31/8/09. Now he is physically free and free from bonded debt.

Murugan Murder Case

    B. Karuppasamy, resident of Subramaniapuram, Kovilpatti Union, Thoothukudi District, belongs to Dalit Arunthathiyar community. His brother B. Murugan (36) is working as a cook in a Kerala Hotel. Murugan has lots of friends from Devar community. M. Kutty Raja (43), resident of South New Street, belongs to dominant caste hindu Devar community is one of his friend. On 25/08/09,

    Kutty Raja’s brother Venkat alias Venkatasen (41), went to watch the Patti Mandram organized in New Street. As a scuffle broke out between Venkat and other caste hindu Pillai community youths, Venkat was brutally assaulted by G. Velmurugan. On his return to home, he reported about this assault to his brother. Hence on 29/08/09, Kutty Raja along with Murugan, went to Velmurugan’s house to enquire about this. Infuriated Velmurugan verbally abused them saying, “how dare you come to my house and question me? He along with Mahesh Babu, Murugasen, Ganesh Moorthy, Jothiraj and Solairaj, carrying sickles in their hand, tried to attack Kutty Raja and Murugan. As Kutty Raja and Murugan ran towards the railway track, the perpetrators chased them down. Velmurugan attacked with sickle on Kutty Raja’s neck, he managed to block that attempt with his hand and sustained grievous injury in his hand. Murugan who came to the rescue of Kutty was targeted and slaughtered him to death. Then they mob threw him on the railway track. Kutty Raja begged for their mercy and he was spared from being killed. Later police have arrested all the perpetrators involved in the murder.

Brutal Assault and False Counter Cases

    M. Paechimuthu (37), resident of Urkaadu, Ambasamuthiram Taluk, Thirunelveli District, belongs to Dalit Paraiyar community. He is pig rearer. In 2008, T. Thangapandi Devar, resident of Urkaadu, belongs to dominant caste hindu Devar community, assaulted Paechimuthu. Hence Paechimuthu file a complaint with the Ambasamuthiram Police Station against Thangapandi and a case was filed under SC/ST PoA Act. Since Thangapandi is a lawyer and belongs to caste hindu, police filed false counter cases against Paechimuthu and remanded him jail. Thangapandi repeatedly threatened Paechimuthu to withdraw the complaint. Even the police officials in support of Thangapandi threatened Paechimuthu to withdraw the case. Later due to the influence the case was DISMISSED by the DISTRICT VIGILANCE AND MONITORING COMMITTEE as MISTAKE OF FACTS. But Paechimuthu filed an appeal with the High Court to review the case.

     

    Thangapandi repeatedly threatened Paechimuthu to kill him and his family on many occasion, for not withdrawing the case. On 28/08/09 11pm, inorder to intimidate and threaten paecimuthu, Thangapandi along with M. Shankar and S. Palaiyan trespassed into the pig farm and tried to steal his pigs. On seeing this, Paechimuthu tried to prevent them stealing. But Thangapandi verbally abused him referring derogatory regarding caste and threatened him saying, “you para son of prostitute, if you try to intimidate us, we will kill you and your family. Later Paechimuthu filed a complaint with the Ambasamuthiram Police Station, but the police men refused to register the case and compelled him to compromise with the perpetrators. They police have not arrested the perpetrators. On noticing the negligence of the police station, Paechimuthu filed a law suit against the perpetrators at the High court. As per the direction given by the High Court, Ambasamuthiram police officials registered an FIR against the perpetrators.

ATTACK AND CASTE ALIENATION

    Gollapalli Devamma (42) and her husband Malakondaiah are residents of Mahmadapuram village, Varikuntapadu mandal, Nellore District. They are agricultural workers and also have a small piece of land. There are only 3 families of SCs in the village. Devamma and Malakondaiah were often harassed by the dominant community to give away their land. On 25th Aug, 09 on the eve of Vinayaka chavithi both participated in the festival celebrations around 5.30pm. Chandra Venkaiah naidu of the same village insulted them and asked, “why did you come to our God” and abused them in the name of caste by using vulgar language. Sakamuri Subba Rao, Sakamuri Venkateswarlu, Chandra Prabhakar Naidu, Pagadala Venkateswarlu has also joined Venkaiah, abused on the name of caste. Chandra Venkaiah Naidu kicked Devamma in her lower abdomen and pushed her down. Kodidhina Kalavathi caught hold of her hair, beat her up and abused her in filthy language. Sakamuri Lakshmi, Sakamuri Kamala also joined and hit her on her chest and other parts. Chandra Venkaiah Naidu also beat her husband Malakondaiah when he tried to protect his wife. They all warned of dire consequences and said not to reveal to anybody. Sakamuri Subba Rao kept his leg on throat of Devamma and warned not to lodge a complaint or else they will be hanged. Venkaiah Naidu warned them to leave the village by leaving their house and land or else will kill them. The frightened couple stayed at house without coming out. On 26th Aug, around 12 noon Chandra Venkaiah Naidu, Sakamuri Subba Naidu, Sakamuri Venkateswarlu Naidu, Chandra Prabhakar Naidu and Pagadala Venkateswarlu came drunk to their home and Venkaiah Naidu pulled Devamma’s saree and put his hand on her chest. They all beat both of them forcing to leave the village immediately. They packed everything and waited for their son to come from Chennai. On 27th having noticed that they were still in the village, all the persons above mentioned planned to kill them. Having come to know Devamma and Malakondaiah escaped through fields and reached Pamuru. They could not lodge the complaint immediately as they were frightened. This harassment was for the past 30 years, they were treated as untouchables and forced to go for bonded labour. 10 years back Devamma stopped going to work in the fields of the dominant community for which they beat her. They also did not allow her to work under NREGA. At last they mustered courage and with the help of their son they lodged a complaint in Varikuntapadu PS.
