K. Karuppan (67), resident of JJ Nagar, Karai Ellaipalayam, Erode District, belongs to Dalit Arunthathiyar community. He is working as a daily wage farm laborer. On 26/04/09, when he was working in the Karaiyangaadu Agricultural filed, P. Thulasimani Kounder, belongs to dominant caste hindu Kounder community, on drunken state fell on the thorn fence due to intake of alcohol. Thulasimani cried for help and asked Karuppan to help him out. Hence Karuppan lifted him and helped him. On seeing this, Perumal Kounder, criticized Thulasimani for his drinking behavior. In return Thulasimani verbally abused him. Perumal Kounder met Thulasimani’s wife and reported the incident. Once Thulasimani returned home, her wife criticized him for his drinking behaviours. Thulasimani who felt humiliated and assuming that Karuppan had informed her wife about this incident, decided to beat him up. Hence along with karakattakaran alias Chinnasamy, went to Karaiyangaadu field. He brutally assaulted Karuppan for helping him out of the thorn fence by touching him. He verbally abused him referring derogatory regarding caste. On hearing the noise of the scuffle, Chinnasamy separated them. Later Karuppan went to Bhavani Government Hospital for medical assistance. He received treatment for five long days. Karuppan who sustained severe injury as being slapped on the ears, became deaf due to this assault. People belonging to Kounder community threatening him to withdraw the complaint. Police who were negligent and biased in favour of caste hindus, have not arrested the perpetrator. As Karuppan refused to withdraw the complaint, he and his family members are ostracized and denied jobs by the caste hindu agricultural land owners. This case was referred to the NHRC, Chief Minister and higher officials, but in vain without any hope for justice for the victim.
Later this case was DISMISSED as MISTAKE OF FACT by the DISTRICT VIGILANCE AND MONITORING COMMITTEE.
Musahari Tola in Ranti Brahmotra Musahiri village and found out that on 24th April, 2009 morning at around 8:00 am a huge gang of people from ‘Yadav’ community, resident of the neighboring village ‘Mohanpur Purvari Tola’ in ‘Pandol’ Panchayat under ‘Pandol’ police station stormed the ‘Musahar Tola’ in ‘Ranti’ Panchayat under ‘Rajnagar’ police station with 4 (four) tractors, including 46 people (as stated by one of the victims who were admitted to hospital due to resultant injury). The huge gang of perpetrators came to the village (Musahar Tola) and started beating the Dalits and also looted the possession of the Dalits as well as set fire on the houses of Dalits.
As a result around 74 Dalit houses were looted and burnt and around 70 more Dalit houses were looted and Dalit men and women were beaten including 8 seriously injured Dalits who had to be hospitalized. Talking to the villagers it is found that there had been tension between the two communities for more than a year. This tension was ignited by recent two incidents within the villagers of these two communities, namely: Dalits of ‘Musahar Tola’ asserted their right to fish in a stream of water which is a public resort. (Dated: 22nd April 2009) and Dalits of ‘Musahar Tola’ asserted their rights to vote according to their will during the current General Election 2009. (Dated: 23rd April 2009)
An FIR was registered against the perpetrators under IPC. The section of SC/ST (PoA) Act was not attracted in the FIR. The victims have not been rehabilitated and adequately compensated for the damage by the administration.
Saka Yesu Babu (40) s/o Masaraiah SC Mala is the resident of Gudala village, Allavaram mandal in East Godavari district. He is an employee in BSNL. On 18/04/09 around 5.30 pm he was returning to home from duty. When he reached Thadikona road center in Gudala an auto was parked in the middle of the way. Adapa Subrahmanyam s/o Butchaiah, Addala Venkanna (alias Chilaka) s/o Veerapandu and Thatikayala Sudhir s/o Venkateswara Rao were sitting in the auto. When Yesu Babu asked them to give way, all three came down the auto and said “vorai mala lanja kodaka yours is a small job, why we should give way to you, caught hold of his collar and beat him up. Though many people belonging to Kapu community were present there, they never came for his rescue. Immediately Yesu Babu lodged a complaint in Allavaram PS, but the complaint was not registered.
Next day i.e., on 19/04/09 the dalits have planned to organize a meeting around 10 am in the community hall at Gudala. Few dalits including women from a SC colony of Gudala were passing by Chandula Street to reach the meeting place. Pulime Ramudu, Pattem Nageswara Rao, Nukala Suri Babu and others stopped the dalit women and abused them in vulgar language. The dalit youth present with the women have opposed the Kapus. The above said men dragged Vaska Chadra Rao, Jalli Satyanarayana and Dasari Krishnayya into the house of Pattem Nageswara Rao (kapu) and beat them up severely. In this attack Chandra Rao’s hand was fractured and bleeding injury was caused to his head. Chandra Rao and Krishnayya have undergone treatment in KIMS hospital at Amalapuram. In the mean time the police took 8 dalit youth into custody. Having come to know about the incident the dalit women present in the community hall went and damaged the houses of the Kapus who attacked the dalit youth and abused the dalit women.
Since 2 decades the dalits have been attacked many times by the kapus and the disputes have become constant. Never justice was done to the dalits. The reasons are that all the police and revenue officials belong to kapu community.
Late Satyananran Ram (40) s/o Late Baldev Ram, Sushila Devi w/o Late Styananrayan ram is r/o Narayanpur village, P.O. Darihara, P.S. Mahuwa, Dist. Saran (Chhapra), belongs to Chamar (SC) community.
On the incident day, 07/04/2009, deceased Satyanarayan ram went to Laxmi chouk of the village to take a cup of tea. While returning home back, the accused persons namely Shasthradhan Shah s/o late Ramjeevan, Ratnesh Bhagat s/o Brahmadev, Abdhesh Shah s/o Chaturbhuj, Rakesh Bhagat s/o Rajendra, Raju Bhagat s/o Mathura, Vijay Bhagat s/o Yogendra, Manoj Thakur s/o Vishwanath, Rampravesh Bhagat s/o Rajendra, Sunil Bhagat s/o Shyambihari, Chandan Kumar Shah s/o Abdhesh, belonging to dominant caste community went with motorbikes and blocked his way. They abused him in caste name and beat mercilessly. When he tried to run and hide himself to save his life, the attackers opened fire at him and he died on the spot.
The reason behind the incident was that Late Satyananran was a School committee president, thus there a dispute between victim and dominant caste people over construction of school builind and thus Satyanarayad had lodged complaint in the police station, where many from dominant caste people were arrested. When they released on bail, took revenge of the incident.
A case was registered in Mahuwa police station on 08/04/2009, as No. 109/09, u/s 302,307,120B, 34 IPC & 27 Arms Act. Only 5 accused persons were arrested but bailed out. The case was acquitted in a Lower Court but the survivor has appealed in the Patna High Court.
Poja Kaur is a married Dalit woman, living in Dadpur Colony near Railway Station Alwar. On 5th April 2009, at 1:30 pm, the accused people telephoned her from Abbas Khan, friend of her husband Bunty informing that he was standing in front of Mittal Hospital and her husband had consumed too much liquor and not in conscience. Abbas also asked her to come immediately and take him to house. The victim immediately reached Mittal Hospital, where Abbas was standing. The victim asked for her husband, but Abbas replied that after getting another patient in the hospital, he would take Poja Kaur to her husband.
After some time Abbas took her to Bhagat Singh Juice shop and gave a glass of juice. After having juice, victim felt giddiness and so she asked Abbas to take her to husband. Upon this he took her to Budh Vihar and stopped in front of room and told her that her husband Bunty is lying inside the room. As soon as she entered into the room, she saw Manoj, another friend of her husband Bunty and the other person whom she did not know. All these three people caught hold of her and forced her to drink alcohol, after that raped her one after the other. They spent whole night over there and at about 7 a.m, they dropped her near the bridge. Manoj and Abbas threatened her not to tell this incident to anyone else or else she would face dire consequences.
After the incidence, the victim, with the help of one Karan managed to lodge complaint in Mahila Police Thana Alwar on 7 April, 09. On the basis of complaint the police registered a case No. 34/09, u/s 366, 328, 376(2) IPC & 3(2)(v) of SC/ST (PoA) Act. The police investigated the matter but did not arrest ManojYadav, the main accused; who was is a police constable living in Police Line Alwar, for a long time.
It was also observed in this case that Police Authorities wanted to protect the rapist Manoj Yadav, Police Constable in the same area and tried to weaken the case. The Public Prosecutor was also said to be influenced by another main accused Abbas and did not plead the case effectively in the special court. This is a very genuine case but because of lapses on the part of Public Prosecutor and maximum links of all powerful rapists with the police and justice providers. The SC/ST special Court Alwar acquitted the accused perhaps on technical grounds whereas credible evidences have been fully appreciated by the court. The laxity on the art of local police clearly proved in the view of the non arrest of the main accused Manoj Yadav constable and also diluted the evidences.
The tragedy of this case is that after acquittal of all powerful rapists by the court, the poor and helpless Dalit victim was so depressed drain that she beaten her little daughter who finally died. Now the poor helpless Dalit woman Pooja Kaur is undergoing jail sentence in Alwar.
