Case in Brief
Jyothi, aged 13 years, D/o Late Ramachandraiah, R/o Puduru village, Puduru mandal, Ranga Reddy district, Occ: Student, SC madiga by caste was studying in 7th class in Puduru ZP High School. Chetla Subash, aged 19 years, S/o Mannaiah, BC Mutarasi by caste, Occ: auto driver resides in the same village. He used to harass Jyothi every day while she was studying in 7th class in ZP High School. Once Jyothi’s elder brother Venkatesh studying 9th class observed this and tried to warn Subash, but Subash in turn threatened and beat Venkatesh. Unable to bear his harassment, Jyothi was joined in MV Foundation residential camp for girls in Aaluru. Subash used to go even there and harass her. He was warned by the teachers at the camp but he did not change. One day, when Jyothi and her friend have come out of the camp, he threatened and beat them and forcefully got them into his auto and left them at Manneguda. They stayed to night at Jyothi’s mother’s colleague and in the morning, Jyothi’s mother sent her friend to her village and took Jyothi with her. Finally on 3rd April 2007, at 10:30 in the morning, Subash came to Jyothi’s house when no one except Jyothi was there, threatened her that if she doesn’t come, he would kill her parents and took her forcefully in auto to a room in Vikarabad. He locked her there and came in the evening and took her to another room. He kept her in that room for 2 days and left her at her home on 5th April 2007. In those three days, he raped her 5-6 times. He also asked her not to reveal his name in case of pregnancy and in case she reveals his name, he would kill her.
As soon as Jyothi was kidnapped, her uncle and maternal grandmother complained in the police station as they doubted Subash. After Jyothi returned, Subash’s family offered Rs.10,000/- to Jyothi’s family to withdraw the complaint. Jyothi’s family did not agree. As soon as Jyothi returned, instead of taking her immediately for medical tests, the police have taken her for room verification. It is actually Subash whom the police should take for room verification but as they took Jyothi, she couldn’t identify the route properly. The police frittered away the valuable time in worthless investigation and sent her for medical examination after 2 days after her return, i.e., on 7th April 2007. FIR was registered u/s 366A, 376 of IPC on 7th April 2007 at Chanugomula Police Station bearing FIR No. 58/07.
