Mass attack on Dalits for celebrating Ambedkar Jayanti, Fatehpur village

  • Summary:: On 13th April’ 08 Sunday night at around 7.30 p.m. about 20-25 persons belonging to Gujjar community from Fatehpur village attacked 3 Dalits, who were busy with preparing for Dr Ambedkar’s 117th birth anniversary celebrations at Balmiki Temple, located on the K C Cinema Road. The assailants also demolished and attacked the infrastructure of the Balmiki Temple, broke the glass panel on the door which is shattered with splinters lying on the ground. The people living near the temple informed to the Balmikies Basti meantime police also reached the spot. The villagers, accompanied by police took the injured people and admitted in the B. K. Hospital. After some time 30-40 Gujjars went to the Hospital, well armed with rods, sticks and guns, first they cut the supply of electricity and closed the door of the Hospital and attacked Dalits, opened firing and started stoning. 12 Balmikies were grievously injured in that incidence. The police reached the spot after 5 hours of the incident. Firstly, this attack was on caste based discrimination because on every occasion of Ambedkar Jayanti or Ravidas Jayanti, the Gujjars used to refraining Dalits that “Don’t organize these programmes’, you belong to lower Community”. Secondly, the Balmiki Temple is located adjacent to K C Cinema Road, a big commercial complex, where the majorities are Gujjars. This is the biggest temple for Dalits in this area. The Dalits occasionally organize meetings of celebrating community festivals, these did not appeal to Gujjars On 13th April on Sunday night at around 7.30 p.m. Mukesh (34) Lohari , Karamvir (32) s/o Sonpal and Rajendra (33) s/o Jaypal r/o NIT – No.5, J Block, K.C. Road, Faridabad,Haryana all belonging to Balmiki community were busy in preparing for Dr Ambedkar’s 117th birth anniversary celebrations at Balmiki Temple located on the K C Cinema Road. This is the biggest temple for Dalits in this area. All our meetings are held in the room located inside the Temple Complex. The Dalits, mostly Valmikis who live near the temple, work as sweepers either for the Municipal Corporation of Faridabad or in the shopping complexes of the area. A few of them are also petty contractors. Suddenly a mob of 20-25 from Fatehpur village belonging to Gujjar community reached there and abused them in caste name and started beating. They also demolished and attacked the infrastructure of the Balmiki Temple. They broke the glass panel on the door which is shattered with splinters lying on the ground. The chairs and a Chowki were turned upside down. Ramesh, Roshan, Pramod belonging to Gujjar community continuously blow serious hits on their bodies and dragged them out of the Temple. Rajinder went unconscious for some time. When he regained his consciousness, he called his family members for the help. On the way to the Hospital his family members informed police officials of Police Chowki No- 5. Two Police officials immediately took them to B.K. Civil Hospital along with other victims for the medical examination. In the hospital their relatives, neighbors went to the hospital to meet them. That somehow the accused persons came to know that a case has been registered against them therefore in the night of 13th April at around 10.30 a mob comprising of 30-40 belonging to Gujjar community attacked in the hospital. Before the attack the accused persons totally cut off the electricity in the Hospital. 30-40 odd attackers were armed with Iron rods, sword, Pistols and sticks. They attacked and beaten up 35 family members and seriously injured 12 victims, who are now admitted in the Hospital. The victims were showered with caste abuses and battered. They said “Sale Chooron ab dekthe ho kya karoge “Salon chooron tumhe jaan se maar denge” The Cops present at the hospital failed to react and ran away from the spot. When the victims asked for the security they said we cannot do anything. Incidentally, a police post too is located barely 50 yards away from the hospital. However, the police authorities have arrested 12 offenders and booked them under various sections of the IPC and the SC/ST (Prevention of Atrocities) Act. A majority of them are Gujjars, from the nearby Fatehpur Chandela village. The ferocity of the attack can be seen in this hospital room. Rajendra Beniwal was attacked on his head; there’s been blood all over his T. shirt at the time of the incident. Barely 12-years-old, Rohit Tank has two fractures on his hand. Vinod Chauhan’s hand too is in plaster. And Gautam Valmiki’s face and nose are swathed in many bandages. That the cause of this attack is caste based discrimination with them. Dalit festivities during Ambedkar Jayanti or Ravidas Jayanti occasionally prompt Gujjars to remark, ‘Don’t organize these programmes’, you belongs to lower Community. That So far they have not received any sort of Compensation neither as per the SC/ST Act, nor they have received any relief from the authorities, though the D.M, S.S.P have visited the incident place on the 13Th night. That surprisingly the Investigation Officer assigned to investigate this case is of the rank of D.S.P from Traffic. That for the initial two days some police officials and PCR VAN did the patrolling near the Hospital and Temple but now that too has been removed despite the fact that victims are lying in the Hospital and situation remains tensed. That the people form Dalit communities from village are afraid of commuting in the area as the situation remains tensed. That on 13.04.08 Rajinder s/o Jaipal and Karamvir s/o Sohan Lal have lodged 2 different complaints and the case have been registered Case No 69 u/s 323/147/148 & SC/ST (POA) Act 3(1) (1)/33 & Case No 80 u/s 147/148/ 149/323/506 & SC/ST (POA) Act 3-33-89 respectively. The following dalits were seriously injured in the attack; they are Karamvir (32) s/o Sonpal, Mukesh (34) Lohari, Rajinder Chandaliya (38) s/o Jaipal, Rohit (12) s/o Khubiram, Rakesh (27) Simbu, Rajendra Beniwal (28) s/o Rojaram, Bishan (30) s/o Prahalad, Goutam s/o Srichand, Binod (25) Ramesh, Dinesh (30) The police arrested 12 offenders and booked them under IPC and the SC/ST (Prevention of Atrocities) Act. A majority of them are Gujjars, an intermediary caste, from the nearby Fatehpur Chandela village. SSP Faridabad, Alok Mittal, admits that the police were present in the hospital when the second attack took place. D.M, S.S.P has visited the incident place on the 13th night. For the initial two days some police officials and PCR VAN did patrolling near the Hospital and Temple but now that too has been removed despite the fact that the victims are lying in the Hospital and situation remains tensed. 12 persons from Gujjar community have been arrested and they are in the jail. Victims have not got any compensation or relief. Charge sheet not filed & Case is under investigation.

A Minor Dalit Girl was Abducted & Raped

    Rajora village is located 25 kilometers away from the District head quarter Dholpur. The village has around 620 families of different communities i.e. Thakur, Jatav, Pandit, Kachi, Kirar, Kumhar, Koli, Dhobi, Leel, Baniya, Vaishya, Balim and Muslim with a dominance of Thakur community. The main occupation of people here is agriculture and Dalits work on farms of Thakurs as daily wages laborers.

     

    Aarti has been living in the village Rajora Khurd since birth with her parents. On April 12th, 2007 around 7 pm, Aarti went to the fields nearby to fresh up. When she did not return home after some time, her family members started searching for her in the nearby fields. There he saw Aarti with a boy named Jaita (resident of the same village). On hearing her grandfather calling Anita, they ran away taking Jaita with them. When Ram Bharosi tried to run after them, he fell down and got hurt on his leg. Ram Bharosi informed about it to Aarti’s father Ram Babu who had gone to attend an engagement party.

     

    When the spread over, he took her to his home and brutally raped her. He did not let Aarti go her home and threatened her not to shout or else he would kill her.  When Aarti’s father did not find her, he went to the police Station to lodge complaint. Police lodged the complaint and while investigation came to know that the accused had abducted Aarti and kept her confined at his home. At 2 am, police went to his home and arrested him. Then the accused confessed that Aarti is at his residence. The police went his home and rescued the victim. Later on, a case of Rape was lodged by the police. As per Aarti, she was kept at the police station for six days and was also beaten up. For her safety one lady constable Gola Kumari stayed with her but only for one day. Her father used to take food for her from home. For determination of rape and age Aarti was sent for X- ray & medical examination on 15th April 2008. Statements under section 164 Cr.P.C. were not recorded in spite of insisting by Aarti’s father. On 14th April, culprit’s brother came to Aarti’s home and abused them and threatened them to withdraw the case and release his brother otherwise they will be killed. The Police lodged a missing complaint of Aarti registered by her father and investigated and thus arrested the accused. Later on, they interrogated the accused and rescued the victim. Police lodged an FIR of Rape against the accused. But they restrained the victim also in the police station for six days which was not an admirable act. They did so as they were of the thought that she will be pressurized by the society and accused family, so to avoid this, they restrained her in the police station. The victim’s statement has not been recorded under section 164 of Cr.PC. The charge sheet was submitted to the court.

     

    The medical of the victim was conducted on 15th April 2008 where her age came out to be 15-16 years. However, the medical examiner who was a male doctor, gave his opinion that nothing can be said about the occurrence of rape. He counted on FSL Report. The challan for the case was submitted under the court. The presiding officer acquitted the accused on account of benefit of doubt as the evidences turned hostile.

     

    The accused and her family are habitual offenders and they have been engaged in this kind of offence earlier also. His brother was involved in kidnapping of a Telia boy involving an amount of ransom of rupees 5 Lac. One of his brothers has been sent to jail under the charge of rape after which he was murdered. After the arrest of the accused, the family of the accused started threatening Aarti and her family to compel them for withdrawal of the case. On April 14th 2008, the brother of the accused went to Aarti’s home and abused them in filthy words and threatened them to kill if they will not take their complaint back. Victim’s Statement has not been recorded under section 164 of Cr.P.C. Challan has been submitted before the court. The culprit has been acquitted of the charges. The girl due to this incident was traumatized. She has now confined herself at home. The culprit has been acquitted from the charges due to which she is devastated

Murder of a Dalit on theft allegation, Habri village

  • Summary:: The incident happened on 10.04.08 in Habri village under the jurisdiction of Pundri Police Station, Kaithal District. The victim Rajendar (20) S/o Ram singh belongs to Valmiki community was charged with the false allegation of theft by the perpetrators Bhupender singh (45) and Virsingh belongs to the Jat sikh community from the same village and abducted the victim on 10/04/08 and beaten very cruelly with iron rod and sticks which cause serious injuries to the victim. Due to this attack he became very serious. Since it was the night time he found nobody in that way. Somehow the village Sarpanch Raguvir came to know about the incident and informed to the Pundri Police station at about 1 am. After some time two police officials went to the spot. Though he was very serious and about to die they did not take him to the hospital and did not take any steps to save his life. They simply left him in the spot itself and returned back to the police station. Due to the serious injuries and unbearable pain and also the negligence of the police the victim died in that spot. On 11/04/08 the next day morning the family and the relatives came to know about his death. Then his dead body was taken to the district Govt. hospital at Kaithal for the post mortem. On the same day 11/04/08 the case was registered in Pundri police station. The FIR no is 79/08 u/s 302/342/34 IPC. Perpetrators are arrested and in jail. So far no relief and compensation has been given to the victim’s family and the charge sheet also is not yet submitted in the court.

Bonded Labour at Sardar Zira Firozpur

  • Summary:: Kuldeep Singh S/o Tehal Singh, Aged 22 years is resident of village- Shahwala, tehsil-Zira, Distt- Ferozpur. He belongs to ‘Majhabi Sikh’ caste which is declares scheduled caste by the Govt of Punjab. He was worked for Chanan Singh Pardhan S/o Piyara Singh resident village- Shahwala, tehsil-Zira, Distt- Ferozpur. Kuldeep Singh was working from 2008 for the employer. The employer give him advance of Rs. 10000/- to bonded labourer which he has used to pay the bonded debt of his previous employer Hardeep Singh S/o Surat Singh of the same village. The employer fixed his salary 40,000 /- per year. The bonded labourer worked for the employer from 5:00am to 11:00 p.m. During the season he worked continuously day and night. The employer does not allow any leave for the bonded labourer. When the bonded labourer take a leave due to illness and due to other domestic purpose then the employer charged him fine of Rs.150 for day and night and add this amount in the advance amount and make an interest on the whole amount. After one year work when the bonded labourer demanded his wages to make his house then the employer abused him on caste base and demanded the debt of Rs. 26000 from the bonded labourer. The employer does not allow the bonded labourer to leave his work without paying the bonded debt .The bonded labourer was not interested to continue his work with the employer.When he approached to VSJ his complaint was filed before District Magistrate, Firozpur. Now he is physically free from bonded labour and bonded debt but he has not been given any release certificate from the concerned district administration.
