They did so as they were of the thought that she will be pressurized by the society and accused family, so to avoid this, they restrained her in the police station. The victim’s statement has not been recorded under section 164 of Cr.PC. The charge sheet was submitted to the court.
The medical of the victim was conducted on 15th April 2008 where her age came out to be 15-16 years. However, the medical examiner who was a male doctor, gave his opinion that nothing can be said about the occurrence of rape. He counted on FSL Report. The challan for the case was submitted under the court. The presiding officer acquitted the accused on account of benefit of doubt as the evidences turned hostile.
The accused and her family are habitual offenders and they have been engaged in this kind of offence earlier also. His brother was involved in kidnapping of a Telia boy involving an amount of ransom of rupees 5 Lac. One of his brothers has been sent to jail under the charge of rape after which he was murdered. After the arrest of the accused, the family of the accused started threatening Aarti and her family to compel them for withdrawal of the case. On April 14th 2008, the brother of the accused went to Aarti’s home and abused them in filthy words and threatened them to kill if they will not take their complaint back.
